The City Council of the City of Baytown Texas met in a Special Meeting on Thursday, July 24,
2017 at 5 30 P M. in the Council Chamber of the Baytown City Hall 2401 Market Street
Baytown, Texas with the following in attendance

Mayor Pro Tem Presley convened the July 24 2017 City Council Special Meeting with a
quorum present at 5.30 P M., all, members were present with the exception of Mayor DonCarlos
and Council Members Alvarado and Johnson who were all absent
PUBLIC HEARINGS
a Conduct the second public hearing concerning the involuntary annexation of
approximately 252 acres of land, generally located east of John Martin Road and west of
Garth Road on the north and south side of West Cedar Bayou Lynchburg Road, including
multiple parcels, Sheppard Road, Thomas Road Connally Road and the Harris County
Flood Control drainage ditch, east of its intersection with John Martin Road in Harris
County, Texas
At 5 31 P M. Mayor Pro Tem Presley opened and conducted the second public hearing
concerning the involuntary annexation of approximately 252 acres of land generally located east
of John Martin Road and west of Garth Road on the north and south side of West Cedar Bayou
Lynchburg Road including multiple parcels, Sheppard Road, Thomas Road, Connally Road, and
the Hams County Flood Control drainage ditch east of its intersection with John Martin Road in
Hams County Texas
Director of Planning and Community Development Services Tiffany Foster presented an
overview of the second public hearing concerning the involuntary annexation of approximately
252± acres as previously described, which is in and around where San Jacinto Boulevard would
be constructed She stated that staff began this involuntary annexation approximately three (3)
weeks prior to this meeting in an effort to protect the area around the city's mf rastructure Mrs
Foster stated that an improvement will be going through in this area to include a roadway and

utilities She farther stated that they're also looking to close a portion of an area located right
outside of the city limits to protect the city limits and to provide services to the residents in that
area She addressed a question that was asked at the last public hearing regarding the timing of
the utilities and stated that the utilities would be installed in and around that area along with
the San Jacinto Boulevard and therefore should be available within 21/2 yews Additionally,
she noted that the existing utilities will be allowed to be maintained even when the city has
utilities in place
Council Member Hoskins inquired for clarity, that at Evergreen, if a person had a septic or water
well system and sales their house would the new owners have to connect to the city's utility or
be able to maintain their current system Mrs Foster stated that as long as the existing system in
a good repair, the property owner could continue to maintain the existing system regardless of
the transferring of ownership
John Wayne Jackson Manuel San Miguel Diane Smith Robin Smith Terry Araujo Noal
Stephens, Rick Henderson, Gloria Medrano David Oehler Melva Catheriner and Judy Duncan
all registered to speak at the second public hearing regarding agenda item 1 a
Mr John Wayne Jackson stated that he lives at 5500 Sheppard Road and does not want to be
annexed into the City of Baytown as being annexed will bring more crime to their neighborhood
and that their streets will not be maintained properly
Mr Manuel San Miguel stated that stated that he lives at 2211 Connally Road and does not want
to compromise jeopardize or surrender jurisdictional Hams County tights and responsibilities
to the City of Baytown Additionally, he stated that his community is currently experiencing
much traffic, as well as, speeding in their neighborhood from outsiders and they have no need for
city services
Ms Diane Smith yielded her time to speak to her daughter Robin Smith
Ms Robin Smith stated that they live at 1410 W Cedar Bayou Lynchburg and believe that being
annexed would be beneficial to them as they currently have their land for sale Ms Smith
inquired as what services the city would provide that the county does not She noted that they
have issues regarding trees covering the power line in the front of their house that the county has
not removed to protect the power lines and further inquired if the city would be responsible for
such Additionally Ms Smith inquired if the property owner continued to maintain their own
utility services would they be responsible for paying taxes on those services even if they're not
receiving them Mayor Pro Tem Presley requested for Assistant City Manager Troller to provide
insight to the right -of way's maintenance and upkeep Assistant City Manager Troller stated that
Centerpomt would be responsible for the issue regarding the power line and that the property
owner would have to pay city property taxes
City Attorney Ignacio Ramirez noted to Mayor Pro Tem Presley that typically when receiving
information from a speaker there's not a question and answer period Mayor Pro Tem Presley
stated that the City Attorney's comments were duly noted

Ms Terry Araujo stated that she had several questions and Mayor Pro Tem Presley allowed for
her to ask her questions Ms Araujo inquired as to who's expense and responsibility would it be
to connect to city services Mr Ramirez stated that it's the property owner's responsibility to tie
into the right-of-way She further inquired if the property owner would have to search for a
plumber to complete the work necessary for the connection or will the city complete the job then
bill the property owner Council Member McCartney stated that the property owner would have
to provide their own plumber for such services Ms Araujo inquired if the pipes being used for
the water lines will be located in the area where the open ditches are or will her property line be
dug into so that the pipes are put there Mr Ramirez stated that the water and sewer lines will be
put in the City's right-of-way and not on the owner's property Council Member Hoskins noted
that once the lines are installed the ground will be covered to its previous state Mr Ramirez
further noted that once the lines are installed the right -of way may extend larger than the ditch
Additionally Ms Araujo stated that the Connally Road became a speed way for vehicles when
John Martin Road was complete, therefore, requested that speed bumps, as well as street
lights be installed and further inquired if the road alongside the Aldi's (South Road) would be
extended to Connally Road Mrs Foster stated that South Road is planned to be extended
at some point, but currently there were no construction plans for the City of Baytown to improve
or extend Mrs Foster further noted that there was a plan to extend South Road and when Aldi's
decided to develop in that area they (Aldi s) extended the road, as well as, a culvert sac right pass
the pipeline corridor so that if there's future development the developer could extend the road
Neal Stephens stated that he lives at 5719 Sheppard Road and according to the staff report for
the annexation he received there's a plan to extend South Road Additionally he stated that he
opposes being annexed into the city
Mr Rick Henderson stated that this involuntary annexation will increase the property owner s
taxes for those in their area Additionally, he stated that their area is already developed and
recommended to develop the areas towards the north and east that's undeveloped
Mrs Melba Cathenner stated that she lives at 5103 Bush Road in which the traffic is excessive
and the speed on the road is too high She inquired as to how long it would be before the fire
hydrant would be installed In response to Mrs Cathenner's inquiry regarding the fire hydrant
being installed Mayor Pro Tem Presley stated that an answer could not be speculated at such
time Mrs Cathenner further inquired that if an 8 It fence is built on the front portion of a
property how far back does it have to be from Bush Road Mrs Foster stated that the area in
question in not necessanly zoned, so the setbacks currently do not apply but will in the future
Mrs Foster further noted that the amount of right-of-way on Bush Road is much wider than what
was being seen on the paved road and because of such she was unable to provide the distance
from the right -of way and the paved street but stated that the 8 ft fence could be placed on the
property line
Ms Judy Duncan stated that she lives at 4701 Bush Road, Unit 26 and noted that because of the
growth in Baytown traffic has increased on Bush Road to include 18 wheelers Additionally she
stated that she's concerned that there will be more difficulties of residents being able to enter and
exit from their neighborhoods or residents on Bush Road with the increased speeding

Gloria Median, was provided speaking translation assistance by the City Clerk, Leticia Brysch
Through translation Ms Gloria Medrano stated that she lives at 5430 Aloe Avenue and her past
residency of thirty years was surtounding by drugs and vandalism She stated that they chose
their current residency to be able to live in calmness and tranquility Additionally she stated
that she understands the city's necessity and whatever is decided as appropriate they will accept
At 6:02 P M., Mayor Pro Tem Presley closed the second public hearing regarding agenda item
1 a.
MANAGER'S REPORT
Assistant City Manager Troller stated that staff will answer any questions that the property
owners may have, as well as, follow up with a response to the questions asked during the second
public heating that were not addressed Additionally, he stated that the first reading of the
ordinance related to this annexation will be at the Special Meeting held on Tuesday, August 15,
2017, at 5.30 P M., in the Council Chamber

A motion was made by Council Member Terry Sain and seconded by Council Member David
McCartney adjourning the July 24, 2017. City Council Special Meeting. The vote was as
follows
