AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, RATIFYING AND EXTENDING
THE ORDER ISSUED BY THE MAYOR PURSUANT TO THE TEXAS DISASTER ACT OF
1975, SUSPENDING CHAPTER 86 "SOLID WASTE," ARTICLE II "RESIDENTIAL SOLID
WASTE," DIVISION 4 `BAYTOWN GREEN CENTER," SECTION 86-104 `BAYTOWN
GREEN CENTER," SUBSECTION (C) "LOAD FEE" OF THE CODE OF ORDINANCES,
BAYTOWN, TEXAS, FOR ELIGIBLE DEBRIS RESULTING FROM HURRICANE HARVEY
AND DEPOSITED AT THE BAYTOWN GREEN CENTER; PROVIDING NOTICE;
PROVIDING SEVERABILITY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, on the 27h day of August, 2017, the Mayor issued an order and proclamation declaring a state
of disaster for the City of Baytown, Texas, resulting from Hurricane Harvey, which presented within the City of
Baytown an imminent threat of widespread or severe damage, injury, or loss of life or property and severe
economic and social disruption due to flooding, high winds and tidal surges and other public calamity resulting
therefrom; and
WHEREAS, on the 315` day of August, 2017, the City Council found that the ravages of Hurricane Harvey,
arising from its impact upon the property and inhabitants of the City of Baytown on August 26, 27, 28, and 29,
2017, continued to exist and extended the declaration of local disaster until terminated by the City Council; and
WHEREAS, because of the wide -spread damage, the Mayor issued an order suspending Chapter 86 "Solid
Waste," Article II "Residential Solid Waste," Division 4 "Baytown Green Center," Section 86-104 "Baytown
Green Center," Subsection (c) "Load fee" of the Code of Ordinances, Baytown, Texas, for eligible debris resulting
from Hurricane Harvey and deposited at the Baytown Green Center: and
WHEREAS, the City Council desires to ratify such order; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS;
Section 1: In accordance with Section 418.108 of the Texas Disaster Act of 1975, Local Government
Code of Texas, the City Council hereby ratifies and extends until December 31, 2017, the order of the Mayor
suspending Chapter 86 "Solid Waste," Article II "Residential Solid Waste," Division 4 "Baytown Green Center,"
Section 86-104 "Baytown Green Center," Subsection (c) "Load fee" of the Code of Ordinances, Baytown, Texas,
for eligible debris resulting from Hurricane Harvey and deposited at the Baytown Green Center. A copy of such
order is attached hereto as Exhibit "A," and incorporated herein for all intents and purposes.
Section 2: This ordinance shall take effect immediately froZand r its passage by the City Council
of the City of Baytown.

WHEREAS, by proclamation issued on the 271h day of August, 2017, the Mayor declared a state
of disaster for the City of Baytown resulting from Hurricane Harvey; and
WHEREAS, said state of disaster requires that certain emergency measures be taken; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF BAYTOWN, TEXAS:
Section 1- That effective immediately, Chapter 86 "Solid Waste," Article II "Residential
Solid Waste," Division 4 "Baytown Green Center," Section 86-104 "Baytown Green Center," Subsection
(c) "Load fee" is hereby suspended for eligible debris, as defined in such section, resulting from
Hurricane Harvey and deposited at the Baytown Green Center. This suspension shall remain in effect
until lifted by the Mayor.
Section 2: This order shall take effect immediately.
