Ordinance No. 13,581ORDINANCE NO. 13,581 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED TWO HUNDRED THIRTY-TWO THOUSAND THREE HUNDRED FIFTY AND NO/100 DOLLARS ($232,350.00) TO TRAFFICWARE GROUP, INC., FOR THE SOLE SOURCE PURCHASE OF SIX (6) TRAFFIC SIGNAL CONTROLLER CABINETS AND RELATED EQUIPMENT FOR THE ADAPTIVE TRAFFIC SIGNAL CONTROL SYSTEM DAMAGED BY HURRICANE HARVEY; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************************** WHEREAS, Texas Local Government Code Annotated §252.022 provides that when the functional requirements of the City can only be satisfied by one source, the requirement for competitive bids is not applicable; and WHEREAS, the City currently uses the equipment and software of Trafficware Group, Inc., for activation and monitoring of its adaptive traffic signal control system; and WHEREAS, the purchase of six (6) traffic signal controller cabinets and related equipment for the adaptive traffic signal control system damaged by Hurricane Harvey may only be purchased from a single source — Trafficware Group, Inc.; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that only one source can satisfy the needs of the City to integrate equipment and software into the City's adaptive traffic signal control system. Section 2: That the City Council of the City of Baytown authorizes payment to Trafficware Group, Inc., for the sole source purchase of six (6) traffic signal controller cabinets and related equipment damaged by Hurricane Harvey, in an amount not to exceed TWO HUNDRED THIRTY-TWO THOUSAND THREE HUNDRED FIFTY AND NO/100 DOLLARS ($232,350.00). Section 3: That the City Manager is hereby granted general authority to approve a decrease or an increase in costs by FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less, provided that the amount authorized in Section 3 hereof may not be increased by more than twenty-five percent (25%). Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
