Ordinance No. 13,579ORDINANCE NO. 13,579 AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, RATIFYING AND EXTENDING THE ORDERS ISSUED BY THE MAYOR PURSUANT TO THE TEXAS DISASTER ACT OF 1975, REGARDING PLATS FOR TEMPORARY STRUCTURES AND EXISTING SINGLE-FAMILY DWELLING UNITS DAMAGED IN HURRICANE HARVEY; PROVIDING NOTICE; PROVIDING SEVERABILITY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, on the 27th day of August, 2017, the Mayor issued an order and proclamation declaring a state of disaster for the City of Baytown, Texas, resulting from Hurricane Harvey, which presented within the City of Baytown an imminent threat of widespread or severe damage, injury, or loss of life or property and severe economic and social disruption due to flooding, high winds and tidal surges and other public calamity resulting therefrom; and WHEREAS, on the 31" day of August, 2017, the City Council found that the ravages of Hurricane Harvey, arising from its impact upon the property and inhabitants of the City of Baytown on August 26, 27, 28, and 29, 2017, continued to exist and extended the declaration of local disaster until terminated by the City Council; and WHEREAS, because of the wide -spread damage, the Mayor issued an order regarding plats for temporary structures and single-family dwelling units damaged in Hurricane Harvey in order to alleviate the suffering of people and to protect and rehabilitate properties within the City; and WHEREAS, the City Council desires to ratify such order; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS; Section 1: In accordance with Section 418.108 of the Texas Disaster Act of 1975, Local Government Code of Texas, the City Council hereby ratifies and extends the order of the Mayor regarding plat requirements for existing single-family dwelling units within the city limits damaged in Hurricane Harvey and temporary structures placed within the city limits in accordance with Chapter 22 "Civil Emergencies," Article IV" Post -Disaster Management," Division 2 "Emergency Waiver for Post - Disaster Temporary Accommodations" of the Code of Ordinances, Baytown, Texas.
