quorum present at 6:30 P M., all members were present with the exception of Mayor DonCarlos

Planning Manager, Christopher Chavis summarized the public hearing concerning proposed
amendments to the ULDC for trash enclosures He stated that the purpose of this Item is to
attempt to essentially screen and place waste containers and receptacles in an ideal location
via the ULDC He stated that the placement of the items would be on the side and rear yards of
development sites and apply to new developments only He stated that if the development has
challenges in meeting this standard there's a variance process that the developer can pursue
With there being no one registered to speak regarding agenda item 3.a., Mayor Pro Tem Presley
closed the public hearing at 6:51 P M

4 PROPOSED AMENDMENT TO UNIFIED LAND DEVELOPMENT CODE
(ULDC) REGARDING LIVABLE CENTERS (LC)
a Conduct a public hearing regarding proposed text amendments to the Unified Land
Development Code (ULDC) to amend the requirements for the Livable Centers (LC)
Zoning District to (1) change the property development standards by increasing setback
requirements, (it) remove the detail plan requirement, and (iii) decrease the size limits for a
Planned Unit Development (PUD) in a LC zoning district
At 6.53 P M., Mayor Pro Tem Presley opened and conducted a public hearing regarding
proposed text amendments to the Unified Land Development Code (ULDC) to amend the
requirements for the Livable Centers (LC) Zoning District to (i) change the property
development standards by increasing setback requirements, (ii) remove the detail plan
requirement, and (in) decrease the size limits for a Planned Unit Development (PUD) in a LC
zoning district
Sr Planner Manager Nathan Dietrich summarized the public hearing in regards to proposed
amendments to the text of the Unified Land Development Code (ULDC) for the Livable Center
(LC) Zoning District With regards to the change of the property development standards by
increasing setback requirements, he stated that currently there are no requirements for this
particular zoning district He further stated that the areas surrounding LC districts being Bayland
Island the Mall the cast side of Hwy 146 south of Hwy 99, and the old hospital site on
Decker, are generally commercial therefore the attempt is to make consistency with the way
development is trending in those particular areas
Regarding the removal of the detail plan requirement, Mr Dietrich stated that currently the way
the ordinance is written any development done within the livable center zoning district has to
provide a detail plan, which is a very onerous achievement for a developer and staff feels that
setbacks along with other requirements achieve the same revisions of such plan.
Additionally Mr Dietrich stated that they decreased the size limits for a Planned Unit
Development (PUD) in a Livable Centers zoning district to make the area more desirable
for redevelopment, as they are very visible locations within the City

a Conduct a public hearing regarding proposed text amendments to the Unified Land
Development Code to delete references to "towing service," to allow vehicle storage and
sandblasting only as accessory uses in the Mixed Use (MU) zoning district, to clarify the
definition of "towing yard," and to remove such redefined use from the Mixed Used zoning
district
At 6:57 P M., Mayor Pro Tem Presley opened and conducted a public hearing regarding
proposed text amendments to the Unified Land Development Code to delete references to
`towing service " to allow vehicle storage and sandblasting only as accessory uses in the Mixed
Use (MU) zoning district to clarify the definition of `towing yard" and to remove such
redefined use from the Mixed Used zoning district
Mr Dietrich presented a summary of the public hearing concerning proposed amendments to the
text of the ULDC He stated that the text amendments were to clarify and be more consistent
with the ordinance and noted the following changes as such
(i) delete references to 'towing service "
(ii) allow vehicle storage and sandblasting only as an accessory use in the Mixed
Use (MU) zoning district and
(iii) clarify the definition of "towing yard and (iv) remove such redefined use
from the Mixed Used (MU) Zoning District

Director of Engineering, Jose Pastrana presented the agenda item and stated that there are water
sheds protected under the ordinance in which one of the requirements is to maintain a 75 feet
buffer between any development and the protected watershed itself He further stated that the
current ordinance allows for a water treatment facility to exempt the properties above it from that
75 feet buffer and this amendment removes that language and allows staff to determine approval
based on its case

REPORTS
a Receive the City of Baytown's Quarterly Financial and Investment Reports for the
Quarter Ending June 30, 2017
Finance Director Wade Nickerson presented the agenda item the City of Baytown's Quarterly
Financial and Investment Reports for the Quarter Ending June 30 2017 He noted that the report
was discussed in detail at the Finance Committee meeting and that the budgets are expected to be
at 75% for this quarter He stated that the general revenues were at 94% of budget and further
noted that property taxes for IDA revenues were collected earlier in the year He stated that the
aquatics fund was at 40% but being that it is seasonal will increase towards the end of the
year He further stated that the water and sewer and the sanitation funds were above 75% of
budget
With regards to expenses, Mr Nickerson noted that the hotel/motel fund was at 15% primarily
due to funds being reserved for the conference center He stated that the water and sewer and
the sanitation funds were above 75% and noted that the the service contract was accrued at the
end of the year which is the reason the sanitation fund increased to 89%
Additionally Mr Nickerson stated that the investments are showing an upward trend
a Receive the Fiscal Year 2017 18 Budget for the Baytown Fire Control, Prevention,
and Emergency Medical Services District
Mr Nickerson presented the agenda item and stated that the Board of Directors ( Board") of the
Baytown Fire Control, Prevention, and Emergency Medical Services District ("FCPEMSD ) met
on Tuesday July 18 2017 and approved its Fiscal Year 2017 18 budget Additionally he stated
that the public hearing for this budget is scheduled for Thursday, August 10 2017
MUNICIPAL BUDGET FISCAL YEAR 2017 18
a Receive the City Manager's proposed municipal budget and budget message for
Fiscal Year 2017 18
City Manager Davis presented the agenda item and stated that an oral presentation of the budget
will be given on August 03 2017, and that this item was to actually submit the budget to
council
b Consider an ordinance setting the date, time and place for a public hearing
regarding the City of Baytown Fiscal Year 2017 18 Proposed Budget
Mr Nickerson presented the agenda item and stated that Ordinance No 13,526 sets the public
hearing regarding the City of Baytown Fiscal Year 2017 18 proposed budget for Thursday

PROVIDING FOR THE EFFECTIVE DATE THEREOF
11 MANAGER'S REPORT
City Manager Davis commended Pirates Bay staff for their prompt response to a man who was
having a heart attack Additionally he commended the traffic division of the public works
department for resolving a resident's safety concern in which has had many incidents happen
over the years
