AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE PAYMENT OF ONE HUNDRED FIVE THOUSAND SEVEN
HUNDRED SIX AND N011 00 DOLLARS ($105,706.00) TO KOMPAN, INC., THROUGH
THE U.S. COMMUNITIES GOVERNMENT PURCHASING ALLIANCE, FOR THE
PURCHASE OF A CUSTOM ARENA SOCCER FIELD FOR JENKINS PARK; MAKING
OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.

WHEREAS, the City of Baytown has consented to the Master Intergovernmental Cooperative
Purchasing Agreement, which authorizes the City, through the U.S. Communities Government Purchasing
Alliance, to purchase products and services, which lead public agencies have competitively bid, thus satisfying
the City's competitive bidding obligations; and
WHEREAS, the purchase of a custom arena soccer field for Jenkins Park may be purchased by the
City through the above -referenced cooperative purchasing program — the U.S. Communities Government
Purchasing Alliance; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the payment of ONE
HUNDRED FIVE THOUSAND SEVEN HUNDRED SIX AND N0/100 DOLLARS ($105,706.00) to
Kompan, Inc., for the purchase of a custom arena soccer field for Jenkins Park through the U.S. Communities
Government Purchasing Alliance.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND N0/100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25%) or
decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and
Council of the City of Baytown.
