2017 07 06 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN July 06, 2017 The City Council of the City of Baytown Texas met in a Special Meeting on Thursday, July 06 2017 at 4.34 P M. in the Council Chamber of the Baytown City Hall 2401 Market Street, Baytown Texas with the following in attendance Laura Alvarado Council Member Robert Hoskins Council Member Charles Johnson Council Member David McCartney Council Member Chris Presley Council Member Stephen H DonCarlos Mayor Rick Davis City Manager Ignacio Ramirez City Attorney Leticia Brysch City Clerk Keith Dougherty Sergeant at Arms Mayor DonCarlos convened the July 06 2017 City Council Special Meeting with a quorum present at 4:34 P M., all members were present with the exception of Council Member Sam who was absent a Consider an ordinance amending Chapter 42 "Health and Sanitation," Article V 'Live Outdoor Exhibitions," Section 42 286 "Permit required" of the Code of Ordinances, Baytown, Texas, to exempt events held at Town Square from the requirements of the Live Outdoor Exhibition Ordinance City Attorney Ignacio Ramirez presented the agenda item and stated that Ordinance No 13,497 amends Chapter 42 "Health and Sanitation, Article V "Live Outdoor Exhibitions " Section 42 286 "Permit required" of the Code of Ordinances, Baytown, Texas, to exempt events held at Town Square from the requirements of the Live Outdoor Exhibition Ordinance (the "Ordinance") He stated that currently the requirements includes a $100 application fee, $100 for each day of the event a $5,000 cash bond, and certificates of insurance evidencing commercial general liability coverage in the aggregate amount of $1,000,000 He stated that exempting all of the events at Town Square would eliminate the council from having special meetings to approve variances regarding such requirements draw visitors and citizens to the downtown area and hopefully encourage more event participation held at Town Square that will result in economic benefits for the businesses in the area Additionally Mr Ramirez noted that City Council City Council Special Meering July 06 2017 Page 2 of 3 amended the Ordinance to exempt events held at Town Square from the 500 foot distance requirement for this same reason, therefore, this amendment would clarify in more detail Health Department Director Mike Lester noted that the parks department rents the town square for events which has certain requirements causing the city to double dip on large events at the town square He stated that since Council wants more of the large events at Towns Square, it make sense to exempt the Town Square from the Live Outdoor Exhibition Ordinance and allow the parks department to control the activities at Town Square Council Member Hoskins inquired of the effective date once the amendment is approved and if the already scheduled event would be affected Mr Lester stated that during the discussions of this topic the intent was that the amendment would cover the already scheduled and future events Mr Ramirez stated that the effective date of this amendment is 10 days, but noted that the portion that's being amended does not impose a penalty therefore, could become effective immediately A motion was made by Council Member Robert C Hoskins and seconded by Council Member Charles Johnson approving Ordinance No 13 497 regarding agenda item La and amending the effective date to begin immediately The vote was as follows Ayes Mayor Stephen DonCarlos, Council Member Charles Johnson Council Member Robert C Hoskins Mayor Pro Tem David McCartney, Council Member Laura Alvarado Council Member Chris Presley Nays None Other Council Member Terry Sam (Absent) Approved ORDINANCE NO 13,497 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS AMENDING CHAPTER 42 HEALTH AND SANITATION " ARTICLE V "LIVE OUTDOOR EXHIBITIONS, SECTION 42 286 "PERMIT REQUIRED BY AMENDING SUBSECTIONS (E) DISTANCE REQUIREMENTS AND (N) "EXCEPTION" OF THE CODE OF ORDINANCES BAYTOWN, TEXAS, TO EXEMPT EVENTS HELD AT TOWN SQUARE FROM THE ORDINANCES REQUIREMENTS PROVIDING A REPEALING CLAUSE, CONTAINING A SAVINGS CLAUSE, PRESCRIBING A MAXIMUM PENALTY OF FIVE HUNDRED AND NO/100 DOLLARS ($500.00) AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF City Council Special Meeting July 06 2017 Page 3 of 3 MANAGER'S REPORT There was no report ADJOURN A motion was made by Mayor Pro Tem David McCartney and seconded by Council Member Laura Alvarado adjourning the July 06, 2017, City Council Special Meeting The vote was as follows Ayes Mayor Stephen DonCarlos Council Member Charles Johnson, Council Member Robert C Hoskins, Mayor Pro Tem David McCartney Council Member Laura Alvarado Council Member Chris Presley Nays None Other Council Member Terry Sam (Absent) Approved With there being no further business to discuss, Mayor DonCarlos adjourned the July 06 2017, City Council Special Meeting at 4.40 P M
