2017 06 22 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN June 22 2017 The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday June 22 2017 at 6:30 P M., in the Council Chamber of the Baytown City Hall 2401 Market Street. Baytown Texas with the following in attendance Laura Alvarado Council Member Robert Hoskins Council Member Charles Johnson Council Member Chris Presley Council Member Teny Sam Council Member David McCartney Mayor Pro Tem Rick Davis City Manager Ignacio Ramirez City Attorney Leticia Brysch City Clerk Keith Dougherty Sergeant at Arms Mayor Pro Tem McCartney convened the June 22 2017 City Council Regular Meeting with a quorum present at 6:30 P M. all members were present with the exception of Mayor DonCarlos who was absent Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Presley MINUTES Mayor Pro Tem McCartney stated that agenda items La and 1 b would be considered together City Clerk, Leticia Brysch noted that the May 25 2017 City Council Work Session minutes were not attached at the time of posting but was provided to Council at the Dias for viewing a Consider approving the minutes of the Baytown City Councd Work Session and Regular Meeting held on May 25, 2017 b Consider approving the minutes of the Baytown City Council Special Meeting held on June 01, 2017 A motion was made by Council Member Robert C Hoskins and seconded by Council Member Chris Presley approving the May 25, 2017 City Council Work Session and Regular Meeting minutes and the Jane 01 2017 City Council Special Meeting minutes The vote was as follows City Council Regular Meeting Minutes Jone 22 2017 Page 2 of 10 Ayes Council Member Charles Johnson Council Member Robert C Hoskins Mayor Pro Tem David McCartney, Council Member Laura Alvarado, Council Member Terry Sam Council Member Chris Presley Nays None Other Mayor Stephen DonCarlos (Absent) Approved RECOGNITIONS AND CITIZEN COMMUNICATIONS a Mr Chet Theiss requested to appear before the council regarding the possible development of a golf course at Evergreen Park Mr Theiss presented the agenda item and requested to stop the re purposing of the Evergreen Golf course into something else He stated that the demand for the golf course has changed since the city acquired the property and the fact that the city purchased this property takes a large income producing properties off the tax rolls for tax paying citizens He stated that the course is already there, but Just needs to be upgraded He further noted that re purposing it lacks wisdom with the typical design costs, topography drainage irrigation, and engineering costs for today's golf course being estimated at $100,000 $250,000 per hole Mr Theiss stated that what's being done to the course has forced golf athletes to other communities that are a fraction of the size of Baytown. He also recommended that Council entertain the thought of adding a golf feature to the proposed convention center and noted that the following areas that have convention centers that have golf courses South Shore Harbors Kingwood the Woodlands, and Newport in Crosby Additionally Mr Theiss stated that he presented this agenda item in an attempt to start a discussion regarding the golf course being re -purposed b Mr Kim Martin requested to appear before the Council to express appreciation to City Council and staff for their support of the Texas Nonprofit Theaters, Inc 2017 Youth Conference held at the Lee College Performing Arts Center June 6-11, 2017 Mr Martin presented the agenda item and expressed gratitude to the City of Baytown for making it possible to host the conference in the city He stated that the organization was partially funded through a grant fund from the hotel/motel tax and noted that this was the second year that they were able to utilize this type of fund for their event He stated that it's not the normal practice of the organization to go to a place more than one year in row, but because of the success of the conference in the year 2016 that had 400 people from around the state of Texas that participated, and whereas the city supported the organization and Lee College was the host the organization requested to come back to Baytown Mr Martin noted that he's the theater instructor at Lee College and a member of the Board of Directors of the Texas Nonprofit Theaters Inc. and further presented a plaque to Council as a token of appreciation of the support given in order to sponsor such event. Years Ignacio Ramirez, Sr, City Attorney Assistant City Attorney (Caren Horner replaced the City Attorney, Ignacio Ramirez at the Dais REZONING OF APPROXIMATELY 2.98 ACRES OF LAND a Conduct a public hearing regarding a proposed amendment to the official zoning map to rezone approximately 2.98 acres of land, located on the south side of Archer Road, approximately 367 feet west from its intersection with Garth Road, legally described as Tracts 7C, SA & 9A Block 22, Highland Farms, Baytown, Harris County, Texas, from an Open Space/Recreation (OR) Zoning District to a General Commercial (GC) Zoning District At 6.50 P M., Mayor Pro Tem McCartney opened and conducted a public hearing regarding a proposed amendment to the official zoning map to rezone approximately 2.98 acres of land, located on the south side of Archer Road approximately 367 feet west from its intersection with Garth Road, legally described as Tracts 7C, 8A & 9A Block 22, Highland Farms Baytown Hams County, Texas. from an Open Space/Recreation (OR) Zoning District to a General Commercial (GC) Zoning District Director of Planning and Community Development Services, Tiffany Foster presented the summary of the public hearing regarding agenda item 3.a. and stated that this area was recently annexed last month She stated that a developer requested to rezone the land with the desire of opening a German grocery store She noted that open space/recreation is what land is zoned to as soon as it's annexed She stated that this is consistent with the future land use plan for flus area and meets the criteria for zoning Additionally Mrs Foster stated that the Planning and Zoning Commission recommended approval of this zoning change City Council Regular Meeting Mmules June 22 2017 Page 4 of 10 With there being no one registered to speak regarding agenda item 3.a., Mayor Pro Tem McCartney closed the public hearing at 6.51 P M b Consider an ordinance amending the official zoning map to rezone ORDINANCES a Consider an ordinance authorizing a contract with Direct Expansion Solutions Inc., through the National Cooperative Purchasing, Alliance, for the Municipal Service Center HVAC Renovation Project City Council Regular Meeting Minutes June 22 2017 Page 5 of 10 Purchasing Manager, Drew Potts presented the agenda item and stated that the public works facility has a nineteen (19) year old HVAC system that needs to be replaced as it was designed to last for twelve (12) years He stated that this proposal replaces ten (10) standard units with three (3) state of the art Daikin VRV IV systems He noted that the new units will inn approximately 30 seer range whereas, the standard household would inn 13 16 He stated that this system will run twice more efficient, be quieter and give employees a little more flexibility regarding temperature Additionally he noted that the system will not be a forced air system but will be a controlled computerized system with a ten (10) year warranty A motion was made by Council Member Terry Sam and seconded by Council Member Chris Presley approving Ordinance No 13,493 regarding agenda item 4.a The vote was as follows Ayes Council Member ($485,000.00) TO DIRECT EXPANSION SOLUTIONS INC. Consider a resolution directing the preparation of a service plan for the involuntary annexation of approximately 228+ acres, generally located east of John Martin Road and west of Garth Road on the north and south side of West Cedar Bayou Lynchburg Road, including multiple parcels, the Harris County Flood Control drainage ditch, and the Archer Road right -of way, east of their intersections with John Martin Road in Harris County, Texas Mrs Foster presented the agenda item and stated that this item is the beginning of an involuntary annexation of approximately 228+ acres located east of John Martin Road and west of Garth Road along West Cedar Bayou Lynchburg Road She stated that Staff requested for Council to initiate a service plan which will direct staff to evaluate the area for the possible future annexation Additionally, she noted that this area is south of an area that was previously annexed Council Member Johnson recused himself from voting on agenda item 5.a.
