The City Council of the City of Baytown Texas met in a Regular Work Session on Thursday
June 22 2017 at 5:45 P M., in the Hullum Conference Room of the Baytown City Hall 2401
Market Street Baytown Texas with the following in attendance

Mayor Pro Tem McCartney convened the June 22 2017 City Council Regular Work Session
with a quorum present at 5.45 P M., all members were present with the exception of Mayor
DonCarlos and Council Member Sain who were absent
DISCUSSIONS
a Discuss any or all of the agenda items on the City Council Regular Meeting Agenda
for June 22, 2017, which is attached below
City Manager Davis stated that staff had an update for the Council regarding item 5.a which
states in pan that the City Council will consider approving a service plan for the involuntary
annexation of approximately 228 acres of land related to the San Jacinto Boulevard Project,
Phase II.
Mrs Tiffany Foster Planning and Development Services Director stated that the item before the
council later that evening relates to the approval of the creation of a service plan for an
involuntary annexation for approximately 228 acres of land She stated that this annexation is in
response to the Govemor's special legislative session in July where one of the items being
considered related to an annexation bill that would eliminate the City's ability to annex land
without voter approval She stated that the bill in question did not make it through the regular
legislative session and that it may not make it through the special session, however, staff
identified this area as being of high importance to the City for annexation purposes She noted
that this area does or will have the City's water and sewer infrastructure and San Jacinto
Boulevard and in order to protect that infrastructure it s beneficial to bring the area into the city

Mrs Foster stated that the approval of such agenda item allows staff to move forward with
creating a service plan that includes further investigation of the area to identify what types of
services would be needed if bringing the area into the city She stated that the area is about 147
parcels of land with 90 of which are residential She noted that most involuntary annexations are
contentious and much more so when there's lots of residents in which residents are never eager
to be annexed into the city
Mrs Foster stated that because of the possibility of the annexation bill passing through the
special session and coming into effect on September 1 st staff is racing against the clock and has
put together an aggressive annexation timeline that includes four (4) special meetings in order to
complete the annexation prior to September I st. She noted that staff will poll council members in
the next few days to check their availability for these special meetings She further noted that the
two meetings in July will be public hearings as required on any annexation, however, for
involuntary annexations staff has held the two hearings on separate days to allow the public more
opportunities to speak on the item, which is different from a voluntary annexation whereas both
of the public hearings are held on the same night. She further noted that the property owners
clearly want to be in the city limits
Mrs Foster stated that staff sent out notices of the involuntary annexation on Monday and have
since that time received approximately nine (9) calls inquiring about the City's intent with four
(4) calls being against the annexation She noted that one (1) call was acredit access business
(CAB) that moved out of the city in 2014 when the credit access business ordinance was
passed She stated that staff has identified two (2) such businesses in the area and while thetr use
is grandfathered in along with the 500 foot distance requirement from another CAB they will
have to comply with the City's CAB ordinance and registration It was clarified that the CAB's
we made up of title loan and payday loan establishments whereas the two (2) identified as being
impacted by this proposed annexation me on located at 1303 and 1502 Cedar Bayou Lynchburg
During further discussion Mrs Foster stated that as all the area annexed is going to be brought
into the city as open space recreational and like any other annexation, businesses will be able to
continue their same use and intensity but there's an issue still being researched that deals with
what happens when these businesses want to better themselves and request to be zoned. She
noted that at this time staff cannot promote a light industrial zone in this area because of all of
the housing Mrs Foster also noted that the parcels in question may or may not have water and
sewer, and many of them may be on a well and septic system She further noted that there's a
concern related to existing parcels with well and septic systems in which if someone wanted to
improve they could not do so, as Hams County would not allow them to because the lots are so
small Additionally Mrs Foster stated that staff will continue to work through these issues as
they go through the service plan process
The Council discussed the well water and septic tanks use options after annexation and the
planning of extending services to the area in question no later than four (4) yews after
annexation They agreed to be consistent and allow the newly annexed areas to continue the use
of their well water and septic system, unless they did improvements to their home which will
then require at that time for them to connect to the City's water and sewer system

The Council discussed the item briefly and requested that the staff move forward with the
involuntary annexation
