2011 06 23 WS MinutesMINUTES OF THE REGULAR WORK SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN June 23, 2011 The City Council of the City of Baytown, Texas met in a Regular Work Session on Thursday, June 23, 2011, at 4:35 P.M., in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Brandon Capetillo Council Member Robert Hoskins Council Member David McCartney Council Member Mercedes Renteria Council Member Terry Sain Council Member Stephen DonCarlos Mayor Robert D. Leiper City Manager Kevin Troller Assistant City Manager Ignacio Ramirez City Attorney Leticia Brysch City Clerk Keith Dougherty Sergeant at Arms Mayor Pro Tem McCartney convened the June 23, 2011, City Council Regular Work Session with a quorum present at 4:35 P.M., all members were present with the exception of Council Member Sheley who was absent and Mayor DonCarlos and Council Member Hoskins who arrived at 4 :45 P.M. 1. DISCUSSION a. Discuss Mayor Pro Tem Appointment, Processes and Procedures - City Council. City Manager Leiper presented the item to discuss the Mayor Pro Tem Appointment, Processes and Procedures and stated that staff has a concern with item number 5 on the guidelines for the appointment of the mayor pro tem that it is a violation of the Open Meetings Act, which constitutes a walking quorum. Council Member Capetillo stated that he shared this concern with the City Attorney Ramirez and recommended that item number five (5) and seven (7) be removed from the guidelines. City Manager Leiper stated that at one time the practice for appointing the mayor pro tem was to appoint the most senior member on council that had not yet served. Mayor Pro Tem McCartney stated that he believed the guidelines were pretty cut dry, but recommended a possible rotating system. Council Member Capetillo stated that some cities rotate the appointment every year after one (1) year of serving on the council, thus ensuring that all council members serve for one year during their three year term and is not placed in the position without some experience n the Council. The consensus of the Council is that the Mayor Pro Tern appointment would move to a rotating list of every six (6) months starting with district one, with the stipulation that they have already served one year on council. Also, before a member may begin his/her appointment he /she must meet with the Mayor and the outgoing Mayor Pro Tern to discuss the nature of the appointment. If anyone desires to pass on their Mayor Pro Tern appointment in the rotation, the next district will be appointed. City Manager Leiper recommended starting on July l" through December with the first term and then appointing the person next in the rotation in January 2012. Mayor DonCarlos stated that the Mayor Pro Tern should be available when he can not serve and they should not have to attend the TML training. City Manager Leiper stated that a revised procedure will be brought to the July 14`h meeting in reference to the Mayor Pro Tern being elected every six (6) months in a rotating order by districts, beginning with District 1. He also stated that if the Mayor or Mayor Pro Tern is not available another Council Member will be asked to serve as a representative of the Council. 2. APPOINTMENT a. Appointment: Urban Rehabilitation Standards Review Board - Planning and Development Services /City Clerk. City Manager Leiper presented the agenda item to discuss one (1) vacancy on the Urban Rehabilitation Standards Review Board, which is due to the resignation of Mr. Michael Brosseau, Registered Engineer who resigned on May 9, 2011. The Council's appointee for this position would fulfill Mr. Brosseau's unexpired term until February 28, 2013, where at that time they would be considered for reappointment to a full term. Mayor DonCarlos stated that he had someone in mind for the position and asked that this item be placed on the next Council meeting for action. 3. RECEPTION a. Hold Reception for Former Council Member Lynn A. Caskey II - City Management. Mayor DonCarlos invited all those present to join the Council at the reception honoring former Council Member Lynn A. Caskey II for his service to the City of Baytown Council District No. 5 and the citizens of Baytown. The reception was scheduled to be held in the area immediately outside of the Council Chamber. 4. ADJOURN With there being no further business to discuss, Mayor DonCarlos adjourned the June 23, 2011, City Council Regular Work Session at 4:50 P.M.
