The City Council of the City of Baytown, Texas met in a Special Work Session
on Thursday, March 03, 2011 at 5:35 P.M., in the Council Chamber of the Baytown City
Hall, 2401 Market Street, Baytown, Texas with the following in attendance:

Mayor DonCarlos convened the March 03, 2011, City Council Special Work Session
with a quorum present at 5:35 P.M, all members were present with the exception of
Council Members Caskey and Renteria.
1. DISCUSSIONS
a. Discuss Future Agenda Items - Administration.
City Manager Leiper introduced the item and stated that the following list of agenda
items will be discussed at the one of the meetings held during the month of March, also
noted that the list is subject to change:
• The multi- family registration program;
• Structural report from Carnes for Brunson;
• Hwy 146 Rezoning in Chambers County area (FM565 & HWY146);
• A pilot program with Waste Management;
• Preliminary numbers on the Census;
• Recognize the Lee Interact Club for their food drive;
• Police Department - show a new educational tool;
• Announce the winners of the 2011 Trash -Off T -shirt and 2011 TRAPS Award;
• Public Hearings: Ch. 130 Amendment modifying the Overlay & Ch. 126 The
Density & Building Setback;
• Church Changing the name of Atlantic St. to Willie B. Ridgell Drive;
• Receiving Exxon Donation for Wetlands and Education Center/Nature Center;
• Annual Report for Racial Profiling; and
• Appointments for Fire Control, P &Z, Tow Truck, Confirmation for Reserve
Police Officer, Mayor Appointments for the Housing Authority
Mayor DonCarlos stated that in regards to the proposed legislation regarding the Cedar
Bayou Navigation District, it is currently in Austin, but has not yet been considered. The
Mayor also stated that there are a series of meetings scheduled with a number of
representatives that could assists the City with this issue. Mayor DonCarlos stated that he
did meet with the Chambers County Judge regarding this legislation as Chambers County
is concerned with some of the language in the 2007 Legislation in regards to the
requirement changes to the chairmanship which will require them to appointment one (1)
of our the City of Baytown representatives as chairman. Mayor DonCarlos stated that he
would keep Council updated.
Council Member Capetillo inquired as to who files the legislation, and whether or not
there was any sponsorship from the Senate. Mayor DonCarlos stated that Craig Holland
has it in his office and due to it not being filed there is no Senate response at this time.
Council Member McCartney inquired if the Hwy 146 rezoning case will be discussed at
the upcoming City Council Work Session, followed by an action item on the City
Council Regular Agenda. City Manager Leiper stated this item will be on the work
session for discussion, but will not have an action because it has to go to the Planning and
Zoning Commission first; however, staff will provide Council a schedule for staff to
move forward. Council Member McCartney inquired if the oil and well drilling can be
resolved before the Hwy 146 rezoning is settled, City Manager Leiper stated it had to
wait until the rezoning is completed.
Council Member Capetillo stated that the amount of fluoride being put into the City's
water needed to be discussed for clarification purposes.
Council Member McCartney inquired about the status of the rebuilding of the Marina,
City Manager Leiper stated that this project is still in its design stage.
b. Discuss the City of Baytown Vision - Administration.
Council Member Sheley inquired about the changing of district lines in regards to
information. City Manager Leiper stated that a joint agreement is currently being worked
on with the Goose Creek Consolidated School District, and that staff has a target date to
complete this agreement by April.
Council Member Sheley also inquired if it is servicing the City better by having the
ownership of the empty property along the water front district or is it better to offer as an
incentive. City Manager Leiper stated that 99.9% of the land was applied as park land
and requires a city election, in order to sell or give the land away. Council Member
Sheley stated that portions of the Marina would be a good location for a youth center.
Council Member Slieley iii(licated that citizens have requested that the sidewalk trails
connect completely around the Bicentminial Park.
Council Member Sheley inquired about the Memorial Highway in(] rcquested to have

about Ibur (4) years ago, ]cg islatiort designated Spur 330 as the Veterans Memorial
Highway; however, the bill also stated that any public funds were not to be Used to
change the signage, which at that time cost $16,000, City Manager Leiper indicated that
