2011 11 01 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 01, 2011 The City Council of the City of Baytown, Texas, met in a Special Meeting on November 01, 2011, at 5:00 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Brandon Capetillo Council Member Robert Hoskins Council Member David McCartney Council Member Mercedes Renteria Council Member Terry Sain Council Member Stephen H. DonCarlos Mayor Robert D. Leiper City Manager Kevin Troller Assistant City Manager Ignacio Ramirez City Attorney Leticia Brysch City Clerk Keith Dougherty Sergeant at Arms Mayor DonCarlos convened the November 01, 2011, City Council Special Meeting with a quorum present at 5:00 P.M., all members were present with the exception of Council Member Sheley who was absent. 1. PUBLIC HEARINGS a. SECOND PUBLIC HEARING: Involuntary Annexation of Approximately 283 Acres of Land - Planning and Development Services. At 5:00 P.M., Mayor DonCarlos conducted the second public hearing regarding the proposed involuntary annexation of approximately 283 acres owned by LS Energy Properties, LLC, US Denro Steels, Inc., Cedar Crossing LP, NSN Properties LLC, and United States Steel Corporation being out of the W. D. Smith Survey, Abstract No. 23 and John Ijams Survey, Abstract No. 15 located east of FM 1405 and approximately 4,000 feet south of E. McKinney Road in Chambers County, Texas. City Manager Leiper stated that on October 11, 2011, the City Council authorized staff to prepare a service plan for the involuntary annexation of approximately 283 acres of land owned by LS Energy Properties; LLC, US Denro Steels, Inc., Cedar Crossing LP, NSN Properties LLC, and United States Steel Corporation being out of the W. D. Smith Survey, Abstract No. 23 and John Ijams Survey, Abstract No. 15 located east of FM 1405 and approximately 4,000 feet south of E. McKinney Road in Chambers County, Texas. This parcel is contiguous to the city limits of Baytown, is vacant and without residents. A City Council Special Meeting Minutes November 01, 2011 Page 2 of 2 service plan was created on October 14, 2011 and the property subject to the service plan is located within the Baytown Industrial District No. 3. City Manager Leiper stated that a notice of the first public hearings was published in the October 16, 2011, issue of the Baytown Sun and posted on the City of Baytown's notice board and website on October 14, 2011 and held on October 27th. Notice of the second public hearing was published in the October 20, 2011, issue of the Baytown Sun and posted on the City of Baytown's notice board and website on October 21, 2011. City Manager Leiper stated that the City is working with LS Energy and their Attorney is reviewing the alternate agreement which states they will pay a stipulated amount and a level up will be done after their appeal in which they have not yet filed with Chambers County. City Manager Leiper stated that an appeal must be resolved by May of 2012. With there being no one registered to speak, Mayor DonCarlos closed the public hearing at 5:03 P.M. 2. MANAGER'S REPORT City Manager Leiper stated that early voting is going on from 7:00 A.M. to 7:00 P.M. from October 31 at to November 4th and Election Day is on November 8th. 3. ADJOURN A motion was made by Council Member Terry Sam and seconded by Council Member David McCartney adjourning the November 01, 2011, City Council Special Meeting. The vote was as follows: Ayes: Mayor Stephen DonCarlos, Council Member Brandon Capetillo, Council Member David McCartney, Council Member Mercedes Renteria I11, Council Member Terry Sain Other: Council Member Robert C. Hoskins (Absent) and Council Member Scott Sheley (Absent) Approved With there being no further business to discuss, Mayor DonCarlos adjourned the November 01, 2011, City Council Special Meeting at 5:04 P.M.
