2011 03 01 CC Minutes, EmergencyMINUTES OF THE EMERGENCY MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN March 01, 2011 The City Council of the City of Baytown, Texas, met in an Emergency Meeting on Tuesday, March 01, 2011, at 5:03 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Brandon Capetillo Council Member David McCartney Council Member Terry Sain Council Member Stephen H. DonCarlos Mayor Robert D. Leiper City Manager Kevin Troller Assistant City Manager Ignacio Ramirez City Attorney Leticia Brysch City Clerk Mayor DonCarlos convened the March 01, 2011, City Council Emergency Meeting with a quorum present at 5:03 P.M. All members were present with the exception of Council Members Shelcy, Caskey and Renteria. Mayor DonCarlos announced that per Section 551.045 of the Texas Government Code, proper notice was given to the public of an emergency or unforeseeable situation two (2) hours before the meeting was scheduled to begin. 1. PROPOSED ORDINANCES a. Consider approving the Baytown Area Water Authority's Contract for emergency repairs to a BAWA 30 -inch water line - Engineering. City Manager, Bob Leiper presented the agenda item and stated that Ordinance No. 11,593 approves the authorization of General Manager of the Baytown Area Water Authority ( "BAWA ") to enter into a contract for emergency repairs to BAWA's 30 -inch water line located on W. Cedar Bayou Lynchburg Road across from West Road in an amount not to exceed $150,000. City Manager Leiper stated that this line has been leaking for an estimated ten (10) days; both the Engineering and Public Works worked together to repair the leak, and upon further review felt it was the repairs could not be completed in house and considered alternate options for the repair of said line. City Manager Leiper stated that while the line had not collapsed at this time, the leak is situation twenty (20) feet under a bridge that could collapse should the leak worsen. Staff recommends approving the emergency repairs of the BAWA's 30 -inch water line located on Cedar Bayou Lynchburg Road as its current state is a health and safety concern for our citizens. City Manager Leiper also stated that the same repairs were approved by the BAWA Board at its emergency meeting held at 4:00 p.m. today and if Council approved the item, they would be confirming BAWA's action. City Manager Leiper, in response to an inquiry from Council regarding who was paying for the repairs of this line, stated that the repairs of this line would be paid for by BAWA; however, state law requires Council to confirm all of the BAWA Board's contracts. Council requested the exact location of the leak; City Manager Leiper stated that the affected area is between the North Little League Park and storage business behind Wal- Mart. Council also requested that the contractors and staff be aware that the park would be having its opening weekend and communicate with the Little League Association about the repairs; City Manager Leiper stated that staff would make every attempt to work with the League; however, the main goal is the quick and efficient repairs of the line. Council also discussed concerns related to the driveway entrance to the park; Mr. Leiper stated that the repairs to the Little League driveway will be a part of the contract. Council discussed the three (3) quotes from the contractors, which are: • Angel Brothers, $130,000, remove and replace with 30" PVC by open cut method, • SKE Construction, $180,000, remove and replace with HDPE and cast iron joints by open cut method, and • Insituform, $400,000, line the existing line with a new CIP liner City Manager Leiper stated that the PVC was the best option and the least expensive; he also stated that PVC is what public works is using when it replaces water lines. City Manager Leiper stated that staff recommended awarding the bid to Angel Brothers; however, he also noted that the ordinance being authorized the city /general manager to execute a contract, so he would be negotiating the contract with Angel Brothers and that would not be coming back to Council. A motion was made by Council Member Terry Sain and seconded by Council Member Brandon Capetillo approving Ordinance No. 11,593. The vote was as follows: Ayes: Mayor Stephen DonCarlos, Council Member David McCartney, Council Member Brandon Capetillo, Council Member Terry Sain Nays: None Approved ORDINANCE NO. 11,593 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING AN EMERGENCY; APPROVING THE AUTHORIZATION OF THE GENERAL MANAGER OF THE BAYTOWN AREA WATER AUTHORITY TO EXECUTE A CONTRACT FOR EMERGENCY REPAIRS TO BAWA'S 30 -INCH WATER LINE LOCATED ON CEDAR BAYOU LYNCHBURG ACROSS FROM EAST ROAD IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FIFTY THOUSAND AND NO /100 DOLLARS ($150,000.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 2. ADJOURN With there being no further business to discuss, Mayor DonCarlos adjourned the March 01, 2011, City Council Emergency Meeting of at 5:10 P.M.
