2010 11 08 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 08,2010 The City Council of the City of Baytown,Texas,met in a Special Meeting on Monday, November 08,2010 at 6:31 P.M.in the Council Chamber of the Baytown City Hall,2401 Market Street,Baytown,Texas with the following in attendance: Brandon Capetillo Council Member David McCartney Council Member Mercedes Rentcria Council Member Terry Sain Council Member Stephen DonCarlos Mayor Garrison C.Brumback City Manager Bob Leiper Deputy City Manager Kevin Trailer Assistant City Manager Ignacio Ramirez City Attorney Leticia Garza City Clerk Keith Dougherty Sergeant at Arms Mayor DonCarlos reconvened the November 08,2010,City Council Special Meeting with a quorum present at 6:31 P.M. 1.PUBLIC HEARINGS a.Conduct the First Public Hearing Regarding the Proposed Annexation of Approximately 517 Acres of Property -Planning and Development Services. On Monday,October 25,2010,the City Council directed the Planning and Development Services Department to create a service plan for the involuntary annexation of the above mentioned property.A service plan was created on October 26,2010.Notice of the first and second public hearings was published in the October 28,2010,issue of the Baytown Sun and posted on the City's notice board and website on October 28,2010. At 6:31 P.M.,Mayor DonCarlos opened the first public hearing regarding the proposed annexation of approximately 517 acres of property located south of Interstate 10 between State Highway 146 on the east and Sjolander Road on the west,being out of the William Bloodgood League Survey,Abstract No.4,Harris County,Texas. At 6:35P.M.,Mayor DonCarlos closed the first public hearing. At 6:35 P.M.,Mayor DonCarlos opened the second public hearing regarding the proposed annexation of approximately 517 acres of property located south of Interstate 10 between State Highway 146 on the east and Sjolander Road on the west,being out of the William Bloodgood League Survey,Abstract No.4,Harris County,Texas. Richard Cansler,3425 Federal Street,Pasadena,stated that he was in opposition to the annexation of this property at this time.He stated that he along with other partners owned apiece of property in the proposed annexation.He also stated that there were no plans on what to do with the land,there was no possible development at this time,but felt that annexing the area and adding restrictions and codes would limit the possibilities for investment. City Manager Brumback,as a response to a question from the Mayor as it related to the utilities available in this area,stated that,atthis time had a water tank,towerand sewer in the area and could provide the necessary services to this area should annexations go forward.He also stated that the City did have some development controls over areas in the ETJ. City Manager Brumback also stated that the real issue with this annexation was that the City would prefer that the industrial district agreements (IDA's)be signed by the parties involved.He stated that IDA"s incentivized development and brought in revenue in a more stable manner.The annexation of said property is the City's last resort for those companies that don not want to sign their IDA's. Mayor DonCarlos stated that the City would consider all its options for developments and the best use of this property should it be annexed into the city.City Manager Brumback stated that should the property be annexed into the City,it would be zoned as neighborhood Conservation. Jason Garrett,a Joplin Representative,stated that he believed it was in their best interest to execute their IDA with the City and requested an opportunity to speak to a city representative regarding said matter;City Manager Brumback stated that he would schedule a meeting with Mr.Garrett offline.City Manager Brumback also stated that the City Attorney was in negotiations with Degussa and could have an agreement soon. At 6:44 P.M.,Mayor DonCarlos closed the second public hearing.
