The City Council of the City of Baytown, Texas, met in a Special Meeting on Thursday,
April 01, 2010, at 4:15 P.M. in the Council Chamber of the Baytown City Hall, 2401
Market Street, Baytown, Texas with the following in attendance:

Mayor DonCarlos convened the April 01, 2010, City Council Special Meeting with a
quorum present at 4:30 P.M.
Council Members Capetillo and Sheley were absent from the April 01, 2010 City Council
Special Meeting.
1. APPOINTMENTS
a. Change Order No. 1 to the Fire Station No. 6 Project.
City Manger, Garry Brumback presented the agenda item.
Director of Engineering, Jose Pastrana stated that Ordinance No. 11,335 authorizes
Change Order No. 1 to the construction contract with Hassell Construction Company,
Inc., for the Fire Station No. 6 Project in an amount not to exceed $194,904.00. The
original contract was for $1,993,300.00. This Change Order No. l will increase the
contract total to $2,188,204.00.

Change Order No. 1 is necessary due to the unexpected soil conditions encountered
during pier- drilling operations. This Change Order reduces the depth of the bell footings
and allows for a worst case scenario, given the existing soil conditions. Every effort will
be made to drill and place the concrete piers according to revised drawings, provided by
the architect of record, which represents the most cost effective alternative. However,
given the soil conditions, the alternative solution representing the worst -case scenario
may be implemented, partially or entirely. The final cost will be in between the best and
worst case scenarios depending on the number of pier shafts that collapse during drilling
operations.
This change order will extend the project completion from mid November until mid
December 2010.
A motion was made by Council Member Caskey, and seconded by Council Member Sain
approving Ordinance No. 11,335. The vote was as follows:
Ayes: Council Members: Yepez, Caskey, Sain, McCartney,
and Mayor DonCarlos

The motion carried.
ORDINANCE NO. 11,335
AN ORDINANCE OF Tum CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, AUTHORIZING CHANGE ORDER NO. 1 WITH
HASSELL CONSTRUCTION COMPANY, INC., FOR THE FIRE
STATION NO. 6 PROJECT; AUTHORIZING PAYMENT BY THE
CITY OF BAYTOWN, AN AMOUNT NOT TO EXCEED ONE
HUNDRED NINETY -FOUR THOUSAND NINE HUNDRED FOUR
AND NO /100 DOLLARS ($194,904.00); AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
2. ADJOURN
A motion was made by Council Member Caskey, seconded by Council Member
McCartney adjourning the February 04, 2010, Special Meeting. The vote was as follows:

and Mayor DonCarlos
