Ordinance No. 1,134• ORDINANCE NO. 1134 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 19 1/2, OFF- STREET PARKING, BY ADDING A NEW SECTION 19 1/2.1 IN ORDER TO NUMBER THE CLASSIFICATIONS FOR REFERENCE PURPOSES, AND IN ORDER TO ADD CHURCHES TO SECTION 19 1/2.1 (20) THEREOF; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by adding to Chapter 19 1/2, Off -Street Parking, a • new section 19 1/2.1 which shall read as follows: Section 19 1/2.1 Off -Street Parking Requirements. (a) There shall be provided hereafter at the time a plat is approved by the Planning & Zoning Commission, or at such time a building permit is issued for the erection or alteration of a structure, off-street parking spaces in accordance with the fol- lowing minimum requirements: (1) Bowling alley: Five (5) parking spaces for each alley. (2) Business or professional office, -studio, bank, medical or dental clinic: Three (3) parking spaces plus one (1) additional parking space for each two hundred (200) square feet of floor area over five hundred (500). (3) Community Recreation Center, librar , museum or art gallery: Ten (10) parking spaces plus one (1� additional space for each three hundred (300) square feet of floor area in excess of two thousand (2,000) square feet. If an auditorium is included • as a part of the building, its floor area shall be deducted from the total and additional the basis of parking provided on one (1) space for each four (4) seats that it contains. (4) Dance hall, assembly or exhibition hall without fixed seats: One parking space for each one hundred (100) square feet of floor area used thereof. (5) Townhouses, two-family and multi -family dwellings: Two and one quarter spaces per dwelling unit. Guest parking is. to be provided within three hundred (300) feet of each dwelling unit. (6) Fraternity, sorority or dormitory: One parking space for each three (3) beds. (7) Furniture or appliance store, hardware store, wholesale establish- ments, machinery or equipment sales and service, clothing or shoe repair or service shop: Two (2) parking spaces plus one (1) additional parking space for each three hundred (300) square feet of floor area over one thousand (1,000). (8) Hospital: Four (4) parking spaces plus one (1) additional parking space for each four (4) beds. (9) Hotel: One (1) parking space for each two (2) sleeping rooms or suites plus one (1) space for each two hundred (200) square feet •of (10) commercial floor area contained therein. Industrial Plants: The number of parking spaces required to ac- commodate all plant employees and construction forces on any single shift. (11) Mortuary or funeral home: One (1) parking space for each fifty (50) square feet of floor space in slumber rooms, parlors or individual funeral service rooms. (12) Motor -vehicle salesrooms and used car lots: One (1) parking space for each eight hundred (800) square feet of sales floor or lot area. (13) Private club, lodge, country club or golf club: One (1) parking space for each one hundred fifty (150) square feet of floor area or for every five (5) members, whichever is greater. (14) Retail store or personal service establishment, except as other- wise specified herein: One (1) parking space for each two hundred (200) square feet of floor area. (15) Restaurant, nightclub, cafe or similar recreation or amusement establishment: One (.1) parking space for each one hundred (100) square feet of floor area. (16) Rooming or boarding house: One (1) parking space for each sleeping room. (17) Sanitarium, convalescent home, home for the aged or similar institution: One (1) parking space for each (6) beds. i(18) School, elementary: One (1) parking space for each ten (10) seats in the auditorium or main assembly room, or one (1) space for each classroom, whichever is greater. (19) School, secondary, and college: One (1) parking space for each eight (8) seats in the main auditorium or three (3) spaces for each classroom, whichever is greater (20) Church, theater, auditorium (except school), sports arena, stadium, or gymnasium:_ One (1) parking space for each four (4) seats or bench seating spaces. (21) Tourist home, cabin or motel: One (1) parking space for each sleeping room or suite. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects.this ordinance shall be cumulative of other ordi- nances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provisions, section, exception, subsection, paragraph, sentence, clause, or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional,.void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable.
