Ordinance No. 664•r ' ORDINANCE NO. r264 • AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF. BAYTONIN, TEXAS, AND ANk1EXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION AND PASSAGE OF THIS ORDINANCE IN.THE MANNER PROVIDED IN ARTICLE 1, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: Intent and Purpose of this Ordinance: The City Council of the City of Baytown, acting pursuant to Section 9, of Article 1, of the Charter of.said City, hereby declares that it is.necessary that the herein- after described territory lying adjacent to. the City be annexed and the existing boundary limits of the City be extended to include such territory. The purpose and intent of this extension of the boundary limits of the City of Baytown is to take care of said City's present needs for additional territory and the reasonably anticipated future growth and expansion of the City Section 2: That the boundary limits of the City of Baytown, Texas, be enlarged and extended as hereinafter set out so as to include within the boundary limits of said City all that territory lying adjacent to said City within the following described lines, to -wit: TRACT NO. A is BEGINNING at the point of intersection of the centerline of Spring P P 6 Gully with the northerly shore line of Burnett Bay; THENCE, Westerly, Southerly and Westerly following the meanders of the shore line of Burnett Bay to a line that is 2500 feet from and parallel to the centerline of the Houston Ship Channel; THENCE in a Northerly and iesterly direction with the'line whish is 2500 feet at right angles and parallel to the centerline -of the .._ Houston Ship Channel to the intersection of the mean high tide line of the -East Shore of the San Jacinto River; THENCE, in a Northerly direction with the nean high tide line of the East Shore of the San Jacinto River to the intersection of a line which is 200 feet Northerly at right angles and parallel4tto the North right-of-way line of State Highway No., 73; THENCE, Easterly with the line which is 200 feet at right angles from • and parallel to the North right -of way line of State Highway No. 73 to the intersection of said line with the centerline or -Gooey crook Stream; THENCE, in a Southerly direction with the meanders of the centerline of Goose Creek Stream to the intersection of said Centerline with the North line of the Harvey Whiting League; THENCE, Westerly with the north line of the Harvey Whiting Survey to the easterly right-of-way line of State Highway Spur 33b`'(Decker.Drive); THENCE, Northwo9terly with the easterly right-of-way line of State Highway Spur 330 to the centerline of Spring Gully; iTHENCE, Southerly following the meanders of the centerline of Spring Gully to the point of 3EGINNING. TRACT NO. B BEGINNING at the point of intersection of the centerline of Goose Creek Stream with the north line of the Harvey V&iting Survey; THENCE, Easterly with the North line of the Harvey ('Whiting League to the Northeast -corner of the Harvey Whiting League said corner being a West line of the J. W. Singleton Survey; THENCE, Northerly along the said West line of the J. W. Singleton Survey to the; Northwest corner of said Survey; THENCE, Easterly along -the North line of said J. V. Singleton Survey to the Northeast corner of said Survey; THENCE, continuing an a line which is the South line of the Benjamin J. is Barrow Survey, and the North line of the D. M. McFadden Survey to the intersection -of said line with the mean high tide line of the tWest bank of Cedar Bayou; THENCE, Southerly with the meanders of the westerly shore line of Cedar Bayou Stream to the westerly right-of-way line of State Highway 146; THENCE, Southerly with the westerly right-of-way line of State Highway 146 to a line which is 200 feet north of and parallel to the north line of the Massey -Tompkins Road; THENCE, Westerly with the line that is 200 feet north of and parallel to the north line of the Massey -Tompkins Road to the east right-of- way line of Worth Main Street; THENCE, Northerly with the east ri&,ht-of-way line of North Main Street to an easterly extension of the north line of a 309.19 acre tract of land owned by the estate of Dr. and Mrs. G. A. Lilly; • THENCE, Westerly over and across North Main Street to the northeast corner of the 309.10 acre Lilly Tract, and continuing Westerly with the north line of the Lilly tract to the northwest corner of the Lilly tract; THENCE, continuing Westerly with the South line of a 189.05 acre tract of land owned by Wilburn Brothers to the east right-of-way line of Garth Road; THENCE, Westerly over and across Garth Road and continuing westerly with the south right-of-way line of Baker Road to the centerline of Goose Creek Stream; THENCE, Northerly with the meanders of the centerline of Goose Creek Stream to the point of BEGINNING. Section 3: That the above described additional territory and area so 0 annexed shall be a part of the City of Baytown, and the property so added to said City shall bear its pro rata part of the taxes levied by the City of Bay-; town and the inhabitants thereof shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, regulations and provisions of the Charter of the City of Baytown. -2- C� U SQction 4: That if any portion or portions of the above described territory is validly included within the territory limits of another city or town, then such portion or portions of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown, and the boundary limits of said City are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Seotiqa 5: That if any portion or portions of the above described ter- ritory legally may become included within the limits of another city or town, by reason of a valid annexation ordinance heretofore introduced before the coup- cil, commission or other governing body of such city or town, then such por- tion or portions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Baytown and the boundary .limits of said City of Baytown are .. hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Section B: That if any legal inpediment exists preventing the valid annexation of any portion of the above described territory to the City of Baytown, then such portion of the above described territory is hereby excluded and the remaining territory is hereby ammexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the territory so annexed. Section 7: If any provision, exception, section, paragraph, sentence, caluse or phrase of this ordinance or the application of same to any person or set of circumstances or the any particular tract or parcel of land, shall for any reason be held unconstitutional, void, or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or theira, application -to other persons or sets of circumstances or to other tracts or parcels of land included in the territory hereinabove described in Soctio- 2 of this ordinance. -3- � 6 - Section 8: That this ordinance upon and after its introduction shall be published and finally acted upon in the manner provided in Article 1, Section 92 of the Charter of the City of Baytown, INTRODUCED, READ and PASSED by the affirmative vote of -.majority of the City Council of.the City of Baytown on this the 29th day of November, 1962. _ATTEST: Edna Oliver, City Clerk � a• I* - a LA!� Al Clayton, Mayor -4-
