ORDINANCE N0. 514
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, RECEIVING AND ACCEPTING THE WORK OF CON-
STRUCTION OF PERMANENT PAVING AND OTHER IMPROVE-
MENTS WITHIN THE FOLLOWING DEFINED PORTIONS OF
CAROLINA STREET IN THE CITY OF BAYTOWN; AUTHOR-
IZING AND DIRECTING THE EXECUTION AND ISSUANCE
OF SPECIAL ASSESSMENT CERTIFICATES TO BROWN &
ROOT, INC., THE CONTRACTOR PERFORMING SAID WORK;
APPROVING THE FORM OF SUCH SPECIAL ASSESSMENT
CERTIFICATES; AND PROVIDING FOR THE EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1. That the work of improving Carolina Street from
end to end, i. e., from the north property line of Missouri Street
to the south property line of West Main Street within the City of
Baytown, Texas, by raising, grading, filling, widening, perma-
nently paving and repaving same, and by the construction, recon-
struction, repairing or realigning of concrete curbs and gutters,
and by the construction of such drains and other necessary inci-
• dentals and appurtenances as deemed necessary by the City Engineer,
said permanent paving consisting of an adequate asphaltic wearing
surface upon a substantial concrete base, both of such type, con-
struction, materials and thickness as have been deemed adequate
and proper by said City Engineer, and all of said improvements
being as provided for in the Plans and Specifications therefor
which have heretofore been prepared by the City Engineer and as
have been approved and adopted by the City Council; and all of same
having been performed and completed in full accordance with all
the terms and provisions of the contract dated May 28, 1958,
• between said City of Baytown, Texas, and Brown & Root, Inc.; and
said City,Engineer having measured, examined and caused to be

tested the finished improvements by the means and in the manner
provided by the terms of said contract and the Plans and Specifi-
cations, and having found that such improvements have been con-
structed and completed in full compliance with all provisions of
said contract and said Plans and Specifications, and said City
Engineer having approved and accepted said work and improvements
and having heretofore issued his Certificate of Final Acceptance,
and so certified to said City Council and recommended that it
accept and receive said work and the improvements as constructed
and completed by said Brown & Root, Inc., and said work and improve-
ments having been examined and found by the Mayor and City Council
of said City of Baytown, Texas, to have been performed and com-
pleted in full compliance with said contract and said Plans and
Specifications therefor, said work and improvements are hereby
found by said City Council to have been performed and completed
by said Brown & Root, Inc., in full compliance with the terms and
provisions of said contract and said Plans and Specifications
therefor, and same are hereby accepted and received by said City
Council of the City of Baytown, Texas.
Section 2. That the Mayor and City Clerk of the City of
Baytown, Texas, are hereby authorized and directed to execute and
issue to Brown & Root, Inc., Special Assessment Certificates evi-
dencing the assessments levied against the properties improved
abutting upon said portions of Carolina Street and against the
real and true owners thereof, which, by the terms of said contract,
the City of Baytown, Texas, has agreed and obligated itself to
issue and deliver to said Brown & Root, Inc., in accordance with
provisions of the relative proceedings heretofore had and adopted
by said City Council; said Special Assessment Certificates to be
executed in the name of said City by its Mayor and City Clerk,
and impressed with the seal of said City, and dated as of the

date hereof, and such officers are hereby authorized and directed
to execute said certificates in their official capacities on
behalf of said City, and deliver same to said Brown & Root, Inc.',
said Special Assessment Certificates having heretofore been pre-
pared and printed, a copy of which is on file with the City Clerk,
the form and contents thereof being hereby approved and adopted.
Section 3. This ordinance shall take effect from and after
• the date of its passage by a majority of the City Council of the
City of Baytown..
INTRODUCED, READ AND PASSED by a majority of the City
Council of the City of Baytown, Texas, on this the 25th day of
November, 1958.
