AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
RENEWING THE ANNUAL POLICE UNIFORM CONTRACT WITH RED THE
UNIFORM TAILOR, THROUGH A COOPERATIVE AGREEMENT WITH THE CITY
OF FRISCO, FOR THE PURCHASE OF POLICE UNIFORMS AND BODY ARMOR;
AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN OF AN AMOUNT
NOT TO EXCEED NINETY THOUSAND AND N0/100 DOLLARS ($90,000.00);
MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement for
cooperative purchasing with the City of Frisco; and
WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids received
by the City of Frisco; and
WHEREAS, the City of Frisco has taken bids for police uniforms and body armor for the Police
Department; and
WHEREAS, the City of Baytown in making a purchase under a cooperative purchasing agreement
satisfies state law requiring municipalities to seek competitive bids for the purchase of the items; and
WHEREAS the City Council of the City of Baytown, Texas, awarded Red the Uniform Tailor the
Annual Police Uniform Contract on April 9, 2015, pursuant to the above -referenced interlocal agreement,
which annual contract included an option by the parties to renew for additional one-year periods; and
WHEREAS, such contract has been renewed one (1) time and may be renewed again for an additional
one-year term; and
WHEREAS, Red the Uniform Tailor has indicated its willingness to renew the contract for an
additional year under the same terms and conditions; and
WHEREAS, the Administration has reviewed the market conditions and recommends renewal as being
in the best interest of the City; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby renews the Annual Police
Uniform Contract with Red the Uniform Tailor through a cooperative agreement with the City of Frisco, for
the purchase of police uniforms and body armor, in the amount of NINETY THOUSAND AND NO/100
DOLLARS ($90,000.00) and authorizes payment thereof.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND N0/100 DOLLARS ($50,000.00) or less,
provided that the original contract price of each item specified in Section 1 hereof may not be increased by
more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent
of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
