February 09, 2017, at 6.34 P M in the Council Chamber of the Baytown City Hall, 2401 Market

Mayor DonCarlos convened the February 09, 2017, City Council Regular Meeting with a
quorum present at 6.34 P M. all members were present with the exception of Council Member
Hoskins who arrived at 7 11 P M

a Consider approving the minutes of the Baytown City Council Regular Meeting held
on January 12 2017
A motion was made by Council Member Terry Sam and seconded by Mayor Pro Tem David
McCartney approving the January 12, 2017 City Council Regular Meeting minutes The vote

2 RECOGNITIONS AND CITIZEN COMMUNICATIONS
a Mr James Herndon requested to appear before Council to address concerns with a
neighbor operating an ATV repair business out of their home in a residential area
Mr James Herndon was not present
b Mr Russell Hamman requested to appear before the Council in regards to the
revitalization of the Brunson Theater & Texas Ave
Joy Greenawalt, Jame Polo Lydia Martinez Yolanda Polo, Mark Schrock, William Hall Denice
Young, Enn Flores, and Billy Barnett all registered to speak regarding agenda item 2.b
Mr Hamman stated that he's the creator and administrator of the facebook site called Haniman's
Baytown History with a Twist He stated that he support's any and all efforts to revitalizing the
Brunson Theater and Texas Avenue in whatever aspect that may be He stated that their slogan is
when we save Brunson, we can save Texas Avenue He stated that he took a poll on facebook
asking the question that if the Bronson was restored in any capacity would you patronize that
business and there was 460 yes responses 15 no responses, and 15 maybe responses He stated
that in reference to a different facebook site the question was asked, 'what you would rather see
stored' Texas Avenue or San Jacinto Mall and there was 115 responses to Texas Avenue He
further presented poll results from other facebook sites regarding patronizing the restored
Brunson and there were more yes responses than there were for the other responses Mr
Hamman stated that he gives the City of Baytown the authority to use his 2nd film project called
"The Both, The Life, The Death, and the Hope of the Brunson Theater' to use as necessary He
stated that the family who owned the Brunson Theater supports him and his groups efforts
regarding the restoration of the theater and that they also provided him with personal
archived pictures of the theater in which he presented to council Additionally he stated the
Brunson is part of Baytown's legacy and urged council to brig it back to life
Ms Joy Greenawalt stated that when she graduated from Baytown Junior High in the ninth grade
in 1951 she remembered loading up in cars with friends and going to the Brunson Theater She
stated that the theater has been a part of her family history for many years as her younger
daughter even worked there Additionally Ms Greenawalt requested that the Bronson be
brought back to beauty it once was
Mr Mark Schrock stated that he was born in Baytown, but moved away and returned with plans
to retire here He stated that he's heard stones of the Brunson Theater and supports the city on its
endeavor to restore Texas Avenue and bring back the home town atmosphere
Mr William Hall stated that he's learned about the task of restoring the City of Baytown's
landmarks through Mr Hi mman's facebook group which covers the history of Baytown and
things part of earlier generations He stated that the group was created on September 10 2016
and to date includes 5 450 members which is approximately tlurty six members per day

Additionally Mr Hall stated that his hope is that the work created on the Brunson Theater will
be revived
Ms Demce Young stated that she has a passion to see Texas Avenue come alive again
starting with the Brunson Theater She stated that other towns such as San Antonio, Liberty,
and Taylor have refurbished their theaters She stated that the Majestic Theater in San Antonio
remained on a self-sustaining basis and was registered under the National Historic Places She
stated that a property listed in the national register may qualify for a tax incentive derived
from the total value of expenses incurred for preserving the property She stated that the National
Historic Preservation Act established a process for adding properties to it and of the million
properties on the register 80,000 are listed individual and each year approximately 30,000
properties are added to the registry She noted that the Brunson should be part of that registry
She further stated that as parking may be an issue one of the empty concrete lots could be
developed into a multi purpose level parking garage whereas the city could charge for Ms
Young inquired if a business would be allowed to invest in rehabbing the facility then utilize the
budding rent free long enough to receive a return on their investment, which will save the theater
and further be a valuable piece of real estate
Mr Erin Flores stated that he's a local business owner in Baytown and participated in speaking
regarding the Bronson Theater some years past with another developer He noted that he's
working with Mr Hamman with regards to the video footage documentary of the Brunson
Theater He further stated that the economic social and entertainment missions regarding the
Brunson will provide Jobs for Baytown and additionally stated that he's willing to work with the
new developer on the Brunson Theater
Mr Billy Barnett forfeited his time to speak
Mr Russell Wilson and Ms Jessica Sauceda did not speak but stated that assumed that they
were supposed to sign in.
Mayor DonCados noted that there's an attempt for the City to engage in a partnership for
a worthwhile development for the Brunson Theater that everyone should be proud of and that an
announcement will be made once an agreement is signed Additionally he requested for
everyone to patronize the current merchants on Texas Avenue for their services

a Conduct the public hearing concerning a proposed amendment to the official zoning
map to rezone approximately 0 72 acres of land, located at 906 Massey Tompkins Road
legally described as Tract 30B out of the J W Singleton Survey, Abstract 709, Baytown,
Harris County, Texas, from Mixed Residential at Low to Medium Densities (SF2) to

At 7.06 P M., Mayor DonCarlos opened and conducted the public hearing concerning a proposed
amendment to the official zoning map to rezone approximately 0 72 acres of land, located at 906
Massey Tompkins Road, legally described as Tract 30B out of the J W Singleton Survey,
Abstract 709 Baytown Hams County, Texas, from Mixed Residential at Low to Medium
Densities (SF2) to General Commercial (GC)
Senior Planning Manager, Nathan Dietrich presented a summary of the public hearing and stated
that the zoning map amendment request was made by the property owner He stated that the
parcel of land is located just outside of Apache Meadows single family residential subdivision
off of Massey Tompkins He stated that in 2013 when the city did a city wide rezoning this
parcel was lumped into the single family residential neighborhood and the owner would like to
use this property for commercial property for a real estate office He stated that in reviewing this
Particular request staff noticed that it followed the narratives of future land use plan and believes
that it will fit within the Massey Tompkins commercial corridor
Patty Herrera and Marcia Fraley registered to speak regarding agenda item 3.a., but did not do

At T09 P M. Mayor DonCarlos opened and conducted a public hearing regarding an
amendment to the Baytown 2025 Comprehensive Plan's Future Land Use Plan (FLUP) from
Low Medium Density Residential to Commercial Corridor and Industrial Buffer in select areas
along Bayway Drive from Decker Drive to Park Street
Mr Dietrich presented a summary of the public hearing and stated that this endeavor started
where staff decided to put more intense uses along the Bayway corridor based on inquiries done
by residency in and around this area He stated that currently according to the future land use
plan this area is designated as low to medium residential density, which is not ideal to facilitate
the expected and desired development along Bayway Drive He stated that the land use
assessment conducted by staff, considered criteria including but not limited to, existing land
uses maximum potential of current lot sizes, long -tern property holdings non conforming
properties and land use progressions He noted stated that the amendment is the change the

FLUP allowing for a Commercial Corridor Designation from the Spur 330 to bottom of Decker
near the Exxon Plant Additionally, he noted that alongside of Exxon's campus there was an
industrial buffer in which an increase in size of such buffer is being requested as additional
property has been purchased in this area as well
With there being no one registered to speak regarding agenda item 4.a. Mayor DonCarlos closed

At 7 14 P M. Mayor DonCarlos opened and conducted the public hearing concerning a proposed
amendment to the official zoning map to rezone approximately 9 71 acres of land located at 7510
and 7522 Bayway Drive, Lots 100 and 101, Block 27 Elena Fruit and Cotton Farms, Unit D,
Hams County Texas from Neighborhood Serving Commercial (NSC) to General Commercial
(GC) and the public hearing concerning a proposed amendment to the official zoning map to
rezone approximately 4.85 acres of land located at 7600 Bayway Drive, Lot 99, Block 27, Elena
Fruit and Cotton Farms D, Hams County Texas from Neighborhood Serving Commercial
(NSC) to General Commercial (GC)
Mr Dietrich presented a summary of the public hearings for agenda items 5.a and 6.a He stated
that the requests are to change all three (3) properties from Neighborhood Serving Commercial
(NSC) to General Commercial (GC) He stated that the properties located at 7510 and 7522
Bayway Drive is a City -sponsored application with the goal of creating adjacency to the 4.85
acre parcel located at 7600 Bayway Drive He noted that the change from NSC to GC does not
cause any son of additional nonconformity since their locations of the particular parcels are
currently residential in nature, but are currently zoned neighborhood serving commercial.
Mr Dietrich stated that the third parcel of the 4.85 acres is an application for a rezoning of a
more intense use other than what neighborhood serving commercial allows He stated that this
request is to allow for the construction of self -storage a gym yoga studio and office facilities,
whereas the self -storage is currently not an allowed use in the existing NSC zone but the other
facilities would be
Lisa Little, Cheryl Collier Rankin and Steven Adnan all registered to speak regarding agenda
item 5.a
Cheryl Collier -Rankin Steven Adnan, and Dee Anne Navarre all registered to speak regarding
agenda item 6.a
Ms Lisa Little stated that she's fairly new to Baytown and lives in Lakewood She stated that
there are 23 storage facilities in Baytown with 16 of those being within a five (5) to ten minute
commute from Lakewood She stated that there's plenty of storage's to choose from and that
they do not create jobs Additionally Ms Little stated that her concerns with this storage
facility is that the location is across from the schools in the area, it can be a negative impact on
the values of the property in her area and can even be an eye sore
Ms Cheryl Collier Rankin stated that she lives in Lakewood and agrees with the comments from
Ms Little Additionally she stated that she s concerned that some of the businesses allowed
could have a negative impact on the Lakewood community

Mr Steven Adrian stated that he agrees with the previous statements and noted that he wants
businesses along Bayway Drive that would improve the quality of life in the area, in which he
feels that a storage facility does not do so
Ms Dee Anne Navarre stated that she's the developer of the storage facility and the intent is to
build a 7 000 to 10,000 square foot budding that would house the Crossfit gym and an office
for EMAX General Contractors which is their general contracting business She noted that the
Crossfit gym has outgrown the fire station building that she owns, in which she'd lease once the
new building is ready She further noted that she and her business partner have lived in
Lakewood and their hope is to bring good things to Lakewood She stated that they believe a
self storage facility is needed as there's lots of boats in Lakewood being that they've live there
and if granted approval, the EMAX Crossfit and Yoga would be in the front of the building
while the self -serve storage would be in the back
At 726 P M. Mayor DonCarlos closed the public hearings regarding agenda items 5.a. and 6.a.
5.b Consider an ordinance amending the official zoning map to rezone approximately

6.b Consider an ordinance approving a proposed amendment to the official zoning map
to rezone approximately 4.85 acres of land, located at 7600 Bayway Drive, Lot 99, Block 27,
Elena Fruit and Cotton Farms D, Harris County, Texas, from Neighborhood Serving
Commercial (NSC) to General Commercial (GC)
Mayor DonCarlos stated that agenda items 5.b and 6.b would be considered together He further
stated that the consensus from council during the work session discussion was to look at a more
detailed plan in this area from a zoning perspective as there are concerns of the future direction
of Bayway Drive
Mayor DonCarlos inquired for clarity that if council denies the zoning request, the part of the
storage facility would not delay Ms Navarre from moving forward with the plans for her
businesses In response to Mayor DonCarlos's inquiry, Mr Dietrich stated that the Mayor's
clarity was correct as the other businesses fall under the neighborhood serving commercial
City Attorney Ignacio Ramirez requested that Mr Dietrich go over the criteria in which council
is to judge these applications Mr Dietrich stated that the seven (7) criteria to be met for such
application include the following
1) consistency with the guiding documents
2) compatibility with the surrounding area
3) promotion of health, safety, or general welfare
4) facilitation of infrastructure,
5) if there are changed conditions

6) effect on natural environment, and
7) community need
Council Member McCartney stated for informational purposes that 90% of the properties on
Bayway Drive to date would already qualify to have a storage facility and that it is an
appropriate use
Council Member Presley noted that his concern with compatibility with surrounding areas is that
the GC use allows for body shops equipment rental facilities, homeless shelters and
manufacturing facilities
A motion was made by Council Member Charles Johnson and seconded by Council Member
Chris Presley approving to deny agenda items 5.b and 6.b The vote was as follows

2015 16 General Fund Budget to cover budget overruns in the Legal and Fire Department
budgets
Finance Director Wade Nickerson presented the agenda item and stated that Resolution No
2460 transfers unencumbered appropriations in the Fiscal Year 2015 16 General Fund Budget to
cover budget overruns in the Legal and Fire Department budgets He noted that this is an annual
adjustment of reallocated departmental funds that will not change the bottom line of the budget

application for the Police Department to the Criminal Justice Division (CJD) of the Texas

Police Chief, Keith Dougherty presented the agenda item and stated that Resolution No 2461
authorizes the City to submit a continuation grant application for the Police Department in
response to the General Victim Assistance Direct Services Programs Solicitation from the
Criminal Justice Division (CJD) of the Texas Governor's Office through the Houston Galveston
Area Council (H GAC) for a two year period FY2017 18

10 MANAGER'S REPORT
a The First Annual "Dine with your Valentine at Town Square" will be held on
February 11th
Director of the Parks and Recreation Department, Scott Johnson presented the agenda item and
stated that the first annual "Dine with your Valentine at Town Square" will be held on February
11, 2017 He stated that the event will start off with a free keepsake photo next to the beautiful
Town Square Fountain, followed up with a walk to Roosters Steakhouse for steak dinner for two
and topped with a banana split for two from the new ice cream shop Additionally he stated that
evening will be followed up at the Dirty Bay, who s offering $1 off drinks
b The 16th Annual "Daddy and Me" Valentine's Dance will be held on Friday,
February 10, 2017, from 7 00 P M until 10 00 P M at the Baytown Community Center
Mr Johnson presented the agenda item and stated that the 16th Annual "Daddy and Me"
Valentine's Dance will be held on Friday February 10, 2017, from 7,00 P M until 10:00 P M at
the Baytown Community Center He noted that there were 950 tickets sold and the plan for next
year is to make this a two (2) day event
Additionally City Manager Davis acknowledged Officer Martin Cisneros for receiving his
Advanced Peace Officer's Certification
