The City Council of the City of Baytown, Texas met in a Regular Work Session on Thursday,
January 26, 2017 at 5:36 P.M., in the Hullum Conference Room of the Baytown City Hall, 2401
Market Street, Baytown,Texas with the following in attendance:

Mayor DonCarlos convened the January 26, 2017, City Council Regular Work Session with a
quorum present at 5:36 P.M., all members were present with the exception of Council Member
Presley who arrived at 5:50 P.M.
1. DISCUSSIONS
a. Discuss the 2017-2018 annexation strategy.
City Manager Davis presented the item and stated that on the council agenda is an item to begin
the unilateral annexation of approximately 230 acres of land between John Martin Road and
Garth Road. He noted that this is part of a larger plan to get the city moving forward and
cleaning up some areas that needed to be addressed within the city boundaries. City Manager
Davis further noted that council discussed this annexation approximately a year ago, whereas at
that time; the council requested that the processes for some of these annexations be
accelerated. He further Mrs. Tiffany Foster, Planning and Development Services Director to give
the council an overview of the plan and consideration item.
Mrs. Foster distributed to council a map of the City's boundaries and its extraterritorial
jurisdiction (ETJ), along with the color coded areas that are part of the annexation plan. She
noted that staff identified various areas throughout the city for consideration of being brought
into the city for different reasons, which allows the city to control the development and the look
of the corridors in that area, manage that area's growth, and close the donut holes throughout the

city. Mrs. Foster stated that the plan has six (6) general areas, whose boundaries may change
when moving along in the annexation process, in order to capture all of the parcels wanted or not
wanted, depending on the circumstances.
Council and staff discussed the naming of Cedar Bayou Lynchburg and uniform naming of
streets within our city limits. Mrs. Foster stated that staff continues to work with Harris County
to get the street names correctly and with uniformity.
Mrs. Foster identified the six(6)areas on the map as follows:
With regards to Annexation Area#1 - San Jacinto Extension, Mrs. Foster stated that the first area
is about 230 acres of land between John Martin and Garth Roads and covers the San Jacinto
Boulevard area which is being constructed in two (2) phases with this first annexation covering
the area for Phase 1 of the San Jacinto Boulevard Project. She stated that as the project
progresses, staff will move to annex the areas needed to include the area all the way down to
Crosby Cedar Bayou along Bush Road, which is needed to complete Phase 2 of the San Jacinto
Boulevard Project and is part of Annexation Areas #6.
Mrs. Foster clarified that the action item for councils' consideration is specific to the 230 acres of
land and allows the staff to move forward in the creation of a service plan. She noted that council
is allowing staff to move forward with the annexation of this area by studying this area a little
closer, creating metes and bounds, identifying the services needed and begin working with
property owners to identify issues, needs and agricultural exemptions for development
agreements. Mrs. Foster clarified that the development agreements allow properties that are
designated as agricultural to delay annexation for up to seven years or until such time as they
begin any development. She stated that staff has already started having some discussions with
property owners in this area and some want to be inside the city limits and some don't; therefore,
staff will continue to work with these potential residents to work through their concerns as the
annexation process moves forward.
Regarding Annexation Area #2 -Barkuloo Road Infill Protection Area, Mrs. Foster stated that
this area is from Barkuloo west, filling in a lot of land that is along N. Main. She stated that over
the last few years there has been some interest in development along N. Main, whereas, some
parcels have portions of land located inside the city limits and some that are not, which must be
cleaned up. Council and staff discussed areas that would and would not like to be annexed that
are adjacent to annexation area#2, such as Red Berry subdivision that does not want to be inside
the city limits and a potential nuisance site that residents in the area do want annexed in order to
deal with its related issues. Mrs. Foster stated that staff would be looking into council's concerns
and resident input.
During further discussion regarding Annexation Area #3 - IS- 10 Corridor, Mrs. Foster stated
that this area is anything south of 1-10 going east from N. Main. She noted that many areas that
want to be developed are put through the annexation process for utilities before they can even be
considered for zoning changes. She stated that by putting these areas through a unilateral
annexation, it allows future developers to start from the zoning stage as the properties are already
in the city limits.

Mrs. Foster stated that Annexation Area #4 - IS-10 & Cedar Bayou East, is the area on the west
side of SH 146 and I-10 and is on the list because we know that there is development interest at
this time. She noted that depending on how fast development moves this area may move up on
the annexation list.
Mrs. Foster stated that Annexation Area #5 - Crosby Cedar Bayou, is the area south of Blue
Heron Parkway going to Massey Tompkins. She noted that there is a large tract of land on
Massey Tompkins that is not inside the city limits that needs to be considered for annexation and
this annexation will help clean up that area.
During further discussion, Mrs. Foster stated that Annexation Area #6 - San Jacinto Extension
2.0, is the second part of the San Jacinto Boulevard area. She stated that staff is aware that
there's development interest in this area at this time, that the existing boundaries are not
reasonable in this area, and that the city wants to protect the development and growth
management of this area.
Mrs. Foster cautioned council that the list provided is not set in stone as it relates to the order of
the annexation and depending on the circumstances and development interest, the order may
change.
Council Member McCartney inquired as to why there were pockets or triangles throughout the
provided map that were not inside the city limits. In response to Council Member McCartney's
inquiry, Mrs. Foster responded and stated that either the areas should be inside the city limits and
need to be taken in through the annexation process or they have a development agreement with
the city.
Mrs. Foster clarified that while staff is moving through the above mentioned involuntary
annexations, they will also be handling volunteer annexation requests as they come in, as one
process does not stop the other, and they can process multiple annexations at any given
time. Lastly, she noted that if there is a voluntary annexation that has adjacent land surrounding
it that should be brought into the city, staff will do so at that time.
City Manager Davis stated that this was the beginning of this process, and more discussion and
actions would come forward for the council's consideration as staff work to clean up the city's
boundaries.

a. Recess into and conducted an executive session pursuant to Section 551.071 to seek
the advice of the City attorneys on legal matters related to a proposed policy regarding the
conduct of city business through written communication on personal communication
accounts/devices.
At 5:54 P.M., Mayor DonCarlos recessed into and conducted an executive session pursuant to

Mayor DonCarlos reconvened the open meeting at 6:23 P.M. and announced that in compliance
with Section 551.102 of the Texas Government Code that no action was taken in executive
session.

With there being no further business to discuss, Mayor DonCarlos adjourned the January 26,
2017, City Council Regular Work Session at 6:23 P.M.
