Ordinance No. 13,405ORDINANCE NO. 13,405 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED FIFTY-SIX THOUSAND NINE HUNDRED FORTY-FIVE AND NO/100 DOLLARS ($56,945.00) TO TRAFFICWARE GROUP, INC., FOR THE SOLE SOURCE PURCHASE OF FOUR (4) TRAFFIC SIGNAL CONTROLLER CABINETS; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Texas Local Government Code Annotated §252.022 provides that when the functional requirements of the City can only be satisfied by one source, the requirement for competitive bids is not applicable; and WHEREAS, the City currently uses the equipment and software of Trafficware Group, Inc., for activation and monitoring of its adaptive traffic signal control system; and WHEREAS, the purchase of four (4) traffic signal controller cabinets to be integrated into the City's system may only be purchased from a single source — Trafficware Group, Inc.; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that only one source can satisfy the needs of the City to integrate four (4) traffic signal controller cabinets into the City's adaptive traffic signal control system. Section 2: That the City Council of the City of Baytown, Texas, authorizes payment of the sum of FIFTY-SIX THOUSAND NINE HUNDRED FORTY-FIVE AND NO/100 DOLLARS ($56,945.00) to Trafficware Group, Inc., for the sole source purchase of four (4) traffic signal controller cabinets into the City's adaptive traffic signal control system. Section 3: That the City Manager is hereby granted general authority to approve a decrease or an increase in costs by FIFTY THOUSAND AND N0/100 DOLLARS ($50,000.00) or less, provided that the amount authorized in Section 2 hereof may not be increased by more than twenty-five percent (25%). Section 4: This ordinance shall take effect immediatelyfn and after its passage by the City Council of the City of Baytown.
