2016 12 21 CC Minutes, Special MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN December 21, 2016 The City Council of the City of Baytown, Texas, met in a Special Meeting on Wednesday, December 21, 2016, at 2:00 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Laura Alavardo Council Member Brandon Capetillo Council Member Robert Hoskins Council Member David McCartney Council Member Chris Presley Council Member Terry Sain Council Member Stephen H. DonCarlos Mayor Rick Davis City Manager Ignacio Ramirez City Attorney Leticia Brysch City Clerk Keith Dougherty Sergeant at Arms Mayor DonCarlos convened the December 21, 2016, City Council Special Meeting with a quorum present at 2:00 P.M., all members were present with the exception of Council Member Sain who arrived at 2:03 P.M. 1. CANVASS a. Canvass the returns of the City of Baytown's Runoff Election held on Saturday, December 10,2016. Mayor DonCarlos presented the agenda item and stated that the City Clerk hand delivered the sealed precinct results to the Council who is the canvassing authority. He stated that he would detail the number of votes and summary of the precincts, as well as, the totals tabulated and the total number of voters for each precinct that cast a ballot. He presented the results as follows: Council District 3 - Canvass Total Spencer Carnes- 142 Charles Johnson- 160 Total Votes Cast- 302 303 ballots cast out of 7,056 registered voters for a 4.29%turn out City Council Special Meeting Minutes December 21,2016 Page 2 of 4 Precinct 13 Spencer Carnes - 107 Charles Johnson - 74 Total Votes Cast - 181 Precinct 28 Spencer Carnes - 9 Charles Johnson- 20 Total Votes Cast- 29 Precinct 63 Spencer Carnes - 0 Charles Johnson - 0 Total Votes Cast - 0 Precinct 103 Spencer Carnes - 4 Charles Johnson - 19 Total Votes Cast- 23 Precinct 50 Spencer Carnes - 0 Charles Johnson - 0 Total Votes Cast - 0 Precinct 387 Spencer Carnes - 0 Charles Johnson - 0 Total Votes Cast - 0 Precinct 456 Spencer Carnes - 0 Charles Johnson - 3 Total Votes Cast - 3 Precinct 739 Spencer Carnes - 22 Charles Johnson - 44 Total Votes Cast - 66 Precinct 740 Spencer Carnes - 0 Charles Johnson - 0 Total Votes Cast - 0 City Council Special Meeting Minutes December 21,2016 Page 3 of 4 Mayor DonCarlos stated that he delivered the returned tally of the early voting and precinct reports used in the canvass to the City Clerk who is the custodian of records and will reserve them for the required retention period. b. Consider a resolution declaring the results of the City of Baytown Runoff Election held on Saturday,December 10,2016. Mayor DonCarlos stated that the official canvass report is available in the City Clerk's office and shall be released under the public information request process. A motion was made by Council Member Brandon Capetillo and seconded by Mayor Pro Tem Robert C. Hoskins approving Resolution No. 2454. The vote was as follows: Ayes: Mayor Stephen DonCarlos, Council Member Laura Alvarado, Council Member Brandon Capetillo, Mayor Pro Tem Robert C. Hoskins, Council Member David McCartney, Council Member Terry Sain, Council Member Chris Presley Nays: None Approved RESOLUTION NO. 2454 A RESOLUTION CANVASSING THE RETURNS OF THE RUNOFF ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 10TH DAY OF DECEMBER, 2016, FOR THE PURPOSES OF ELECTING A COUNCIL MEMBER FOR COUNCIL DISTRICT NO. THREE (3) OF THE CITY OF BAYTOWN; FINDING THAT NOTICE OF THE RUNOFF ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 2. REPORTS a. Receive written comments from the Planning and Zoning Commission on the proposed amendments to the land use assumptions, capital improvements plan, and impact fees. Assistant City Attorney, Karen Horner presented the agenda item regarding the comments from the Planning and Zoning Commission(the "Commission")regarding the proposed amendments to the land use assumptions, capital improvements plan, and impact fees. She stated that the Commission reviewed the report, in which Council must receive five (5) days prior to its' public hearing. Additionally, she stated that this item acknowledges the fact that such report have been in the City Clerk's office and that Council has also received it. ADJOURN A motion was made by Council Member David McCartney and seconded by Council Member Chris Presley adjourning the December 21, 2016, City Council Special Meeting. The vote was as follows: Ayes: Mayor Stephen DonCarlos, Council Member Laura Alvarado, Council Member Brandon Capetillo, Mayor Pro Tem Robert C. Hoskins, Council Member David McCartney, Council Member Terry Sain, Council Member Chris Presley Nays: None Approved With there being no further business to discuss, Mayor DonCarlos adjourned the December 21, 2016, City Council Special Meeting at 2:04 P.M. // • :Sys,;
