2016 10 27 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN October 27, 2016 The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, October 27, 2016, at 6:30 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Robert Hoskins Council Member David McCartney Council Member Chris Presley Council Member Terry Sain Council Member Stephen H. DonCarlos Mayor Rick Davis City Manager Ignacio Ramirez City Attorney Leticia Brysch City Clerk Keith Dougherty Sergeant at Arms Mayor DonCarlos convened the October 27, 2016, City Council Regular Meeting with a quorum present at 6:30 P.M., all members were present with the exception of Council Members Capetillo and Renteria who were both absent. Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member McCartney. 1. RECOGNITIONS AND CITIZEN COMMUNICATIONS a. Recognize City of Baytown Employees for their Years of Service. PROPOSED ORDINANCES a. Consider an ordinance amending Chapter 18 `Buildings and Building Regulations," Article XII "Fencing," Division 1 "Generally" of the Code of Ordinances, Baytown, Texas, to establish general maintenance standards for fences and amending Chapter 42 "Health and Sanitation," Article II "Public Health Hazards," Division 2 "Public Health Nuisances," Section 42 -62 "Maintenance of premises" of the Code of Ordinances, Baytown, Texas, to address open storage of certain personal property. Health Department Director, Mike Lester presented the agenda item and stated that this amendment is to address property maintenance with regards to fences, as well as, open storage throughout the city. Additionally, he stated that Ordinance No. 13,335 cleans up the code and adds more specific definitions of what's visibly inappropriate from the public rights -of- way. Council Member Presley inquired for clarity if the storage could be shielded from the rights -of- way. In response to Council Member Presley's inquiry, Mr. Lester stated that the storage must be enclosed and not just covered with some sort of tarp or object leaned up against it as a shield. During further discussion, Mr. Lester stated that staff always provide notice and education material before enforcing citations, but they will start enforcing the code. Additionally, he stated that staff will work with anyone who has large issues regarding this matter. Council Member McCartney inquired as to what would be the determining as to who gets cited when a fence borders two separate property owners. Mr. Lester stated that typically both owners are sited if need be in such cases, but staff works with the owners to determine fence ownership. Mayor DonCarlos stated that this agenda item was discussed during the council work session prior to this meeting and Mr. Sammy Hotchkiss registered to speak to answer any questions that may arise. Mr. Sammy Hotchkiss registered to speak regarding agenda item 2.b., but did not do so as there were no questions to address. A motion was made by Mayor Pro Tem Robert C. City Clerk, Leticia Brysch recommended that agenda items 2.c. and 3.a. be considered together. 2.c. Consider an ordinance amending Chapter 2 "Administration," Article IV 'Boards and Commissions," of the Code of Ordinances of the City of Baytown, Texas, to remove the provisions for youth membership on the following boards, commissions, committees and task forces of the City: 1. Baytown Animal Control Advisory Committee, 2. Baytown Cultural Arts Council, 3. Baytown Library Board, 4. Community Development Advisory Committee, 5. Construction Board of Adjustments and Appeals, 6. Planning and Zoning Commission, 7. Parks and Recreation Board, and 8. Tow Truck Committee. 3.a. Consider a resolution repealing Resolution No. 1,957 regarding the authorization of youth membership on the Local Law Enforcement Block Grant Advisory Board as well as on the boards of the Baytown Municipal Development District; the Baytown Fire Control, Prevention, and Emergency Medical Services District; and the Baytown Crime Control and Prevention District. Mrs. Brysch presented the agenda items and stated that in the year 2008 there was a move from council to add youth members ages 14 to 16 to certain advisory boards as full memberships and ex officio members. She stated that the recommendation is to remove the youth and ex officio members from the above listed boards. She further stated that Resolution No. 2442 removes the youth full membership on the Local Law Enforcement Block Grant Advisory Board and ex officio membership on the Boards of the MDD, FCPEMSD and CCPD because these boards are City Council Regular Meeting Minutes October 27, 2016 Page 5 of 14 special districts; therefore, they must be approved separately. Mrs. Brysch noted that since the inception of the year 2008, there weren't any successful applicants to any of the positions, although there were three (3) applicants after many outreach efforts. PROPOSED RESOLUTIONS b. Consider a resolution designating the Lee College Red Zone Family Tailgate Party to be held on November 19, 2016, as a city co- sponsored event for which an off - premise sign may be placed on city property pursuant to Chapter 118 "Signs," Article III "Regulations," Division 4 "Location," Subdivision IV "Off- Premises Signs," Section 118 -358 "New Signs" of the Code of Ordinances, Baytown, Texas, contingent upon the filing of the requisite application and assumption of liability. Mr. Lester presented the agenda item and stated that Resolution No. 2444 authorizes the allowance to place three (3) banners across the city for a free community tailgating event hosted by Lee College. Gracie Luna registered to speak regarding agenda item 3.b. and stated that this free community event is to promote Lee College and the programs offered. C. Consider a resolution supporting the Environmental Protection Agency's recommended remedies for the San Jacinto River Waste Pits. City Manager Davis presented the agenda item and stated that Resolution No. 2444 pledges the City's support for the Environmental Protection Agency's (EPA) recommended remedies for the San Jacinto River Waste Pits, which is for full remediation of the waste pits. He stated that there was considerable support for full remediation during the hearing in Highlands and he feels that this is the right course to take regarding this agenda item. During further discussion, Council Member Presley inquired if the City of Baytown was joining other municipalities by supporting the EPA's decision by resolution and if the City of Baytown could encourage them to do so. In response to Council Member Presley's inquiry, Mayor DonCarlos stated that he wasn't sure what other cities were doing, but the City of Baytown could encourage them to do. Council Member Hoskins stated that the speakers that came to oppose the EPA's decision were from outside of this community and in favor of putting a cap on the pits as the best result. Council Member Hoskins further noted that the plan is to remediate and remove the majority down to a measurable level on the contaminants with the anticipation of being done by 2020. REPORTS a. Receive the City of Baytown's Quarterly Financial and Investment Reports for the Quarter Ending September 30, 2016. Finance Director, Wade Nickerson presented the City of Baytown's Quarterly Financial and Investment Reports for the Quarter Ending September 30, 2016. He noted that these preliminary unaudited reports were discussed in detail at the Finance Committee meeting held on October 25, 2016. He stated that the sales .tax receipts were steady until September because there was a Strategic Partnership Agreement (SPA) with Chambers County MUD #1 that had to be released and in order to get caught up a $216,000 payment was made. He noted that current payments with this regard are made monthly. With regards to the revenues, Mr. Nickerson stated that the general, aquatics, hotel /motel, and the water and sewer funds came in above what was budgeted but that their expenses came in under budget respectively with the exception of the water and sewer fund which came in slightly higher than budgeted as expected when more water is sold. He further noted that the sanitation revenues and expenditures came in under budget. During further discussion, he stated that the investment yield was at .5801 % which is an increase compared to the benchmark 90 Day T -Bill of 0.2750 %. 5. ORDINANCE NO. 13,340 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 86 "SOLID WASTE," ARTICLE II "RESIDENTIAL SOLID WASTE," DIVISION 3 "FEES AND CHARGES AND BILLING PROCEDURE," SECTION 86 -101 "CHARGE FOR COLLECTION" OF THE CODE OF ORDINANCES, BAYTOWN, TEXAS, TO COMBINE FEES FOR RESIDENTIAL REFUSE COLLECTION AND CURB -SIDE RECYCLING SERVICES AND TO INCREASE SUCH COMBINED FEE BY APPROXIMATELY FIVE PERCENT (5 %) PER MONTH; CONTAINING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF FIVE HUNDRED AND NO /100 DOLLARS ($500.00); AND PROVIDING FOR THE PUBLICATION AND THE EFFECTIVE DATE THEREOF. Consider an ordinance authorizing expenditures for the Curbside Recycling Agreement and Residential Solid Waste Collection and Disposal Services to Waste Management of Texas, Inc. Mayor DonCarlos request clarity as to whether or not there was a decline in customers regarding this agenda item. Mr. Nickerson stated that in discussions with Waste Management there were some disagreements to the number of residents in which they listed as being collected on; therefore, staff is waiting on Waste Management to provide more information. Additionally, Mr. Nickerson stated that the City's numbers, which are billed according to utility billing system, are lower than what Waste Management had listed. Council Member Hoskins inquired for clarity if the City kept track of the recycling bins locations and pick -ups. Mr. Nickerson stated that Waste Management is supposed to keep track of pick up locations and provide the city with a monthly report of the details. Mr. Nickerson further noted that the first report has never been submitted but staff is working on correcting the oversight of monitoring those reports and are waiting to receive the first report. ORDINANCE NO. 13,341 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF THREE MILLION TWO HUNDRED FIFTY -EIGHT THOUSAND TWO HUNDRED THIRTY -NINE AND 52/100 DOLLARS ($3,258,239.52) TO WASTE MANAGEMENT OF TEXAS, INC., AS THE COST FOR CURBSIDE RECYCLING AND RESIDENTIAL SOLID WASTE COLLECTION AND DISPOSAL SERVICES; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. e. Consider an ordinance prescribing the number of positions in each classification in "Service Group - Fire." ORDINANCE NO. 13,342 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, PRESCRIBING THE NUMBER OF POSITIONS IN EACH CLASSIFICATION IN THE FIRE DEPARTMENT; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. f. Consider an ordinance approving an amendment to the FY2016 -2017 budget of the Baytown Fire Control, Prevention, and Emergency Medical Services District to reprogram funds to change the QA/QI position in the Fire Department from a Firefighter classification to a Lieutenant classification. Consider an ordinance authorizing the purchase of one (1) 2016/2017 Chevrolet C3500 6.6 -liter Diesel Chassis and Frazer Type 1 12' Generator Powered Module, through the Houston - Galveston Area Council, for the Fire Department. Consider appointment to the Baytown Fire Control, Prevention, and Emergency Medical Services District. City Clerk, Leticia Brysch presented the agenda item to consider the appointment of Mr. Barry Hawkins, a retiree firefighter from the City of Baytown, to the Baytown Fire Control, Prevention, and Emergency Medical Services District. She noted that Ms. Kimberlee Whittington, the District 5, At -Large appointee did not seek a reappointment. A motion was made by Mayor Pro Tern Robert C. Hoskins and seconded by Council Member David McCartney approving the appointment of Mr. Barry Hawkins to the FCPEMSD Board. MANAGER'S REPORT a. The Annual Heritage Scaritage Festival will be held at the Republic of Texas Plaza on Saturday, October 29, 2016, from 10:00 A.M. to 4:00 P.M. b. The Environmental Protectors Initiating Change (EPIC) Spooktacular will be held at the Eddie V. Gray Wetlands Education Center on Saturday, October 29, from 6:00 P.M. to 10:00 P.M. Mr. Scott Johnson stated that the annual Heritage Scaritage Festival is scheduled to be held at the Republic of Texas Plaza on Saturday, October 29, 2016, from 10:00 A.M. to 4:00 P.M., presented by the Baytown Historical Preservation Association and on that same day from 6:00 P.M. to 10:00 P.M. at the Wetlands Center, the EPIC Spooktacular kids event will be held. Additionally during the Manager's Report, City Manager Davis presented to Ryan Holzaepfel acknowledgement in achieving his designation as a Certified Texas Emergency Manager. He presented appreciation to some of the engineering and public works staff for recognizing an alternate option with regards to the original plan of incorporating right turn lanes into an adaptive synchronization system on Garth Road which resulted in an approximate $29,000 savings for this project. He further acknowledged Lieutenant Richie Whitaker; Officers David Holland, Juan Navarro, Thomas Brown, Marshall Pigg, Brad Turner, Russel White, and Andrew Richter; Chief Dougherty, Firefighter Tom Adam, and Firefighter Justin Kennedy for their professionalism while performing their duties to include contributing assistance to other agencies when needed. He noted that the Houston Methodist San Jacinto Hospital is redesigning their emergency room and the city's police and fire department will be collaborating with them regarding this endeavor. Lastly, he noted that the Texas City Attorney Association elected Karen Horner as the TCAA President for a one year term at their annual meeting on October 06, 2016, in Austin, Texas. S.
