A motion was made by Council Member Terry Sain and seconded by Council Member David McCartney approving the August 04, 2016, City Council Special Meeting minutes. Ms. Jett presented the agenda item and Mayor DonCarlos presented to the Planning and Development Services Team a proclamation designating October as National Community Planning Month in Baytown. 3. PROPOSED ORDINANCES a. Consider an ordinance adopting the tax rate for General Fund Maintenance and Operations at $0.47006 per $100 valuation and adopting the tax rate for Debt Service at $0.35197 per $100 valuation for the fiscal year ending September 30, 2017. A motion was made by Council Member David McCartney and seconded by Council Member Mercedes Renteria III approving Ordinance No. 13,313. Hoskins, Council Member David McCartney, Council Member Mercedes Renteria III, Council Member Terry Sain, Council Member Chris Presley Nays: None Approved ORDINANCE NO. 13,313 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ADOPTING THE RATE AND TAX LEVY FOR GENERAL FUND MAINTENANCE AND OPERATION AND DEBT SERVICE FOR THE CITY OF BAYTOWN FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2017, UPON ALL TAXABLE PROPERTY IN SAID CITY OF BAYTOWN IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS AND THE CHARTER PROVISIONS AND ORDINANCES OF SAID CITY; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider an ordinance establishing the City of Baytown's 2016 -17 Tourism Partnership Grant Program allocations and approving the standard forms of agreement. Tourism Coordinator, Anna Yowell presented the agenda item and stated that in 2012, Council adopted a procedure for allocating funds for the City's Tourism Partnership Grant Program, in which each year the tourism office accepts applications for. She stated that the Texas Tax Code 351 allows for portions of the Hotel Occupancy Tax (HOT) revenue to be awarded to qualifying non -profit organizations whose programs, projects, and special events fall into at least one of the qualified categories. She stated that each year during the City's budget process a lump sum of money is identified for this use and ten (10) organizations returned completed applications, whereas they all qualified to receive funds totaling $70,500. Mrs. Yowell stated that although the Bayou Bowl, Baytown Little Theater, and Photofest didn't apply this year, there were four (4) new applicants: the Art League of Baytown Spring Show, Portrait of a Warrior Art Gallery, Baytown Youth Fair and Rodeo, and the Baytown YMCA Bike Ride. Walter Stricklin, Susan Smedley, Billy Barnett, Marsha Landers, Jim Zaruba, Kim Martin, Fred White, and Tiffany McCain all registered to speak regarding agenda item 3.b. All registered speakers expressed appreciation for the funds received from the Tourism Partnership Grant allocated to their hosted events. A motion was made by Council Member Brandon Capetillo and seconded by Council Member Mercedes Renteria III approving Ordinance No. 13,314. Consider an ordinance amending Chapter 1 "General Provisions," Section 1 -14 "General penalty; continuing violations" and Chapter 42 "Health and Sanitation," Article II "Public Health Hazards," Division 2 "Public Health Nuisances," Section 42 -62 "Maintenance of premises" of the Code of Ordinances, Baytown, Texas, to establish a fine for illegal dumping and an offense for littering in the City. Mr. Mike Garner presented the agenda item and stated that this ordinance is meant to strengthen the enforcement on litter initiative. He stated that the state law allows the City to assess a fine of up to $4,000 upon conviction for illegal dumping; therefore, Ordinance No. 13,315 updates Section 1 -14 to reflect the increased penalty and makes littering an offense so that the City can proceed against the person that dumps the refuse where prohibited. A motion was made by Council Member Mercedes Renteria III and seconded by Mayor Pro Tern Robert C. Hoskins approving Ordinance No. 13,315. Council Member Presley recused himself from agenda items 3.d. and 3.e. and stated that he filed the required disclosure form with the City Clerk's office. Consider an ordinance authorizing an interlocal agreement with the Baytown Municipal Development District for funding of a development project in the Arts, Cultural and Entertainment Zoning District. e. Consider an ordinance authorizing a Chapter 380 Agreement for an economic development project in the Arts, Cultural and Entertainment Zoning District. Mr. Artie Presley stated that the development project regarding this agenda item includes the typical modern style residential apartment complex with first floor parking. He stated that this building will maintain its historical texture and that the main core of the building is structurally sound; therefore, the project should be around for long term. Additionally, Mr. Artie Presley stated that he's excited about the project and is okay with the incentives as from the beginning he wasn't interested if the incentives was going to be of a significant portion of the City. Deputy City Manager Bottoms stated that the 380 agreement for this project is for a 34 unit apartment building with parking on the first level. He stated that since the project is in the neighborhood empowerment zone, it is eligible for tax abatement and permit fee incentives. He further stated that the funding proposed consist of two (2) payments: $160,000 upon the issuance of the certificate of occupancy (CO) and an additional $50,000 on the one (1) year anniversary after the CO has been issued and will include bringing utilities to the site. Additionally, Deputy City Manager Bottoms stated that the minimum investment for this project is $1.4 million which is required to maintain the taxable value of $1 million and that the term of the agreement is ten (10) years. Mayor DonCarlos stated for clarity purposes that Mr. Artie Presley is the father of Council Member Chris Presley who's involved with this project but has filed the necessary documents, as well as, recused himself from all discussions within this matter and neither participated in the vote. PROPOSED RESOLUTIONS a. Consider a resolution designating a representative and an alternate for the General Assembly and Board of Directors of the Houston - Galveston Area Council for the year 2017. City Clerk, Leticia Brysch presented the agenda item and stated that Mayor DonCarlos submitted to the General Assembly the same representative and altemate as last year, Council Member Terry Sain as the representative and himself (Mayor Stephen DonCarlos) as the alternate. MANAGER'S REPORT City Manager Davis expressed appreciation to all involved with making the Academic Beginners for Children "ABC" end of the summer reading celebration a success, as well as, to Chad Brown, Community Service Supervisor, and Officers Grant and Cochran for assisting citizens in their time of need. He further recognized Officer Haley Hammus for obtaining her intermediate Peace Officers Certification and James "Jimmie" Garcia, Mosquito Control Coordinator, for providing an excellent presentation at the TML Conference with regards to the effects of the Zika virus. Mayor DonCarlos noted that the second Farmers Market event would be held on Saturday, October 15th, and the Alzheimer's Walk at Bayland Island at 8:30 A.M. City Council Regular Meeting Minutes October 13, 2016 Page 15 of 15 Additionally, City Manager Davis stated that the ground breaking for HEB is scheduled for November 02, 2016. 7.
