Ordinance No. 13,306ORDINANCE NO. 13,306 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING MAXIMUM PRIMA FACIE SPEED LIMITS FOR MOTOR VEHICLES IN DESIGNATED SCHOOL ZONES AND PROVIDING FOR HOURS OF ENFORCEMENT ON SCHOOL DAYS OR WHEN CHILDREN ARE PRESENT; AUTHORIZING AND DIRECTING THE PLACEMENT OF SIGNS BY THE DIRECTOR OF PUBLIC WORKS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 DOLLARS ($200.00); AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. ********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, pursuant to Section 545.356 of the Texas Transportation Code, authorizing alteration of maximum prima facie speed limits with respect to highways or portions thereof within the corporate limits of the City of Baytown based upon engineering and traffic investigations and requested public hearings; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That a special hazard exists to traffic safety in the vicinity of elementary schools within the corporate limits of the City of Baytown on days when schools are in session and at times when students and other traffic approach from and depart from the vicinity of such schools and facilities and the City Council hereby makes such findings and determines and declares that the maximum prima facie speed limits to be reasonable, prudent and lawful are as follows at the time and place herein described: THE SCHOOL BEFORE AND AFTER SPEED ZONE OF-'-)O MPH COlMiMENCING THIRT)" THE START OF EACH SCHOOL DA)'AND (,30) MINUTES THIRT)" MINUTES BEFORE ANDAFTER THE END OF EACH SCHOOL LOCATIONS Street Limits School South Pruett Between 75 feet south of West Republic George Washing Carver Street Street and 75 feet north of Dailey Street. Elementary School Between 120 feet north of Ivie Lee Street and James Bowie Elementary Clayton Drive 120 feet south of James Bowie Drive. School North Pruett Between West Lobit Avenue and Green Mirabeau B. Lamar Street Street. Elementary School North Jones Between West Adoue Street and Forrest Mirabeau B. Lamar Street Avenue. Elementary School Between 50 feet west of Georgia street and San Jacinto Elementary Virginia Street New Jersey Street. School THE SCHOOL SPEED ZONE OF 20 MPH COMMENCING THIRTY(30) MINUTES BEFORE AND AFTER THE START OF EACH SCHOOL DAY AND THIRTY MINUTES BEFORE AND AFTER THE END OF EACH SCHOOL DAY AT THE FOLLOWING LOCATIONS Street Limits School Between 150 feet south of West Main Street San Jacinto Elementary Georgia Street and 50 feet south of Kentucky Street. School Between 150 feet east of Louisiana Street and San Jacinto Elementary Kentucky Street Carolina Street. School Between 650 feet south of the school's south David Crockett Elementary Barkuloo Road entrance driveway and 650 feet north of the School school's north entrance driveway. Between 300 feet south of the school's south Lorenzo DeZavala Tri-City Beach driveway and 550 feet north of the school's Elementary School Road north driveway. Between 300 feet east of the east driveway of Stephen F. Austin Massey Fire Station 3 and 350 feet west of Raccoon Elementary School Tompkins Road Drive. Between its intersection with Massey Stephen F. Austin Raccoon Drive Tompkins Road and 350 feet north of such Elementary School intersection. Cedar Bluff Drive Extending from its intersection with SH 146 Dr. Johnny T. Clark, Jr., to its intersection with Cedar Landing Drive. Elementary School Between 30 feet west of Garth Road and 822 Victoria Walker Seabird Street feet west of Garth Road, for a total distance of Elementary School 792 feet. Extending from 822 feet south west of Garth Seabird Street Road to 1,475 feet south west of Garth Road, Dr. Antonio Banuelos for a total distance of 653 feet. Elementary School Extending from 276 feet north of Connor Eastpoint Drive on East Point Boulevard to 300 feet Dr. Antonio Banuelos Boulevard north of Sheila Drive on Eastpoint Boulevard, Elementary School for a total distance of 276 feet. Robin Road Between Lazy Lane and the Harris County William B. Travis Flood Control Ditch. Elementary School East James Between N. 6`h Street and 50 feet west of N. Ashbel Smith Elementary 4th Street. School THE SCHOOL SPEED ZONE OF 30 MPH COMMENCING THIRTY (30) MINUTES BEFOREAND AFTER THE START OF EACH SCHOOL DAY AND THIRTY MINUTES BEFORE AND AFTER THE END OF EACH SCHOOL DAY AT THE FOLLOWING LOCATIONS Street Limits School Extending from 700 feet north of the intersection of North Main Street at Archer N. Main Road to 2,000 feet north of the intersection of Alamo Elementary School North Main Street at Archer Road, for a total distance of 1,300 feet. Extending from 220 feet north of the northernmost point of the north circle driveway of Baytown Christian Academy at N. Main its intersection with N. Main Street to 320 feet Baytown Christian south of the southernmost point of south Academy School circle driveway of Baytown Christian Academy at its intersection with N. Main Street, for a total distance of 900 feet. Street Limits School Extending from 400 feet north of the intersection of SH 146 at Devinwood Drive to Dr. Johnny T. Clark, Jr., SH 146 400 feet south of the intersection of SH 146 at Elementary School Devinwood Drive, for a total distance of 800 feet. as further depicted in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes. Section 2: The Director of Public Works is authorized and directed as follows: (a) to place the appropriate signs for the elementary schools referenced in Section 1 hereof at the locations described hereinabove or (b) to the extent funds are available, to place and install appropriate signs with flashing lights or beacons for the elementary schools referenced in Section 1 hereof, which lights or beacons shall flash to designate when the reduced speeds in the school zones are in effect. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of 3 such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance. / fNTRODUCED, READ, and PASSED by the affirmative vot of the City Council of the City of Baytown, this the 22nd day of September, 2016.
