Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Presley. 1. RECOGNITIONS AND CITIZEN COMMUNICATIONS a. Mr. Michael Hathaway requested to appear before Council in regards to speeding vehicles in the residential area of 10th Street between the Fire Station and the street that the O'Reilly Auto Parts store is on. Mr. Hathaway was not present when called upon. b. Present recognition to each of the 2016 Baytown Professional Firefighter's Benevolence Fund Inc. scholarship recipients. Mr. Mark Medrano presented recognition of a $500 scholarship to each of the following 2016 Baytown Professional Firefighter's Benevolence Fund Inc. scholarship recipients. Agenda items 2.a. and 2.b. were considered together. a. Consider an ordinance for the second and final reading of the proposed voluntary annexation of approximately 1.77 acres, save and except 1.19 acres previously annexed by Ordinance 5,388, at 6822 N. State Highway 146, legally described as part of and out of Jacob Armstrong Survey, Abstract No. 2, Chambers County, Texas. b. Consider an ordinance placing the newly annexed property generally described as 1.77 acres of land, save and except 1.19 acres previously annexed by Ordinance No. 5,388, located at 6822 North State Highway 146, legally described as part of and out of Jacob Armstrong Survey, Abstract No. 2, Chambers County, Texas, into Council District No. 5. She stated that this parcel will be placed into District 5 and as with any parcel of land coming into the city limits, is zoned as open space recreation but has gone through the process of being rezoned to general commercial. At 6:42 P.M., Mayor DonCarlos opened and conducted the public hearing concerning a proposed amendment to the official zoning map to rezone approximately 1.77 acres of land, save and except land previously annexed (approximately 1.19 acres) by Ordinance No. 5,388, located at 6822 North State Highway 146, legally described as part of and out of Jacob Armstrong Survey, Abstract No. 2, Chambers County, Texas, from Open Space /Recreation (OR) to General Commercial (GC). With there being no one registered to speak regarding agenda item 2.c., Mayor DonCarlos closed the public hearing at 6:43 P.M. d. Consider an ordinance amending the official zoning map to rezone approximately 1.77 acres of land, save and except land previously annexed (approximately 1.19 acres) by Ordinance No. 5,388, located at 6822 North State Highway 146, legally described as part of and out of Jacob Armstrong Survey, Abstract No. 2, Chambers County, Texas, from Open Space/Recreation (OR) to General Commercial (GC). RECONSIDERATION OF ZONING TEXT AMENDMENT a. Consider the reconsideration of an ordinance amending Appendix A "Unified Land Development Code," Article II "Use Districts" Division 2 "Zoning Districts," Section 2.09 "Land Use Tables" of the Code of Ordinances, Baytown, Texas, to prohibit the use of containers in all residential zoning districts. City Clerk, Leticia Brysch presented the agenda item and stated that on May 26th, the City Council passed Ordinance No. 13,200 amending Appendix A "Unified Land Development Code," Article II "Use Districts" Division 2 "Zoning Districts," Section 2.09 "Land Use Tables" of the Code of Ordinances, Baytown, Texas, to prohibit the use of containers in all residential zoning districts. She stated that per ordinance, the caption is supposed to be published twice in the Baytown sun but did not happen timely; therefore, per the rules the item has to be called back to be reconsidered within six (6) months of being passed. She stated that the first vote will be to reconsider the Ordinance No. 13,200, and the second vote will be to approve Ordinance No. 13,200. A motion was made by Council Member Mercedes Renteria III and seconded by Council Member Chris Presley approving the reconsideration of Ordinance No. 13,200. As this item was thoroughly discussed at the previous meeting there was no further discussion in its regard. PROPOSED ORDINANCES Council Member Renteria left the meeting at 6:45 P.M. a. Consider an ordinance amending Chapter 112 "Off Street Parking," Section 112 -2 "Applicability" of the Code of Ordinances, Baytown, Texas, to exempt all property located within the ACE Zoning District from providing a minimum number of required off - street parking spaces. Mrs. Foster presented the agenda item and stated that staff requested for Council to approve amending the required parking code that requires property owners to provide parking on their lot when they get ready to redevelop. Additionally, she stated that there's an exemption in the code that if facing Texas Avenue parking is not required; therefore staff recommended extending this exemption to all of the ACE District. A motion was made by Council Member Chris Presley and seconded by Council Member David McCartney approving Ordinance No. 13,211. Consider an ordinance authorizing a Sculpture Agreement with David Adickes for an equestrian statue of Sam Houston for the San Jacinto Boulevard Project. Mr. Michael Flinn presented the agenda item and stated that Ordinance No. 13,212 authorizes a Sculpture Agreement with David Adickes for an equestrian statue of Sam Houston for the San Jacinto Boulevard Project. He stated that Mr. Adickes, the artist whose work includes the 67- foot -tall Sam Houston statue at Huntsville, will create an equestrian statue of Sam Houston charging towards the San Jacinto Monument. Singleton Survey, Abstract No. 709, D. McFadden Survey, Abstract No. 591 and C. Smith Survey, Abstract No. 69 for multiple parcels and right -of -way, located approximately 130 feet east of N. Main Street, including Blue Heron Parkway right -of -way to Sjolander Road and portions of Barkuloo Road right -of -way, Harris County, Texas. ORDINANCE NO. 13,218 AN ORDINANCE OF THE CITY COUNCIL, CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF SEVENTY -ONE THOUSAND FIVE HUNDRED THIRTY -FOUR AND 20/100 DOLLARS ($71,534.20) TO JOHNSTON TECHNICAL SERVICES, INC., FOR THE PURCHASE AND INSTALLATION .OF A MICROWAVE SYSTEM; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE.DATE THEREOF. 7. APPOINTMENTS a. Consider appointing the Local Health Authority for the City of Baytown. Mrs. Brysch presented the agenda item to consider appointing Dr. James Bernick to the Local Health Authority for the City of Baytown. She stated that Dr. James Bernick has served as the City Council Regular Meeting Minutes June 09, 2016 Page 12 of 13 City of Baytown's Health Authority for a number of years, and has indicated a desire to continue in this capacity. A motion was made by Council Member David McCartney and seconded by Council Member Chris Presley approving the appointment of Dr. James Bernick to the Local Health Authority. Conduct the election of the Baytown City Council Mayor Pro Tem. Mayor DonCarlos presented the agenda item and conducted the election of Council Member Hoskins as the Baytown City Council Mayor Pro Tem for a six (6) month term beginning July 01, 2016, and ending December 31, 2016. A motion was made by Council Member David McCartney and seconded by Council Member Brandon Capetillo approving the election of Council Member Hoskins as Mayor Pro Tem for the term beginning July 01, 2016 and ending December 31, 2016. MANAGER'S REPORT Council Member- Renteria returned to the meeting at 6:50 P.M. City Manager Davis presented acknowledgments from a waterpark attendant for the encouraging feeling from the Pirates Bay Special Needs event and from a citizen for the professionalism of Officers Thomas Brown and Markus Rivers in the handling a situation on last month. Additionally, he presented recognition of Officers James Broussard, Michael Nugent, and Desiree Stanislas on completing their certifications.
