Ordinance No. 13,225ORDINANCE NO. 13,225 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PLACEMENT OF STREET LIGHTS IN THE SPECIFIED RIGHTS -OF -WAY OF THE CITY OF BAYTOWN; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on June 3, 2015, certain private streets within the Bay Oaks Harbor Subdivision (the "Subdivision ") were converted to public streets and conveyed to the City of Baytown; and WHEREAS, the Bay Oaks Harbor Property Owners' Association (the "Association ") is currently paying for private security lights within the Subdivision; and WHEREAS, the Association has requested that the City work with CenterPoint to install new street lights on existing poles within the public rights -of -way within the Subdivision; and WHEREAS, the Association has paid or will pay the City for the cost of removal of the old private security lights and the installation of the new lights within the Subdivision; and WHEREAS, after installation, the City will be responsible for the costs associated with the new street lights at the locations depicted on Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes; and WHEREAS, the City Council finds that the installation of street lights in the numbers and locations specified herein furthers the City's public safety objectives; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That all matters and facts set forth in the recitals hereinabove are found to be true by the City Council of the City of Baytown, Texas. Section 2: That subject to receipt of funds from the Association therefor, the City Council of the City of Baytown, Texas, authorizes the removal of the private security lighting and the the placement of LED streetlights at or near the locations depicted in Exhibit "A." Section 3: This ordinance shall take effect immediately from and after its age by the City Council of the City of Baytown.
