The City Council of the City of Baytown, Texas met in a Special Work Session on Tuesday,
April 26, 2016, at 5:30 P.M., in the Hullum Conference Room of the Baytown City Hall, 2401
Market Street, Baytown, Texas with the following in attendance:

Mayor DonCarlos convened the April 26, 2016, City Council Special Work Session with a
quorum present at 5:34 P.M., all members were present.
1. DISCUSSIONS
a. Discuss the annexation of Blue Heron Parkway.
Tiffany Foster, Director of Planning and Community Development Services presented the
agenda item and stated that in previous years staff discussed with Council the possibility of
moving forward with some voluntary and involuntary annexations throughout the city, in order
to close up the donut holes throughout the city and to protect areas that we thought would have
future growth. She stated that since that time there have been a number of annexations, of which
most have been voluntary, i.e., at developers' request to bring their property into the city limits.
She further stated that in December 2016, the involuntary annexation brought the area north of I-
10 along N. Main into the city limits, in which closed up the gaps of the area surrounding the
city's park and 911 Center.
Mrs. Foster stated that previously when discussing the annexation plan, Blue Heron Parkway
was included, but was later removed to allow the area to be brought into the city according to
developer's needs. However, she stated that the issue with waiting is that because Blue Heron is
not in the city limits, it makes it difficult for the City to deal with issues that arise along it; such
as lighting, road, police response, trash, etc. She stated that staff would like to begin the process

of taking in Blue Heron into the city through an involuntary annexation and wanted to bring this
item forward for the Council's information, before the annexation process started. She further
stated that the annexation of Blue Heron is going to be broken up into two parts: first, taking in
about 25 properties; and second, taking in the area that goes all the way along to Massey
Tompkins, Crosby Cedar Bayou and the area of our park. She stated that after the second area
is annexed a hole will be created; however, staff is comfortable with the hole as it is not in a
hurry to annex this area and there's no capacity to deal with all the issues that will arise from
trying to annex this area. Mrs. Foster stated that as a part of the annexation process, staff will
communicate with those property owners impacted by the annexation via letter with a list of
FAQs about the annexation and how it will impact them. She further stated that after the initial
letter, staff will make contact with the property owners to go over their concerns.
Mrs. Foster stated that of the 25 parcels in the first annexation, there are only 12 owners which
include some belonging to the City, the school district and flood control. She stated that staff is
working with two developers in this area who are interested in starting their projects with one
being for retail fronting the road (N. Main and Blue Heron) with duplexes in the back and the
other located farther down on Blue Heron being multifamily residential.
During final discussion, Mrs. Foster stated that once staff has given the property owners
sufficient notice and worked through their concerns, the annexation process would begin with the
first public hearing for this item at one Council meeting followed by a second public hearing
held at the following meeting. Additionally, she reminded Council that the public hearings were
not to be held on the same night when dealing with an involuntary annexation.
b. Discuss any or all of the agenda items on the City Council Special Meeting Agenda
for April 26, 2016, which is attached below.
Deputy City Manager, Ron Bottoms stated that as it related to item 2.a. on the City Council
agenda regarding the conditions of the railroad crossings on Baker Road and Bayway Drive and
Petterson Street, the City received the complaint and filed a formal request for maintenance of
said intersections with the Railroad Commission, who is the agency that has jurisdiction over all
railroad crossings. He further stated that the City would continue to work with the Railroad
Commission regarding these intersection repairs as they do merit some work.

With there being no further business to discuss, Mayor DonCarlos adjourned the April 26, 2016,
City Council Special Work Session at 5:53 P.M.
