AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY
CLERK TO ATTEST TO THE FIRST AMENDMENT TO THE AGREEMENT
FOR FIRE TRAINING FACILITY, PERSONNEL AND EQUIPMENT WITH
THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY
MEDICAL SERVICES DISTRICT; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes
the Mayor to execute and the City Clerk to attest to the First Amendment to the Agreement for
Fire Training Facility, Personnel and Equipment with the Baytown Fire Control, Prevention, and
Emergency Medical Services District. A copy of said amendment is attached hereto as Exhibit
"A," and incorporated herein for all intents and purposes.
Section 2: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.

FIRST AMENDMENT
TO THE
AGREEMENT FOR FIRE TRAINING FACILITY, PERSONNEL AND EQUIPMENT
STATE OF TEXAS
COUNTY OF HARRIS
This First Amendment to the Agreement for Fire Training Facility, Personnel and Equipment (the
"Amendment ") is made as of the day of May, 2016, by and between the CITY OF BAYTOWN, a
municipal corporation located in Harris and Chambers Counties, Texas, (the "City") and the BAYTOWN
FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT, a fire control,
prevention, and emergency medical services district created under Chapter 344 of the Texas Local Government
Code, as amended, (the "Act ") and located in Harris and Chambers Counties, Texas, (the "District ").
WITNESSETH:
WHEREAS, the City and the District entered into an Agreement for Fire Training Facility, Personnel
and Equipment dated on or about the 17'h day of January, 2012, ( "Agreement ") for the City, with the assistance
of the District to develop, organize and manage various programs, including the following:
1. Fire Training Facility,
2. Fire Training Personnel and Operations,
3. Medical Technology and Capital Equipment,
4. Fire Technology and Capital Equipment,
5. Communications Technology and Capital Equipment, and
6. Administration; and
WHEREAS, the City and the District desire to expand the Agreement in order to expand
communications technology and capital equipment purchases to include other equipment purchases, including
the purchase of radios, equipment, software licenses and installation costs for the 911 Center;
NOW THEREFORE, for and in consideration of the mutual covenants and agreements herein
contained, the parties hereto do hereby mutually agree as follows:
1. Definitions. Unless a different meaning clearly appears from the context, words and phrases as used
in this First Amendment shall have the same meanings as in the Agreement.
2. Amendment. Section 2 "Description of Programs," subsection (e) "Communications Technology and
Capital Equipment" of the Agreement is hereby amended to read as follows:
Section 2. Description of Programs.
The City, with the assistance of the District as herein specified, agrees to develop, organize
and manage the following programs, including entering into and administering all contracts incident
thereto:
e) Communications Technology and Capital Equipment. This program is designed to
provide resources necessary to procure needed communications equipment,
hardware, software and associated installation and update services.

3. Entire Agreement. The provisions of this First Amendment and the Agreement should be read
together and construed as one agreement provided that, in the event of any conflict or inconsistency
between the provisions of this First Amendment and the provisions of the Agreement, the provisions
of this First Amendment shall control.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment in multiple copies,
each of which shall be deemed to be an original, but all of which shall constitute but one and the same
amendment, this day of May, 2016, the date of execution by the City Manager.
