2016 03 24 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN March 24, 2016 The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, March 24, 2016, at 6:31 P.M., in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Brandon Capetillo Robert Hoskins David McCartney Chris Presley Mercedes Renteria Stephen H. DonCarlos Ron Bottoms Karen Homer Leticia Brysch Roger Clifford Council Member Council Member Council Member Council Member Council Member Mayor Acting City Manager Assistant City Attorney City Clerk Sergeant at Arms Mayor DonCarlos convened the March 24, 2016, City Council Regular Meeting with a quorum present at 6:31 P.M., all members were present with the exception of Council Member Sain who was absent. Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Presley. 1. MINUTES a. Consider approving the minutes of the Baytown City Council Work Session and Regular Meeting held on February 25, 2016. A motion was made by Council Member David McCartney and seconded by Council Member Brandon Capetillo approving the February 25, 2016, City Council Regular Meeting minutes. RECOGNITIONS AND CITIZEN COMMUNICATIONS a. Recognize the three (3) grade group winners and the overall winner of the 2016 Keep Baytown Beautiful Trash -Off art contest. Ms. Elena Poirot presented agenda item 2.a. and recognized the 2016 three (3) grade group winners for K -2nd, 3rd -5th, and 6th -8th grades. She stated that the overall winner's artwork will be placed on the front of this year's Trash -Off t -shirt, as it has in previous years. Mr. Scott Sheley stated that the 16th Annual Keep Baytown Beautiful Trash -Off event is Saturday, April 09, 2016, from 9:00 A.M. - 2:00 P.M., locations being at Lakewood, Bergeron Park, Baytown Christian, and Sterling High School. City Clerk, Mrs. Leticia Brysch presented the agenda item and Mayor DonCarlos presented to staff members that work with the CDBG program, a proclamation designating March 28 - April 02, 2016, as Community Development Week in Baytown. C. Recognize City of Baytown Employees for their Years of Service. Director of Human Resources, Ms. Carol Flynt presented the agenda item and recognized City of Baytown Employees for their years of service. Consider a resolution authorizing a grant application to the Texas Parks and Wildlife Department and Harris County, for a San Jacinto Waste Pit grant for the Acquisition and Development of Evergreen Bluff. b. Consider a resolution authorizing a grant application to the Texas Parks and Wildlife Department and Harris County, for a San Jacinto Waste Pit grant, for the repair and improvement of three City of Baytown Boat Ramps. C. Consider a resolution supporting a RESTORE Act grant application to move the Eddie V. Gray Wetlands Center to the Baytown Nature Center. Director of Parks and Recreation, Mr. Scott Johnson presented the agenda items and stated that the grant applications were already discussed in detailed. A motion was made by Council Member Mercedes Renteria III and seconded by Council Member Robert C. Hoskins approving agenda items 3.a. (Resolution No. 2407), 3.b. (Resolution No. 2408), and 3.c. GRAY WETLANDS EDUCATION CENTER; DESIGNATING AN AUTHORIZED REPRESENTATIVE; AUTHORIZING THE REPRESENTATIVE TO ACCEPT OR AFFIRM ANY GRANT AWARD THAT MAY RESULT THEREFROM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. RESOLUTION NO. 2409 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY MANAGER TO MAKE APPLICATION TO THE U.S. DEPARTMENT OF TREASURY FOR A RESTORE ACT GRANT IN THE AMOUNT OF ELEVEN MILLION AND NO /100 DOLLARS ($11,000,000.00) FOR THE CONSTRUCTION OF A NEW BUILDING AT THE BAYTOWN NATURE CENTER TO ALLOW THE GROWTH OF EDUCATION PROGRAMS AND ECOTOURISM; DESIGNATING AN AUTHORIZED REPRESENTATIVE; AUTHORIZING THE REPRESENTATIVE TO ACCEPT OR AFFIRM ANY GRANT AWARD THAT MAY RESULT THEREFROM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 4. ORDINANCE NO. 13,358 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE EASTPOINT BLVD REALIGNMENT AND LIFT STATION REPLACEMENT PROJECT; AUTHORIZING FINAL PAYMENT OF THE SUM OF ONE HUNDRED SIXTEEN THOUSAND SIX HUNDRED FOUR AND 48/100 DOLLARS ($116,604.48) TO ANGEL BROTHERS ENTERPRISES, LTD., FOR SAID PROJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. C. Consider an ordinance amending Chapter 94 "Traffic and Vehicles," Article IV "Specific Street Regulations" of the Code of Ordinances to authorize the installation of four stop signs at the intersection of E. ORDINANCE NO. 13,159 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 94 "TRAFFIC AND VEHICLES," ARTICLE IV "SPECIFIC STREET REGULATIONS," SECTION 94 -121 "SCHEDULES ENUMERATED," SCHEDULE VIII "DESIGNATION — STOP AND YIELD INTERSECTIONS" OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, TO AUTHORIZE THE INSTALLATION OF FOUR (4) STOP SIGNS AT THE INTERSECTION OF E. WRIGHT AVENUE AND N. 6' STREET; AUTHORIZING THE POSTING OF PROPER SIGNS; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 DOLLARS ($200.00) FOR EACH VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. RESOLUTION NO. 2410 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY MANAGER TO MAKE APPLICATION TO THE OFFICE OF NATIONAL DRUG CONTROL POLICY FOR A 2016 GRANT FOR THE HOUSTON HIGH INTENSITY DRUG TRAFFICKING AREA PROGRAM IN THE AMOUNT OF ONE MILLION TWO HUNDRED FORTY -ONE THOUSAND ONE HUNDRED EIGHTY -NINE AND NO /100 DOLLARS ($1,241,189.00); DESIGNATING AN AUTHORIZED REPRESENTATIVE; AUTHORIZING THE REPRESENTATIVE TO ACCEPT OR AFFIRM ANY GRANT AWARD THAT MAY RESULT THEREFROM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. e. Consider an ordinance awarding the housing reconstruction projects located at 305 Daniel Street and 3201 Illinois Street. ORDINANCE NO. 13,160 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AWARDING THE CONTRACT FOR THE HOUSING RECONSTRUCTION PROJECTS LOCATED AT 305 DANIEL STREET AND 3201 ILLINOIS STREET TO MLG CONSTRUCTION, INC., FOR THE SUM OF ONE HUNDRED NINETEEN THOUSAND EIGHT HUNDRED AND NO /100 DOLLARS ($119,800.00); AUTHORIZING PAYMENT THEREOF; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 4.b. Consider an ordinance authorizing the Ninth Amendment to the Collective Bargaining Agreement for October 01, 2010 -- September 30, 2016, with the International Association of Firefighters Local 1173 regarding eligibility requirements for beginning positions and post -hire retention requirements. A motion was made by Council Member Robert C. Hoskins and seconded by Council Member David McCartney approving to suspend consent agenda item 4.b. indefinitely. At 6:56 P.M., Mayor DonCarlos recessed into and conducted an executive session pursuant to Section 551.087 of the Texas Government Code to deliberate the offer of a financial or other incentive to a business prospect. At 7:10 P.M., Mayor DonCarlos reconvened the Open Meeting of the City Council Regular Meeting and announced that in accordance with Section 551.102 of the Texas Open Meetings Act, no action was taken in the Executive Session. 6. MANAGER'S REPORT a. The Annual Nurture Nature Festival will be held at the Baytown Nature Center on Saturday, April 09, 2016, from 10:00 A.M. to 4:00 P.M. Mrs. Brysch presented the agenda item and stated that the annual Nurture Nature Festival will be held at the Baytown Nature Center, 6213 Bayway Drive on Saturday, April 09, 2016, from 10:00 A.M. to 4:00 P.M. b. The City of Baytown will host its first ever Town Square Easter Egg Hunt on Saturday, March 26, 2016, for children ages 4 to 12 from 10:00 A.M. to 2:00 P.M. Mrs. Brysch stated that the City of Baytown will host its first ever Easter egg hunt on Saturday, March 26, 2016, at the Town Square for children ages 4 to 12 from 10:00 A.M. to 2:00 P.M. Additionally, she stated that there will be an Exxon Tree Planting Project at Gene Russell Park on Friday, April 01, 2016 from 8:00 A.M. to 12:00 P.M. 7.
