AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ADDING 9.58 ACRES OF LAND, PART OF AND OUT OF NATHANIEL LYNCH SURVEY,
ABSTRACT NO. 44, LOCATED ON THE SOUTH SIDE OF I -10 APPROXIMATELY 600
FEET WEST OF THOMPSON ROAD, HARRIS COUNTY, TEXAS, INTO COUNCIL
DISTRICT NO. 3, REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING
A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE
DATE THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall
redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a Council District;
NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 3 is hereby redistricted by the addition of that property which is
described in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes.
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of
this ordinance or the application of same to any person or set of circumstances, shall for any reason be held
unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of circumstances and to this end all provisions of this
ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its passage by the City
Council. The City Clerk is hereby directed to give notice hereof by causing t caption of this ordinance to be
published in the official newspaper of the City of Baytown at least twice withi en (10) days after passage of this
ordinance.

FIELD NOTES of a 9.5830 acre tract of land situated in the Nathaniel Lynch Survey, Abstract No.
44, Harris County, Texas, and being part of the residue of a called 170.974 acre tract of land
conveyed by Venture 2000 to Venture 2000, Ltd, by Deed dated July 12, 2001 and recorded in
County Clerk's File No. V226376 of the Official Public Records of Real Property of Hams County,
Texas. This 9.5830 acre tract is more particularly described by the following metes and bounds, to-
wit:
NOTE: BEARINGS ARE BASED ON DEED BEARINGS AND FOUND MONUMENTS IN
THE SOUTH RIGHT -OF -WAY LINE OF INTERSTATE HIGHWAY NO. 10 (RIGHT -OF -WAY

COMMENCING at a 5/8 inch iron rod found in the South right -of -way line of said Interstate
Highway No. 10 for the Northernmost Northwest comer of said called 170.974 acres, the Northeast
corner of that certain called 4.896 acre tract of land conveyed to the City of Baytown by Deed
recorded in County Clerk's File No. P029811 of the Official Public Records of Real Property of
Harris County, Texas, and the Northernmost Northwest comer of that certain 139.3786 acre tract
surveyed this date.
THENCE: North 64 °52'22" East along the Northernmost North line of said 139.3786 acres, the
Easternmost North line of said called 170.974 acres and the South right -of -way line of said
Interstate Highway No. 10 for a distance of 257.17 feet to a concrete right -of -way monument found
for the BEGINNING POINT of a curve to the left, concave Northwesterly.
THENCE: Along and around said curve to the left, in a Northeasterly direction, said curve having a
radius of 572.96 feet, a central angle of 29 °29'29 ", and a chord bearing and distance of North
50 002'57" East 291.67 feet, for an arc length of 294.92 feet to a concrete rigbt -of -way monument
found for the TERMINATION POINT of said curve.
THENCE: North 35 °18'12" East along the Northernmost North line of said 139.3786 acres, the
Easternmost North line of said called 170.974 acres and the South right -of -way line of said
Interstate Highway No. 10 for a distance of 29.31 feet to a concrete right -of -way monument found
for the BEGINNING POINT of a curve to the right, concave Southeasterly.
THENCE: Along and around said curve to the right, in a Northeasterly direction, said curve having
a radius of 572.96 feet, a central angle of 29 °31'28 ", and a chord bearing and distance of North
50 °03'46" East 291.99 feet, for an are length of 295.25 feet to a concrete right -of -way monument
found for the TERMINATION POINT of said curve.

Interstate Highway No. 10 for a distance of 933.30 feet to a % inch iron rod, with cap, set for the
Northeast corner of said 139.3786 acres, and the Northwest corner and POINT OF BEGINNING of
this tract. Said point being in the center line of that certain 30 foot wide pipeline easement
conveyed by Albert N. Nelson, et al, to Houston Pipeline Company by deed recorded in Volume
2005 at Page 444 of the Deed Records of Hams County, Texas, and as amended by instrument
dated April 5, 1968 and recorded in Volume 7188 at Page 400 of the Deed Records of Harris
County, Texas.
THENCE: North 64 °49'30" East along the North line of this tract, the North line of said called
170.974 acres and the South right -of -way line of said Interstate Highway No. 10 for a distance of
1180.41 feet to a concrete right -of -way monument found for an angle point in said line.
THENCE: North 79038'14" East along the North line of this tract, the North line of said called
170.974 acres and the South right -of -way line of said Interstate Highway No. 10 for a distance of
69.72 feet to a 3/8 inch iron rod found for an angle point in said line.
THENCE: North 64 °49'25" East along the North line of this tract, the North line of said called
170.974 acres and the South right -of -way line of said Interstate Highway No. 10 for a distance of
54.10 feet to a %z inch iron rod found for the Northernmost Northwest corner of that certain 25.0000
acre tract conveyed by Venture 2000, Ltd, to CFJ Properties by Deed dated August 10, 2001 and
recorded in County Clerk's File No. V- 247862 of the Official Public Records of Real Property of
Harris County, Texas, and filed as a Re -Plat of Flying "J" Travel Plaza in Volume 486 at Page 1343
of the Map Records of Harris County, Texas and the Northeast comer of this tract.
THENCE: South 02 °44'06" East along the Northernmost East line of this tract and the
Northernmost West line of said 25.0000 acres for a distance of 358.96 feet to a 'Y2 inch iron rod
found for an interior comer of said 25.0000 acres and the Easternmost Southeast corner of this
tract.
THENCE: South 64 °51'54" West along an Easternmost South line of this tract and the
Westernmost North line of said 25.0000 acres for a distance of 801.70 feet to a %z inch iron rod
found for the Westernmost Northwest corner of said 25.0000 acres and an interior comer of this
tract.
THENCE: South 25 °08'06" East along the Southernmost East line of this tract and the
Southernmost West line of said 25.0000 acres for a distance of 276.45 feet to a %Z inch iron rod,
with cap, set for an angle point in Northernmost East line of said 139.3786 acres surveyed this date
and in the centerline of said 30 foot easement. Said point being the Southernmost corner of this
tract.

87.42 feet to a % inch iron rod, with cap, set for an angle point in said line.
'THENCE: North 55 015'54" West along the Northernmost East line of said 139.3786 acre tract, the
West line of this tract, and the centerline of said 30 foot easement for a distance of 635.77 feet to
the PLACE OF BEGINNING and containing within these boundaries 9.5830 acres of land.
