ORDINANCE N0. 623
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, CREATING A LIBRARY DEPARTMENT AND AN ADVISORY BOARD
TO ASSIST IN IMPLEMENTING AND CARRYING OUT THE FUNCTIONS
AND DUTIES OF SUCH LIBRARY DEPARTMENT; PROVIDING FOR TERMS
OF OFFICE AND QUALIFICATIONS OF BOARD MEMBERS; PRESCRIBING
THE AUTHORITY AND DUTIES OF SUCH BOARD; REPEALING ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE AND PRO-
VIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, the City Charter of the City of Baytown and the general laws
of the State of Texas empower the City of Baytown, through its duly acting City
• Council, to establish a free public library and to operate such library in coopera-
tion with a Library Board under such terms and conditions as it deems advisable;
and,
WHEREAS, the City Council has carefully studied and considered the
establishment and operation of a Library in this City; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Sec-iion 1: That pursuant to the Charter of the City of Baytown, a Department
is hereby created within the framework of the governmental organization of the City
of Baytown which shall be known as the Library Department and it shall function in
accordance with the Charter of the City of Baytown, this ordinance and amendments
hereto.
Section 2: There.is hereby created a five (5) member advisory Board which
shall assist the City in the proper establishment and operation of such library, as
set forth below, and that such Board shall be known as the Baytown Library Board.
That the City Manager shall appoint said advisory Board members by and with the ap-
proval of the City Council. That such members shall hold office for two (2) years,
and of the first five appointments, three shall be appointed for two years and two
shall be appointed for one year. Thereafter, three shall be appointed during odd -
numbered years and two shall be appointed during even - numbered years. That all
• members of the Board shall be qualified voters and residents. of the City of Baytown.
Should vacancies occur in the Board such vacancies shall be filled in the same man•
ner as original appointments except such terms shall only be for the remainder of
such unexpired term.

Section 3: That the City Council has, heretofore, purchased a tract of
land for the purpose of erecting its first public library building and it has
employed an architect for the purpose of preparing plans and specifications for
such original structure. That said architect is hereby authorized and directed
to consult and counsel with the Library Board as to any and all plans and speci-
fications concerning such proposed library building and the Library Board shall
study and make recommendations of such plans and specifications: afterwhich, they
shall be presented to the City Manager for his subsequent submission to the City
Council at appropriate intervals. That such plans and specifications shall be
subject to final approval by the City Council,
Section 4: That the Baytown Library Board is hereby authorized and directed
to recommend one or more librarians to the City Manager for his consideration and
that the City Manager shall, in turn, appoint a City Librarian, subject to approval
by the City Council. Furthermore, the Library Board, working with the Librarian
and City Manager, shall recommend the number, qualifications and the salaries to
be paid the staff members employed under the Librarian. Such recommendations shall
be subject to approval of the City Council.
Section 5: That the City of Baytown shall have over Three Hundred Thousand
($300,000.00) Dollars, after paying for the abovementioned library site, for the
purpose of constructing and equipping its original library. That the Library
Board is hereby authorized and directed to recommend, through the City Manager,
in writing, to the City Council how such sum of money should be allocated for build-
ing, equipment, fixtures, books and other needful items for a public library, and
the City Council will study such proposal and make final decisions thereon.
Section 6: That all formal meetings of the Board shall be open to the public,
and the Librarian and the City Manager, particularly, shall be entitled and ex-
pected to meet with such Board but shall have no voting rights.
Section 7: That the City Council of the City of Baytown recognizes that the
Library is a new venture for Baytown and that such Department is technical in na-
ture and therefore it hereby authorizes and directs the Library Board to promulgate
general rules and regulations covering the policies and operations of such Depart-
ment. That after same have been studied and finally approved by the City Council
same shall be compiled and a number kept in supply so as to enhance the orderly
operation of said Library. That the Librarian is hereby authorized to prepare th

• annual budget for the Library Department, with the assistance of the Library Board,
and that same shall be presented to the City Manager for his consideration and
amendments if amendments are necessary. The City Manager will present such budget
to the City Council and such will be treated in the manner prescribed by the Char-
ter.
Section B: Repealing Clause: All ordinances or parts of ordinances incon-
sistent with the terms of this ordinance are hereby repealed; provided, however,
that such repeal shall be only to the extent of such inconsistency, and in all
other respects this ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered by this ordinance.
Section 9: Savings Clause: If any provision, exception, section, sub -sec-
tion, paragraph, sentence, clause or phrase of this ordinance or the application
of same to any person or set of circumstances, shall for any reason be held uncon-
stitutional, void or invalid, such invalidity shall not affect the validity of the
remaining provisions of this ordinance or their application to other persons or
sets of circumstances and to this end, all provisions of this ordinance are de-
clared to be severable.
Section 10: Effective Date: This ordinance shall take effect from and
after its passage by the City Council.

LIBRARY PROJECT; LEVYING TAXES TO PAY THE PRINCIPAL
OF AND INTEREST ON SAID BONDS; AWARDING THE SALE
THEREOF; CONTAINING OTHER PROVISIONS RELATING TO
THE SUBJECT; AND PROVIDING THAT THIS ORDINANCE
