Ordinance No. 5150 • • • • 0 • ORDINANCE NO. 515 AN ORDINANCE PERMITTING THE GOVERNING BODY OF THE CITY OF BAYTOWN , TEXAS, TO REGULATE, BY ORDINANCE, THE DRIVER OF A VEHICLE UPON THE PUBLIC STREETS AND THOROUGHFARES OF SUCH CITY UPON METING OR OVERTAKING FROII EITHER DIRECTION ANY SCHOOL BL'S L'!IICH HAS STOPPED FOR THE PURPOSE OF RECEIV- ING OR DISCHARGING ANY SCHOOL CHILDREN; PROHIBITING SAID DRIVER FRODJ PASSING A SCHOOL BUS WITHOUT FIRST STOPPING HIS VEHICLE, AND THEN PROCEEDING PAST SUCH SCHOOL BUS AT A PRU- DENT SPEED, NOT EXCEEDING TEN (10) MILES PER HOUR, AND WITH DUE CAUTION FOR THE SAFETY OF SUCH CHILDREN; REPEALING ORDI- NANCES INCONSISTENT HEREWITH, CONTAINING A SAVINGS CLAUSE; PRESCRIBING A NAXIMMI PENALTY OF TWO HUNDRED ($200.00),DOL- LARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: For the purpose of this ordinance, certain words are defined, words used in the singular include the plural, and the plural, the singular. Words used in the present tense include the future. "1]otor Vehicle ": Every self - propelled vehicle which is designed for use upon a highway, "Operator ": Every person who is in actual physical control of a motor vehicle, male and /or female. School Bus : Every motor vehicle owned by a public or governmental agency and operated for the transportation of children to or from school. Section 2: That henceforth and hereafter, each and every operator of a motor vehicle shall, upon meeting or overtaking from either direction aby school bus which has stopped on a public street for the purpose of receiving or discharging any school children *- stop his vehicle immediately before pas- sing the school bus, but may then proceed past such school bus at a speed which is prudent, not exceeding ten (10) miles per hour, and with due caution for the safety of such children. Section 3: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. I Section 4: Savings Clause: If any provision, exception, section, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the 0 11211 0 • validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. Section 5: Penalty: Any violation of any of the terms of this ordi- nance whether herein denominated as unlaviful or not, shall be deemed misdemeanor; and any person convicted of any such violation shall be fined in a sum not ex- ceeding Two Hundred ($200.00) Dollars. Section 6: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk • is hereby directed to give notice hereof by causing the caption of this ordinance: to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
