AN ORDINANCE PROVIDING FOR THE REGULATION AND OPERATION
OF EMERGENCY VEHICLES, REGULATING THE SPEED THEREOF, RE-
QUIRING Ar.-BUL•ANCES TO BE EQUIPPED WITH SIRENS TO BE USED
CONTINUOUSLY l':IIIL.E ON Er.ERGENCY CALLS; PROVIDING A SAVINGS
CLAUSE; PROVIDING FOR CANCELLATION OF DRIVERS' PERNITS BY
CHIEF OF POLICE; PROVIDING FOR THE REPEAL OF ALL ORDINANCES
IN CONFLICT HEREl9ITH; PROVIDING A PENALTY FOR THE VIOLATION
HEREOF• AND PROVIDING FOR THE EFFECT NE DATE HEREOF,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOUN, TEXAS:
SECTION 1: No person, firm or corporation shall operate or cause to be
operated on the streets of the City of Baytown, Texas, any emergency vehicle
without first securing a permit therefor from the City Health Officer and the
• Chief of Police, stating in s application the name of the owner, or person
by whom such permit is desired, his street address, the type of motor car to
be used, the horsepower thereof, the factory number and /or i:Notor number thereof
and such other relevant information as may be deemed advisable and necessary by
the City Health Officer and the Chief of Police of said City. Such application
shall be signed and sworn to by the applicant.
SECTION 2: It shall be unlawful to operate on the streets of the City of
Baytown any emergency vehicle unless the same shall be equipped with at least
one (1) lighted or revolving blinking red light, visible under normal atmospher-
ic conditions from a di ;�ance of Five Hundred (5001) Feet i.n front of such ve-
hicle, and One (1) - Twelve (12) Volt Siren; said red light and siren to be op-
erated continuously while said emergency vehicle is on an emergency call.
SECTION 3: It shall be unlawful to operate or drive ai, emergency vehicle
upon any street within the cc,porate limits of the P.ty of Baytown at a rate of
speed in excess of Ten (10) -;ales per hour above the legal speed limit.
SECTION 4: It shall be unlawful to drive or operate an emergency vehicle
upon the streets of the City of Baytown unless and until the operator of such
vehicle shall procure and furnish property damage insurance in the standard
amounts and of the standard provisions of such public liability and property
damage insurance and shall furnish a public liability and property damage polic
of insurance on each and every vehicle to be operated with the minimum liabilit
thereunder as follows:
$5,000.00 for any one single personal injury to any one person.
$10,000.10 for personal injuries in any one single accident.
$5,000.00 property damage for any one single accident.
Said insurance policy to be approved by the City Attorney of the City of
® Baytown and said insurance policy shall be one issued by a company of sufficient
assets with an agent at Baytown, Texas, upon whom service of process may be made.
This insurance policy is for the protection of the public that might be injured
by the operation of said vehicle.
SECTION 5: All emergency vehicles nowv operating in the City of Baytown
shall be permitted to continue operating for a period of thirty (30) days after
the passage of this Ordinance without complying with the provisions of this
Ordinance. After said thirty (30) days period all vehicles shall operate under
the terms and provisions of this ordinance only.
SECTION 6: Any person, firm or corporation violating any of the provisions
of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction
shall be fined in any sum not to exceed Two Hundred ($200.00) Dollars.
SECTION 7: In the event any section, sub - section, sentence, clause or phras
of this Ordinance shall be declared or adjudged invalid or unconstitutional, such
adjudication shall in no means effect any other sections, sub- sections, sentences
clauses or phrases of this Ordinance, but all the rest hereof shall be in full
force and effect just as though the section, sub- section, sentence, clause or
phrase so declared or adjudged invalid or unconstitutional was not originally a
part thereof.
SECTION 8: All ordinances or parts of ordinances inconsistent or in confli^
with the provisions of this ordinance shall be and the same are hereby repealed.
• SECTION 9: This ordinance shall take effect immediately from and after its
passage by the City Council. The City Clerk is hereby directed to give notice
hereof by causing this ordinance to be published in the official newspaper of the
City of Baytown at least twice wvithin ten (10) days after the passage of this
ordinance.
INTRODUCED, READ and PASSED by the affirmative vote of a majority of the Cit
Council of the City of Baytown on this the 26th day of June, 1958.
