• AN ORDINANCE REQUIRING THAT ALL APPLICATIONS FOR
BEER LICENSES, EITHER ON- PREMISE OR OFF - PREMISE,
SHALL BE FILM WITH THE CITY CLERK; THAT THE CITY
CLERK SHALL POST A NOTICE.OF EACH APPLICATION IN
THE CITY HALL FOR A PERIOD OF FIVE (5) DAYS AND
SHALL HAVE PUBLISHED IN THE OFFICIAL WIS PAPER OF
THE CITY A NOTICE OF SUCH APPLICATION; THAT SUCH
POSTED AND ADVERTISED NOTICES SHALL SUBSTANTIALLY
CONFORM TO THE APPLICATIONS FOR BEER LICENSES USED
BY THE STATE OF TEXAS;�PROV IDING WrHODS AND STAN-
DARDS FOR OBJECTIONS TO SUCH APPLICATIONS FOR BEER
LICENSES; PROVIDING FOR A PUBLIC HEARING BY TUE CITY
COUNCIL IF AS P�IANY AS FIVE (5) PERSONS OBJECT TO THE
GRANTING OF SUCH BEER LICENSE; PROVIDING THAT THE
FIRE MARSHAL, ELECTRICAL INSPECTOR AND HEALTII OFFICER
SHALL INSPECT AND APPROVE EVERY PROPOSED LOCATION FOR
AN ON- PREMISE CONSU6IPTION BEER LICENSE BEFORE SUCH
LICENSE IS ISSUED; AND PROVIDING FOR THE EFFECTIVE
DATE HEREOF:.
• BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That all applications for a beer license, either on- premise
or off - premise, shall be filed with the City Clerk. The City Clerk shall take
each application for such beer license and post same, or a reasonable facsimile
thereof, at the City Hall for a period of five (5) days and shall publish some
in the official newspaper of the City of Baytown at least once. That such ap-
plications shall substantially comply with the applications used by the State
of Texas for beer licenses. The posted and advertised notices shall give the
applicants' name,location of place of business and the type of business involved.
Section 2: During the five (5) days waiting period, written objections,
if any, shall be received by the City Clerk. Objections may be made by persons
residing or doing business within three hundred (300') feet of the proposed lo-
cation. If as many as five (5) persons object to the granting of an on- premise
or off- premise beer license, then, in such event, a public hearing shall be held
by the City Council to determine whether or not, in its opinion, the application
should be approved or disapproved. The action of the Council shall be reduced
to writing by the City Clerk and mailed forthwith to the County Judge and to
the Liquor Control Board.
Section 3: The Fire Marshal, Electrical Inspector and Health Officer

shall inspect and
approve
every proposed
location
for
an on- premise
consumption
of beer license.
No beer
license shall
be issued
to
such locations
unless and
until approval is given by the said Fire Marshal, Electrical Inspector and Iiealtl
Off icer.

Effective Date: That this Ordinance shall take effect and be in force
from and after its passage, approval and publication, in accordance tivith the
provisions of the Charter of the City of Baytorm.

City Council of the City of Baytown, Texas, on this the 12th day of June, 1958.
