Ordinance No. 467K] I• ..� • • ORDINANCE NO. 467 AN ORDINANCE EMPLOYING THE ENGINEERING FIRM OF BROYLES G BYNU14 FOR THE PURPOSE OF SUPPLET +TENTING THE FUNCTIONS OF THE CITY OF BAYT019N'S ENGINEER- ING DEPARTfJENT; PROVIDING THE TEREIS AND CONDITIONS OF SUCH EMPLOYMENT; PROVIDING FOR THE TERMINATION OF SUCH EMPLOYBENT AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. � l:'HEREAS, the City of Baytown has started a program of constructing major public improvements; and 11HEREAS, such construction program consists, in part, of construct- ing streets, ;urbs and gutters, storm sewers, sanitary sewers, drainage, water pumping facilities, water storage reservoirs, water distribution lines and many ramifications thereof; and 11JEREAS, due to the fact that the abovementioned projects are so ex- . tensive and intensive, it is believed that additional engineering services should be employed to supplement the professional services of the City's Engineering Department; Z , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOVN; Section 1. That the Engineering Firm of Broyles G Bynum is hereby employed as.consulting engineers for the City of Baytown. That such employment shall con- sist of general engineering services to supplement the functions of the City's Engineering Department; such Firm shall only undertake, perform and complete the jobs and tasks that are assigned to it by the City Engineer, and under the direc- tion and supervision of the City Manager and City Engineer. Section 2. That the said Engineering Firm of Broyles & Bynum shall be paid for its services at the minimum rates provided in the latest published edition of the Texas Society of Professional Engineers. Either the City of Baytown, by and through its City Council, or the Firm of Broyles a Bynum may terminate this agreement by giving thirty (30) days written notice; provided, of course, that Broyles F. Bynum shall be paid for any and all services performed by it before such termination end it shall have the right to complete and be paid for any work in progross at the time of termination. I• I• 0 Section 3. That this ordinance shall take effect and be in full force from and after its adoption.
