A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AMENDING RESOLUTION NO. 2393, WHICH GRANTED CONDITIONAL
CONSENT TO THE CREATION OF HARRIS COUNTY MUNICIPAL UTILITY
DISTRICT NO. 528 AND THE INCLUSION OF ADDITIONAL PROPERTY IN THE
TRI- CITIES BEACHM WY 146 AREA, IN ORDER TO REMOVE
THEREFROM 118.216 ACRES OF PROPERTY RECENTLY ACQUIRED BY THE
CITY OF BAYTOWN; MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, no land within the corporate limits of a city may be included in a municipal utility
district unless the governing body of the municipality gives its written consent in accordance with
Chapter 54 of the Texas Water Code; and
WHEREAS, on January 28, 2016, the City Council passed Resolution No. 2393, which granted
conditional consent to the creation of Harris County Municipal Utility District No. 528 (the "District "),
along with the inclusion of an additional 327.3214 acres; and
WHEREAS, on February 2, 2016, after the City's consent but before the District's annexation of
the additional 327.3214 acres, the City purchased 118.216 acres from Texas Capital Development
Corporation, Inc., that was to be annexed by the District; and
WHEREAS, since the City does not desire for its property to be included in the District,
Resolution No. 2393 needs to be amended so that the property recently purchased by the City of Baytown
is excluded; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council hereby amends Resolution No. 2393, passed on
January 28, 2016, to substitute Exhibits "C -1" and "C -2," which are attached hereto and incorporated
herein for all intents and purposes, for the Exhibit "C" contained in Resolution No. 2393. All findings
and conditions contained therein are applicable to the attached Exhibits "C -1" and "C -2."
Section 2: This resolution shall take effect from and after i assage by the City Council of
the City of Baytown. �/

(Tract I) conveyed by Ashbel Smith Land Ltd. to Hazelwood Enterprises, Incorporated, by Deed
dated June 30, 1995 and recorded under County Clerk's File No. R462464 of the Official Public
Records of Real Property of Harris County, Texas. This 45.4783 acre tract is more particularly
described by the following metes and bounds, to -wit:

COMMENCING at a point at the intersection of the Northwest right -of -way line of Evergreen

wide right -of -way). Said point being the Southeast comer of said 192.9755 acres. Said
COMMENCING POINT has a State Plane Coordinate Value of Y= 13,828,194.44 and
X= 3,252,867.12.
THENCE: North 08113'l 9" West along the West right -of -way line of said Tri-City Beach Road
for a distance of 63.60 feet to a point for the Southeast comer and POINT OF BEGINNING of
this tract.
THENCE: South 81 146'39" West along the South line of this tract for a distance of 11.59 feet to
a point in the center of that certain 60 feet wide easement conveyed by Ashbel Smith Land
Company to Houston Lighting & Power Company by Instrument dated July 16, 1969 and
recorded in Volume 7720 at Page 236 of the Deed Records of Harris County, Texas for an angle
point in said South line of this tract.
