A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ADOPTING A POLICY REGARDING THE USE OF EXCESSIVE FORCE AND
PHYSICAL BARRING OF A FACILITY DURING NONVIOLENT CIVIL RIGHTS
DEMONSTRATIONS AS REQUIRED BY THE TEXAS DEPARTMENT OF RURAL
AFFAIRS UNDER THE CDBG -IKE DISASTER RECOVERY GRANT PROGRAM.;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the Texas Department of Rural Affairs requires that recipients of the CDBG Disaster
Recovery Grant Program establish a policy regarding the use of excessive force and physical barring of a
facility during nonviolent civil rights demonstrations; and
WHEREAS, the policy herein adopted prohibits (i) the use of excessive force by the law
enforcement agencies within the City's jurisdiction against any individual engaged in non - violent civil
rights demonstrations; and (ii) the physical barring of any entrance to, or exit from, such a facility within
the City's jurisdiction; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby adopts a
policy regarding the use of excessive force and physical barring of a facility during nonviolent civil rights
demonstrations as required by the Texas Department of Rural Affairs under the CDBG -Ike Disaster
Recovery Grant Program. The policy is attached hereto as Exhibit "A" and incorporated herein for all
intents and purposes.
Section 2: This resolution shall take effect immediately from and after its passage by the
City Council of the City of Baytown.

Excessive Force Policy
Section 1: It is the policy of the City of Baytown to prohibit the use of excessive
force by the law enforcement agencies within its jurisdiction against any individual engaged in
non - violent civil rights demonstrations. The city also prohibits the physical barring of any
entrance to, or exit from, such a facility within its jurisdiction.
Section 2: It is the policy of the city to enforce this policy to the full extent allowed
by law.
