2015 11 16 FCPEMSD MinutesMINUTES OF THE SPECIAL MEETING OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT November 16, 2015 The Board of Directors of the Baytown Fire Control, Prevention, and Emergency Medical Services District (FCPEMSD) met in a Special Meeting on Monday, November 16, 2015, at 4:38 P.M., in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Brenda Bradley Smith President John Adkins Vice- President Richard Carr Director Maurice Watts Director Kimberlee Whittington Director Rick Davis General Manager Ignacio Ramirez, Sr. General Counsel Leticia Brysch Secretary President Bradley Smith convened the November 16, 2015, Fire Control, Prevention, and Emergency Medical Services District (FCPEMSD) Board Special Meeting with a quorum present at 4:38 P.M., all members were present with the exception of Directors Gerald Baldwin and Adelina Gomez - Abshire who were both absent. 1. MINUTES a. Consider approving the minutes of the Baytown Fire Control, Prevention, and Emergency Medical Services District Regular Meeting held on July 21, 2015. A motion was made by Director Maurice Watts and seconded by Director Richard Carr approving the July 21, 2015, FCPEMSD Board Regular Meeting minutes. CANVASS a. eCanvass the returns of the Baytown Fire Control, Prevention, and Emergency Medical Services District (FCPEMSD) continuation election held on November 03, 2015. President Bradley Smith presented the agenda item and stated that through the Secretary the sealed precincts were delivered to the FCPEMSD Board. PROPOSED RESOLUTIONS a. Consider a resolution declaring the results of the Baytown Fire Control, Prevention, and Emergency Medical Services District (FCPEMSD) continuation election held on November 03, 2015. Secretary Brysch presented the agenda item and stated that Resolution No. 41 declares the results of the Baytown Fire Control, Prevention, and Emergency Medical Services District (FCPEMSD) continuation election held on November 03, 2015, and by approving such makes the results official. A motion was made by Director Maurice Watts and seconded by Director Richard Carr approving Resolution No. 41. The vote was as follows: Ayes: Vice President John Adkins, President Brenda Bradley Smith, Director Richard Carr, Director Maurice Watts, Director Kimberlee Whittington Nays: None Other: Director Gerald Baldwin (Absent), Director Adelina Gomez - Abshire (Absent) Approved RESOLUTION NO. 41 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT CANVASSING THE RETURNS OF THE CONTINUATION ELECTION HELD WITHIN THE DISTRICT'S BOUNDARIES ON THE 3RD DAY OF NOVEMBER, 2015, FOR THE PURPOSE OF VOTING FOR OR AGAINST THE PROPOSITION OF WHETHER THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT SHOULD BE CONTINUED FOR FIVE (5) YEARS AND WHETHER THE FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT SALES AND USE TAX SHOULD BE CONTINUED FOR FIVE (5) YEARS; FINDING THAT NOTICE OF THE CONTINUATION ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. b. Consider a resolution approving the reprogramming of funds contained in the Baytown Fire Control, Prevention, and Emergency Medical Services District's Fiscal Year 2015 -2016 Budget from the Contingency Account (20701- 99001) to the Elections Account (20701- 74070) for expenditures related to election services for the Baytown Fire Control, Prevention, and Emergency Medical Services District's continuation election held on Tuesday, November 3, 2015. Secretary Brysch stated that Resolution No.42 authorizes the reprogramming of $13,000 from the Contingency Account (20701- 99001) to the Elections Account (20701- 74070) for expenditures related to FCPEMSD's election services. She stated that the adjustment was due to there being an increase in fees with Harris County and the change of the election being in November rather in May. The vote was as follows: Ayes: Vice President John Adkins, President Brenda Bradley Smith, Director Richard Carr, Director Maurice Watts, Director Kimberlee Whittington Nays: None Other: Director Gerald Baldwin (Absent), Director Adelina Gomez- Abshire (Absent) Approved RESOLUTION NO. 42 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT AMENDING THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT'S FISCAL YEAR 2015 -2016 BUDGET IN ORDER TO REPROGRAM FUNDS FROM CONTINGENCY TO ELECTIONS FOR EXPENDITURES RELATED TO ELECTION SERVICES FOR THE DISTRICT'S CONTINUATION ELECTION HELD ON NOVEMBER 3, 2015; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 4. a. Discuss the purchase of a new ambulance and fire truck. Assistant Fire Chief, Dana Dalbey presented the agenda item and stated that the new ambulance to be purchased goes before Council's approval at the November 16, 2015, Council meeting in which is expected to be received by the end of spring. He stated that the new fire truck Engine 4 has been ordered and in December, meetings will take place at Tower 7 for an Engine 4 as well. Additionally, he stated that the new vehicles will have the advertisement that it was purchased with FCPEMSD funds. 5. BUSINESS ITEMS a. Consider setting the time, date and place for the 2016 FCPEMSD Board meetings. Secretary Brysch presented the agenda item and stated that the dates for the 2016 calendar year FCPEMSD Board meetings are as follows: • Tuesday, January 19, 2016; • Tuesday, April 19, 2016; • Tuesday, June 21, 2016; FCPEMSD Board Special Meeting Minutes November 16, 2015 Page 7 of S • Tuesday, July 19, 2016; and • Tuesday, October 18, 2016. Additionally, she stated that the June meeting is scheduled for budget purposes. A motion was made by Director Kimberlee Whittington, and seconded by Director Maurice Watts approving the scheduled Board meetings for the 2016 calendar year for the FCPEMSD Board. REPORTS a. Present an update regarding the Baytown Fire Training Field, Phase 2. Assistant Fire Chief Dalbey presented the agenda item and stated that the redesign of the restroom and associated utilities, review of the steel for the rescue tower is complete with an expected delivery of six (6) weeks for the steel. He stated that Cox construction should start the ground work for the utilities around December and February is the tentative target date for construction on the redesign portion. President Bradley Smith stated that agenda items 6.b. and 6.c would be considered together. b. Receive the Baytown Fire Control, Prevention, and Emergency Medical Services District's Revenues and Expenditures Report for the Quarter ending September 30, 2015. C. Receive the Baytown Fire Control, Prevention, and Emergency Medical Services District's Quarterly Investment Report for the Quarter ending September 30, 2015. Acting Finance Director, Carl Currie presented the Baytown FCPEMSD's Revenues and Expenditures and Investment Report for the Quarter ending September 30, 2015. He stated that the district came in at about $110,000 above budget which was about $40,000 above last years actual. He stated that the sales tax receipts were up about 5.47% above the previous year resulting in 7% above the budget. He stated that the expenditures were about $77,000 under budget. FCPEMSD Board Special Meeting Minutes November 16, 2015 Page 8 of 8 In regards to the investment report, he stated that the district's ending portfolio was a balance of $667,000, with an average monthly interest rate of .0728 resulting in quarterly interest earnings of $132. 7. MANAGER'S REPORT a. Reminder that the next Baytown Fire Control, Prevention, and Emergency Medical Services District meeting is scheduled for Tuesday, January 19, 2016, at 4:30 P.M. in the Baytown Conference Room, City Hall, 2401 Market Street, Baytown, Texas. General Manager Davis presented the agenda item and stated that the next Baytown Fire Control, Prevention, and Emergency Medical Services District meeting is scheduled for Tuesday, January 19, 2016, at 4:30 P.M. in the Baytown Conference Room, City Hall, 2401 Market Street, Baytown, Texas. Director Watts recommended that a public announcement be done once the truck is received. 8.
