A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY AUTHORIZING PAYMENT IN THE AMOUNT OF FIFTY -NINE THOUSAND
SIX HUNDRED SEVEN AND NOI100 DOLLARS ($59,607.00) TO HARTWELL
ENVIRONMENTAL CORPORATION FOR THE PURCHASE OF REPLACEMENT
FLOCCULATOR PARTS FOR BASIN 4 AT THE BAYTOWN AREA WATER AUTHORITY
TREATMENT PLANT; MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, state law provides that when the functional requirements of the Baytown Area Water
Authority can only be satisfied by one source, the requirement for competitive bids is not applicable; and
WHEREAS, the procurement of replacement flocculator parts for Basin 4 at the Baytown Area Water
Authority Treatment Plant can be satisfied by only one source, Hartwell Environmental Corporation; NOW
THEREFORE;
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY:
Section 1: That the Board of Directors of the Baytown Area Water Authority hereby declares that
only one source can satisfy the needs of the Baytown Area Water Authority for replacement flocculator parts for
Basin 4 at the Baytown Area Water Authority Treatment Plant.
Section 2: That the Board of Directors of the Baytown Area Water Authority authorizes payment of
the sum of FIFTY -NINE THOUSAND SIX HUNDRED SEVEN AND N01100 DOLLARS ($59,607.00) to
Hartwell Environmental Corporation, as the sole source, for the purchase of replacement flocculator parts for Basin
4 at the Baytown Area Water Authority Treatment Plant.
Section 3: That the General Manager is hereby granted general authority to approve any change order
involving a decrease or an increase in costs of FIFTY THOUSAND AND NO /100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty -five percent (25 %) or decreased
by more than twenty -five percent (25 %) without the consent of the contractor to such decrease.
Section 4: This resolution shall take effect immediately from and after its passage by the Board of
Directors of the Baytown Area Water Authority.
