Ordinance No. 1,092-AORDINANCE NO. 1092 -A AN ORDINANCE CONTAINING ORDINANCE NO. 1092, INTRODUCED ON THE 22ND DAY OF APRIL, 1971, AND BEING, "AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUND- ARY LIMITS OF THE CITY OF BAYTOWN, TEXAS." PROVIDING FOR THE FINAL PASSAGE OF SAID ORDINANCE PURSUANT TO ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN, TEXAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That pursuant to Article I, Section 9, of the City Charter, said Ordinance No. 1092, introduced to the City Council of the City of Baytown on the 22nd day of April, 1971, in its original form shall read as follows: ORDINANCE NO. 1092 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described property, to -wit: BEING a 3.388 acre tract of land out of the Christian Smith Survey in Harris County, Texas, and being northeast of the City of Baytown, Harris County, Texas, and being more particularly described by metes and bounds as follows: COMMENCING at a point, said point being the intersection of the northerly right -of -way line of Massey Tompkins Road and the northwesterly right -of -way line of State Highway 146; THENCE, in a northeasterly direction along the northwesterly right -of -way line of State Highway 146 a distance of 320.00 feet to the POINT OF BEGINNING, said point situated in the existing Baytown City limit l i ne; THENCE:, south 80'30' west along the existing Baytown City limit line, a distance of 795.80 feet to a point, said point situated in the westerly line of a 12 foot utility easement; THENCE, north 09 030' west along the westerly line of said 12 foot utility easement, also along the Baytown City limit line, a distance of 140.00 feet to a point; THENCE, north 80 °30' east along the existing Baytown City limit line a distance of 74.42 feet, and continuing a total distance of 630.80 feet to a point; THENCE, north 09 °30' west a distance of approximately 180 feet to a point in the southerly right -of -way line of Tompkins Road; THENCE, south 57 °15' east along the southerly right -of -way line of Tompkins Road an approximate distance of 350 feet to a point, in the westerly right -of -way of State Highway 146; THENCE, south 40 047' west along the northwesterly right -of -way line of State Highway 146 an approximate distance of 115 feet, to the POINT OF BEGINNING. was held at 7:00 o'clock p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas, on the 8th day of April, 1971, which date is not more than twenty (20) days nor less than ten (10) days, prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a news- paper having general circulation in the City of Baytown, Texas, and in the above described territory on the 22nd day of March, 1971, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1st day of January, 1971, was 16,242.956 acres; and WHEREAS, the population of the City of Baytown, Texas, is approximately 50,000 inhabitants; and WHEREAS, the above described territory lies within the extra- territorial jurisdiction of the City of Baytown, Texas; and WHEREAS, the above described territory lies adjacent to and adjoins the City of Baytown, Texas; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS. -2- Section 1: That the following described land and territory lying adjacent to and adjoining the City of Baytown, Texas, is hereby added and annexed to the City of Baytown, Texas, and the said territory hereinafter described shall hereafter be included within the boundary limits of the City of Baytown, Texas, and the present boundary limits of such City, at the various points contiguous to the area hereinafter des- cribed, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas, to -wit: BEING a 3.388 acre tract of land out of the Christian Smith Survey in Harris County, Texas, and being northeast of the City of Baytown, Harris County, Texas, and being more particularly described by metes and bounds as follows: COMMENCING at a point, said point being the intersection of the northerly right -of -way line of Massey Tompkins Road and the northwesterly right -of -way line of State Highway 146; Section 2: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled -3- to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Baytown, Texas. Section 3: This ordinance shall be published and passed in the manner provided in Article 1, Section 9 of the Charter of the City of Baytown, Texas.
