Ordinance No. 13,094ORDINANCE NO. 13,094 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CLOSURE OF FERRY ROAD NEAR ITS INTERSECTION WITH STATE HIGHWAY 146; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on July 21, 2015, the Planning and Zoning Commission approved the recommendation to permanently close Ferry Road near its intersection with State Highway 146; and WHEREAS, on August 13, 2015, the City Council enacted Ordinance No. 12,924 to authorize the closure of sections of Ferry Road near its intersections with State Highway 146; and WHEREAS, the City Council desires to amend Ordinance No. 12,924 in order for its provisions to mirror the recommendation of the Planning and Zoning Commission, which was to permanently close Ferry Road near its intersection with State Highway 146; and WHEREAS, nothing in this ordinance or in Ordinance No. 12,924 shall be construed so as to abandon the Ferry Road right -of -way near its intersection with State Highway 146, as such right -of -way does and shall continue to exist; and WHEREAS, the City Council believes the closure of Ferry Road near its intersection with State Highway 146 as authorized herein is necessary for the public health, safety and welfare; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the recitals set forth hereinabove are hereby found to be true and correct. Section 2: That Section 2 of Ordinance No. 12,924 is hereby amended to read as follows: Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes the closure of the Ferry Road near its intersection with State Highway 146 as more particularly depicted in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes. Section 3: The Director of Public Works is authorized and directed to make the improvements and place the appropriate signs described in Exhibit "A." Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown this the 14'' day of January, 2016. SAIN T Tem Exhibit "A"
