2015 07 21 FCPEMSD MinutesMINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT July 21, 2015 The Board of Directors of the Baytown Fire Control, Prevention, and Emergency Medical Services District (FCPEMSD) met in a Regular Meeting on Tuesday, July 21, 2015, at 4:31 P.M., in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Brenda Bradley Smith John Adkins Gerald Baldwin Richard Carr Adelina Gomez - Abshire Maurice Watts Kimberlee Whittington President Vice- President Director Director Director Director Director Rick Davis General Manager Deanie King General Counsel Leticia Brysch Secretary President Bradley Smith convened the July 21, 2015, Fire Control, Prevention, and Emergency Medical Services District (FCPEMSD) Board Regular Meeting with a quorum present at 4:31 P.M., all members were present. 1. MINUTES a. Consider approving the minutes of the Baytown Fire Control, Prevention, and Emergency Medical Services District Special Meeting held on June 23, 2015. A motion was made by Director Maurice Watts and seconded by Vice President John Adkins approving the June 23, 2015, FCPEMSD Board Special Meeting minutes. The vote was as follows: Ayes: Vice President John Adkins, Director Gerald Baldwin, President Brenda Bradley Smith, Director Richard Carr, Director Adelina Gomez - Abshire, Director Maurice Watts, Director Kimberlee Whittington Nays: None Approved 2. PUBLIC HEARINGS FCPEMSD Board Regular Meeting Minutes July 21, 2015 Page 2 of 5 a. Conduct a public hearing to consider the Baytown Fire Control, Prevention, and Emergency Medical Services District 2015 -16 Proposed Budget. At 4:32 P.M., President Bradley Smith opened and conducted a public hearing to consider the Baytown Fire Control, Prevention, and Emergency Medical Services District 2015 -16 Proposed Budget. General Manager Davis presented the agenda item and stated that the proposed budget's sales tax was approximately $1.6 million with an ending working capital of approximately $337,000. Assistant Finance Director, Carl Currie stated that the budget remains the same since the last meeting. Mr. Mark Medrano registered to speak before the public hearing regarding agenda item 2.a. and stated that at the last meeting there was a discussion of funds being taking from the FCPEMSD and reallocated for equipment that usually comes out of capital budget. He stated that the original intent of the district was to fund the necessities of the fire training facility but if funds continue to be reallocated from the district it will delay the completion of the project. At 4:36 P.M. President Bradley Smith closed the public hearing regarding agenda item 2.a 3. PROPOSED RESOLUTIONS a. Consider a resolution adopting the Baytown Fire Control, Prevention, and Emergency Medical Services District (FCPEMSD) 2015 -16 Budget. Director Watts stated that in reviewing the budget there were items that are questionable and need clarity as to whether it is the responsibility of the FCPEMSD or the City to fund. Director Adkins stated that there were regular operating expenses that should be in the City's budget each year in which he's against adding into the FCPEMSD budget. He stated that he was involved when the board was stuck with paying for items that took years to develop a workable rotation to pay off. During further discussion, Director Watts inquired as to what would be the City's direction if the district requested for the budget to be revised. In response to Director Watts's inquiry, General Manager Davis stated that the City would have to either find other funding sources for the items in which they may or may not get funded. He stated that the condition of the City's budget is on financial ground, but that there was a difference in revenues and expenditures this year that is not expected to be experienced next year and therefore to his understanding there were costs that administration thought was relevant to fire protection which was therefore transferred to the district with the expectation of being a temporary event. He stated that he's optimistic about the City's financial capabilities moving forward and recommended for future purposes that the City work with the district to develop a policy that determines what can be placed in the FCPEMSD budget. Additionally, he stated that they are going to work aggressively with the Fire Chief on getting the fire field completed. The vote was as follows: Ayes: Vice President John Adkins, Director Gerald Baldwin, President Brenda Bradley Smith, Director Richard Carr, Director Adelina Gomez - Abshire, Director Maurice Watts, Director Kimberlee Whittington Nays: None Approved RESOLUTION NO. 39 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR, BEGINNING OCTOBER 1, 2015, AND ENDING SEPTEMBER 30, 2016, IN ACCORDANCE WITH CHAPTER 344 OF THE TEXAS LOCAL GOVERNMENT CODE AND THE ALTERNATIVE PROCEDURES ADOPTED BY THE DISTRICT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. b. Consider a resolution adopting the Baytown Fire Control, Prevention, and Emergency Medical Services District's Investment Policy and Strategy Statement in accordance with the Public Funds Investment Act. Mr. Currie presented the agenda item and stated that Resolution No. 40 revises the Baytown Fire Control, Prevention, and Emergency Medical Services District's ( "FCPEMSD ") Investment Policy and Strategy Statement with the following changes: 1) Annual Training requirement to 10 hours every year for an investment officer rather than every other year; 2) Adding Carl Currie as an authorized investment officer; and 3) Adding Credit Suisse as an authorized broker /dealers. A motion was made by Director Maurice Watts and seconded by Director Adelina Gomez - Abshire approving Resolution No. 40. The vote was as follows: FCPEMSD Board Regular Meeting Minutes July 21, 2015 Page 4 of 5 Ayes: Vice President John Adkins, Director Gerald Baldwin, President Brenda Bradley Smith, Director Richard Carr, Director Adelina Gomez - Abshire, Director Maurice Watts, Director Kimberlee Whittington Nays: None Approved RESOLUTION NO. 40 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT ADOPTING THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT'S INVESTMENT POLICY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 4. a. Consider the election of the President and Vice President and the appointment of the Secretary. Mrs. Leticia Brysch presented the agenda item and stated that the current officers were: Brenda Bradley Smith, President; John Adkins, Vice President; and the City Clerk, Secretary. Additionally, she stated that the elected officers new term will begin on September 01, 2015 and expire on August 31, 2016. A motion was made by Vice President John Adkins and seconded by Director Maurice Watts approving for the current officers to remain the same. The vote was as follows: Ayes: Vice President John Adkins, Director Gerald Baldwin, President Brenda Bradley Smith, Director Richard Carr, Director Adelina Gomez - Abshire, Director Maurice Watts, Director Kimberlee Whittington Nays: None Approved 5. REPORTS a. Present an update regarding the Baytown Fire Training Field, Phase 2. Chief Baylis presented the agenda item and stated that they opened bids on July 12th, with one (1) bidder for $1.55 million to add the five story rescue tower, a rescue prompt, and an outdoor shade structure that included a non - environmentally controlled single restroom. He stated that once started they anticipate 180 construction working days. FCPEMSD Board Regular Meeting Minutes July 21, 2015 Page 5 of 5 During further discussion, there was an inquiry as to if the rescue tower would have burning capability. Mr. Baylis stated that the tower would not have burning capability. Director Watts inquired if the funding costs saving amount previously submitted for approval could assist with restroom revisions. Chief Baylis stated that a change order could possibly be done to add to the validity of an additional restroom or air control. President Bradley Smith stated that agenda items 5.b. and 5.c. would be considered together. b. Receive the Baytown Fire Control, Prevention, and Emergency Medical Services District's Revenues and Expenditures Report for the Quarter ending June 30, 2015. C. Receive the Baytown Fire Control, Prevention, and Emergency Medical Services District's Quarterly Investment Report for the Quarter ending June 30, 2015. Mr. Currie presented the agenda items and stated that the revenues were slightly ahead of last year's with collections of 79.9% of budget. He stated that in the third quarter the district exceeded its investment earnings budget by almost $31 and that the sales tax receipts were up by 8.44% compared to last year. Additionally, he stated that although the expenses were on target the overtime account put the personnel services just above the 75% mark. Additionally, he stated that the portfolio balance was at $669,903 with quarterly earnings of $108.07 being an average rate of return of .0552 %. 6. MANAGER'S REPORT a. Reminder that the next Baytown Fire Control, Prevention, and Emergency Medical Services District meeting is scheduled for October 20, 2015, at 4:30 P.M. in the Baytown Conference Room, City Hall, 2401 Market Street, Baytown, Texas. General Manager Davis stated that the next Baytown Fire Control, Prevention, and Emergency Medical Services District meeting is scheduled for October 20, 2015, at 4:30 P.M. in the Baytown Conference Room. 7.
