Ordinance No. 13,071ORDINANCE NO. 13, 071 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING MAXIMUM PRIMA FACIE SPEED LIMITS FOR MOTOR VEHICLES IN DESIGNATED SCHOOL ZONES AND PROVIDING FOR HOURS OF ENFORCEMENT ON SCHOOL DAYS OR WHEN CHILDREN ARE PRESENT; AUTHORIZING AND DIRECTING THE PLACEMENT OF SIGNS BY THE DIRECTOR OF PUBLIC WORKS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 DOLLARS ($200.00); AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. ********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, pursuant to Section 545.356 of the Texas Transportation Code, authorizing alteration of maximum prima facie speed limits with respect to highways or portions thereof within the corporate limits of the City of Baytown based upon engineering and traffic investigations and requested public hearings; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That a special hazard exists to traffic safety in the vicinity of schools within the corporate limits of the City of Baytown on days when schools are in session and at times when students and other traffic approach from and depart from the vicinity of such schools and facilities and the City Council hereby makes such findings and determines and declares that the maximum prima facie speed limits to be reasonable, prudent and lawful are as follows at the time and place herein described: THE SCHOOL SPEED • AFTER THE START OF AFTER THE END OF EACH SCHOOL DA)'AT THE FOLLOWING LOCATIONS THE FOLLOWING SPEED LIMITS Street Limits Seed Limit School From 200 feet west of Lee Lee High School and Market Street Drive, to a point 3900 feet 30 MPH Early College High west of Lee Drive. Schools From 1100 feet south of Early College High Lee Drive Market Street, to a point 1500 20 MPH School feet south of Market Street. Section 2: The Director of Public Works is authorized and directed to place and install appropriate signs with flashing lights or beacons for the high schools referenced in Section 1 hereof, which lights or beacons shall flash to designate when the reduced speeds in the school zones are in effect. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
