Ordinance No. 13,035ORDINANCE NO. 13,035 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING MAXIMUM PRIMA FACIE SPEED LIMITS FOR MOTOR VEHICLES IN DESIGNATED SCHOOL ZONES AND PROVIDING FOR HOURS OF ENFORCEMENT ON SCHOOL DAYS OR WHEN CHILDREN ARE PRESENT; AUTHORIZING AND DIRECTING THE PLACEMENT OF SIGNS BY THE DIRECTOR OF PUBLIC WORKS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N0/100 DOLLARS ($200.00); AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. ***************************************************************************** WHEREAS, pursuant to Section 545.356 of the Texas Transportation Code, authorizing alteration of maximum prima facie speed limits with respect to highways or portions thereof within the corporate limits of the City of Baytown based upon engineering and traffic investigations and requested public hearings; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That a special hazard exists to traffic safety in the vicinity of elementary schools within the corporate limits of the City of Baytown on days when schools are in session and at times when students and other traffic approach from and depart from the vicinity of such schools and facilities and the City Council hereby makes such findings and determines and declares that the maximum prima facie speed limits to be reasonable, prudent and lawful are as follows at the time and place herein described: THE SCHOOL SPEED ZONE BETWEEN THE HOURS OF 7:45A.M. AND X:45 A.M. AND BETWEEN THE HOURS OF 3:00P.M. AND 4:00P.M. SHALL BE 20 MILES PER HOUR UPON THE FOLLOWING STREET LOCATIONS: Street Limi ts School Extending from 822 feet south west of Garth Banuelos Elementary Seabird Street Road to 14 7 5 feet south west of Garth Road, for a total distance of 653 feet. School Extending from 276 feet north of Connor Eastpoint Drive on East Point Boulevard to 300 feet Banuelos Elementary Boulevard north of Sheila Drive on Eastpoint Boulevard, School for a total distance of 276 feet. THE SCHOOL SPEED ZONE BETWEEN THE HOURS OF 7:15A.M. AND 8:15A.M. AND BETWEEN THE HOURS OF 2:30P.M. AND 3:30P.M. SHALL BE 20 MILES PER HOUR UPON THE FOLLO'vVING STREET LOCATION: Street Seabird Street Limits Extending from 30 feet west of Garth Rd to 822 feet south west of Garth Rd, for a total distance of 792 feet School Victoria Walker Elementary School as further depicted in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes. Section 2: That a special hazard exists to traffic safety in the vicinity of junior high schools , senior high schools , and other student attended facilities within the corporate limits of the City of Baytown on days when schools are in session and at times when students and other traffic approach from and depart from the vicinity of such schools and facilities. The City Council hereby makes such findings and determines and declares that the school zones and the maximum prima facie speed limits previously established for all Goose Creek Consolidated Independent School District's junior high and high schools located within the City of Baytown shall be enforced thirty minutes before and after the start of each school day and thirty minutes before and after the end of each school day and the City shall install flashing beacons or lights during the times the reduced speeds in the school zones are in effect. Section 3: The Director of Public Works is authorized and directed as follows: (a) to place the appropriate signs for the elementary schools referenced in Section 1 hereof at the locations described in Exhibit "A" and (b) to place and install appropriate signs with flashing lights or beacons for the junior high and high schools referenced in Section 2 hereof, which lights or beacons shall flash to designate when the reduced speeds in the school zones are in effect. Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional , void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 6: This ordinance shall take effect from and after ten (1 0) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing 2 the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
