AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, REPEALING CHAPTER 78 "PERSONNEL," ARTICLE IV "POLICE
OFFICER, FIREFIGHTER CLASSIFICATIONS," DIVISION 2 "POLICE
SERVICE GROUP," SECTION 78 -166 "POLICE CADET" OF THE CODE OF
ORDINANCES, BAYTOWN, TEXAS; AMENDING CHAPTER 78
"PERSONNEL," ARTICLE IV "POLICE OFFICER, FIREFIGHTER
CLASSIFICATIONS," DIVISION 2 "POLICE SERVICE GROUP," SECTIONS
78 -167 "POLICE ACADEMY TRAINEE" AND 78 -196 "PATROL OFFICER,"
SUBSECTION (D) "QUALIFICATIONS" OF THE CODE OF ORDINANCES,
BAYTOWN, TEXAS, TO CONFORM THE CLASSIFICATIONS IN THE
POLICE SERVICE GROUP TO THE CLASSIFICATIONS SPECIFIED IN THE
MEET AND CONFER AGREEMENT WITH THE BAYTOWN MUNICIPAL
POLICE ASSOCIATION, INC., AND TO UPDATE THE NAME OF THE
POLICE LICENSING COMMISSION; PROVIDING A REPEALING CLAUSE;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR EFFECTIVE
DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Chapter 78 "Personnel," Article IV "Police Officer, Firefighter
Classifications," Division 2 "Police Service Group," Subdivision II "Non -Civil Service,"
Sections 78 -166 "Police cadet' of the Code of Ordinances, Baytown, Texas, is hereby repealed
in its entirety.
Section 2: That Chapter 78 "Personnel," Article IV "Police Officer, Firefighter
Classifications," Division 2 "Police Service Group," Subdivision II "Non -Civil Service," Section
78 -167 "Police academy trainee" of the Code of Ordinances, Baytown, Texas, is hereby renamed
Section 78 -167 "Police officer trainee" and amended to read as follows:
CHAPTER 78. PERSONNEL
ARTICLE IV. POLICE OFFICER, FIREFIGHTER CLASSIFICATIONS
DIVISION 2. POLICE SERVICE GROUP
SUBDIVISION II. NON -CIVIL SERVICE
Sec. 78 -167. Police officer trainee.
(a) Status. The position of police officer trainee is a non - civil - service employee position
governed by city policy.
(b) General statement of duties. A police officer trainee shall perform training and
administrative duties while awaiting entrance into a police academy. A police officer
trainee shall be assigned as soon as reasonably practicable after being hired by the city to
the police academy for basic police officer training, as required by the Texas Commission
on Law Enforcement (TCOLE).
(c) Distinguishing features of the class. The police officer trainee is a noncertified, newly
hired employee awaiting entrance into or attending a police academy. The police officer
trainee shall attend and successfully complete a certified police academy. Probation for
the police officer trainee begins on the trainee's date of hire.
(d) Examples of work. The police officer trainee shall assists police department personnel
and regularly attend all classes at the police academy and shall complete the required
physical fitness requirements and successfully qualify at the shooting range.
(e) Qualifications. The police officer trainee shall meet the entrance requirements from the
Texas Commission on Law Enforcement (TCOLE); the qualifications established by
V.T.C.A., Local Government Code § 143.001 et seq.; and the civil service rules of the
city. The police officer trainee shall possess a valid Texas driver's license.
Section 3: That Chapter 78 "Personnel," Article IV "Police Officer, Firefighter
Classifications," Division 2 "Police Service Group," Subdivision III "Civil Service," Section 78-
196 "Patrol officer," Subsection (d) "Qualifications" of the Code of Ordinances, Baytown,
Texas, is hereby amended to read as follows:

ARTICLE IV. POLICE OFFICER, FIREFIGHTER CLASSIFICATIONS
DIVISION 2. POLICE SERVICE GROUP
SUBDIVISION III. CIVIL SERVICE
Sec. 78 -196. Patrol officer.
(d) Qualifications. A patrol officer shall have the ability to work under stressful conditions
and the ability to deal courteously with the public. A patrol officer shall have knowledge
of civil, traffic and criminal laws and city ordinances and shall have knowledge of
geography. The patrol officer shall have a high school diploma and 45 semester hours of
college or shall have successfully completed academy training from a certified program
or shall have prior police officer experience as a certified peace officer. A patrol officer
shall have basic police officer certification obtained from the Texas Commission on Law
Enforcement (TCOLE), shall have a valid Texas driver's license and shall have all other
qualifications of a patrol officer as established by V.T.C.A., Local Government Code §
143.001 et seq. and the civil service rules of the city.
Section 4: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered by this ordinance.
Section 5: If any provision, section, exception, subsection, paragraph, sentence,
clause or phrase of this ordinance or the application of same to any person or the set of
circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or their application to other
persons or sets of circumstances and to this end all provisions of this ordinance are declared to be
severable.
Section 6: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
