The fees set out below are adopted for the city services outlined herein:
(2) Development services. Any person applying to the city for a permit shall pay to the
city, prior to the issuance of the permit, a permit fee for any improvement based upon
the following schedules. If work for which a permit is required by this Code is
commenced prior to obtaining the required permit, the fees specified in this subsection
shall be doubled. The payment of this fee shall not relieve any person from any
penalties or enforcement action arising from a person's failure to timely obtain the
requisite permit.

Texas, is hereby amended by adding a new subsection to be numbered and entitled Subsection

Ordinances, Baytown, Texas, is hereby amended to read as follows:

Sec. 2 -766. Abandonment of streets and alleys.
(b) Upon the filing of such request and the fee as provided in this section, the city clerk shall
mail notices of the request and release forms by certified mail, return receipt requested, to
all abutting property owners. Any person filing such petition shall pay the abandonment
application fee as prescribed section 2 -595 upon filing the application. The requirements
of this subsection shall apply equally to section 2 -767 concerning the abandonment of
easements.
Section 6: That Chapter 98 "Utilities," Article VI "Stormwater," Division 1
"Generally," Section 98 -743 "Municipal drainage utility system charges," Subsection (a) "Fee,"
Subsection (1) "Residential property" of the Code of Ordinances, Baytown, Texas, is hereby
amended to read as follows:

hereby amended to read as follows:

ARTICLE II. ADMINISTRATION
DIVISION I. GENERALLY
Sec. 126 -36. Filing fee for plats.
(a) Fee to accompany application. Every application to the commission for the approval of
any proposed development shall be submitted to the planning and development services
department and shall be accompanied by a filing fee in accordance with the schedule
contained in section 2 -595 of the code, and the commission shall not act upon any plat
unless all fees as provided in that section have been received.
(b) Expiration. These fees shall expire after a maximum time period between the preliminary
and final approval of 180 days or as provided elsewhere in this chapter.
(c) Vacation of subdivisions. For vacation of a subdivision, the filing fee shall be in
accordance with the schedule contained in section 2 -595 of the code and in accordance
with V.T.C.A., Local Government Code §§ 212.013- 212.016.
Section 8: That Chapter 126 "Subdivisions," Article II "Administration," Division 2
"Lot Consolidation and Lot Line Adjustment," Section 126 -69 "Procedure for commission
approval," Subsection (a) of the Code of Ordinances, Baytown, Texas, is hereby amended to read
as follows:
CHAPTER 126. SUBDIVISIONS
ARTICLE II. ADMINISTRATION
DIVISION 2. LOT CONSOLIDATION AND LOT LINE ADJUSTMENT
Sec. 126 -69. Procedure for commission approval.
(a) Under this division, the following shall be submitted to the director of planning and
community development seven days prior to the commission meeting at which action is
sought:
(1) A completed application form for the lot line adjustment or a lot consolidation,
accompanied by a filing fee as prescribed in section 2 -595 of the code;

(2) Copies of deeds and restrictive covenants to all lots involved; and
(3) A scale drawing on legal size paper showing all lots involved, as platted, and as
desired.
Section 9: That Chapter 126 "Subdivisions," Article II "Administration," Division 3
"Small Subdivisions," Section 126 -97 "Platting procedure," Subsection (b) "Filing fee" of the
Code of Ordinances, Baytown, Texas, is hereby amended to read as follows:

3.7 "Amending Plats," Section 126 -117 "Platting procedures," Subsection (b) "Application fee"
of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows:

Sec. 126 -117. Platting procedures.
(b) Application fee. An application fee in the amount prescribed in section 2 -595 shall
accompany every application for an amending plat.
Section 13: That Chapter 126 "Subdivisions," Article IV "Improvements," Division 1
"Generally," Section 126 -454 "As -built or record plans," Subsection (b) of the Code of
Ordinances, Baytown, Texas, is hereby amended to read as follows:
CHAPTER 126. SUBDIVISIONS
ARTICLE IV. IMPROVEMENTS
DIVISION 1 GENERALLY
Sec. 126 -454. As -built or record plans.
(b) Along with the as -built plans specified in subsection (a) and in any event prior to final
plat approval, the subdivider shall also submit a fee in the amount prescribed in section 2-
595 for GIS development as -built verifications.
Section 14: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered by this ordinance.

Section 15: If any provision, section, exception, subsection, paragraph, sentence,
clause or phrase of this ordinance or the application of same to any person or the set of
circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or their application to other
persons or sets of circumstances and to this end all provisions of this ordinance are declared to be
severable.
Section 16: Sections 3, 6, 13, 14, 15, and 16 of this ordinance shall take effect from
and after ten (10) days from its passage by the City Council. Sections 1, 2, 4, 5, 7, 8, 9, 10, 11,
and 12 of this ordinance shall take effect on January 1, 2016. The City Clerk is hereby directed
to give notice hereof by causing the caption of this ordinance to be published in the official
newspaper of the City of Baytown at least twice within ten (10) days after passage of this
ordinance. /l
