BAWA Resolution No. 2015-12RESOLUTION NO. 2015-12 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY ELECTING TO BECOME A COOPERATIVE MEMBER IN THE LOCAL GOVERNMENT PURCHASING COOPERATIVE; AUTHORIZING THE PRESIDENT TO EXECUTE AN INTERLOCAL PARTICIPATION AGREEMENT WITH THE LOCAL GOVERNMENT PURCHASING COOPERATIVE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. *********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, the Baytown Area Water Authority (`BAWA ") desires to participate in a local government cooperative purchasing program pursuant to the authority granted by Chapter 791 of the Texas Government Code, the Interlocal Cooperation Act ( "Act "); and WHEREAS, BAWA wishes to be a Cooperative Member in The Local Government Purchasing Cooperative (hereinafter "Cooperative "), a local government purchasing cooperative program created by local governments in accordance with and pursuant to the Act and Section 271.101, et seq., of the Texas Local Government Code; and WHEREAS, BAWA is of the opinion that participation in the Cooperative's purchasing program will be highly beneficial to its rate payers through the efficiencies and potential savings to be realized; and WHEREAS, BAWA desires to participate and join with other local governments in an Interlocal Participation Agreement ( "Agreement ") for the purpose of fulfilling and implementing their respective public and governmental purposes, needs, objectives, programs, functions and services; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY: Section 1: That the Board of Directors of the Baytown Area Water Authority hereby requests that the Cooperative include its stated needs for all categories, including but not limited to, instructional, maintenance, custodial, and food service goods and services, in the Cooperative's purchasing program and select vendors for those items, whereby Baytown Area Water Authority may be allowed to purchase those items from the Cooperative's contracts; and that Cooperative is authorized to sign and deliver necessary requests and other documents in connection therewith for and on behalf of the Cooperative Members that have elected to participate. Section 2: That the Board of Directors of the Baytown Area Water Authority hereby elects for the Baytown Area Water authority to be a member of the Cooperative. Section 3: That the Board of Directors of the Baytown Area Water Authority hereby authorizes and directs the President to execute the Interlocal Participation Agreement with The Local Government Purchasing Cooperative, which is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 4: This resolution shall take effect immediately from and after its passage by the Board of Directors of the Baytown Area Water Authority.
