A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY AUTHORIZING THE PAYMENT OF SIXTY -EIGHT THOUSAND SEVEN
HUNDRED FIFTY -FIVE AND NO /100 DOLLARS ($68,755.00) TO RIGHTWAY
CONNECTIONS OF TEXAS, INC., THROUGH THE TEXAS DEPARTMENT OF
INFORMATION RESOURCES FOR THE PURCHASE AND INSTALLATION OF NEW
PLANT FIBER OPTIC CABLING; MAKING OTHER PROVISIONS RELATED THERETO;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the Baytown Area Water Authority may purchase fiber optic cabling through the Texas
Department of Information Resources ( "DIR ") pursuant to Section 2054.0565 of the Texas Government Code; and
WHEREAS, the DIR's purchasing process includes posting the request on the Electronic State Business
Daily (ESBD), gathering and reviewing the vendors' responses to the posting, negotiating with selected vendors,
and managing vendor contracts; and
WHEREAS, such process in combination with the interlocal cooperative contract allows the Baytown Area
Water Authority to purchase automated information systems products and/or services in an efficient, cost effective,
and competitive procurement method; and
WHEREAS, the Baytown Area Water Authority in making a purchase under a DIR contract through its
interlocal cooperation contract satisfies state law requiring municipalities to seek competitive bids for the purchase
of the item; NOW THEREFORE
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY:
Section 1: That the Board of Directors of the Baytown Area Water Authority hereby authorizes the
payment of SIXTY -EIGHT THOUSAND SEVEN HUNDRED FIFTY -FIVE AND NO /100 DOLLARS
($68,755.00) to Rightway Connections of Texas, Inc., through the Texas Department of Information Resources, for
the purchase and installation of new plant fiber optic cabling.
Section 2: That the General Manager is hereby granted general authority to approve any change order
involving a decrease or an increase in costs of FIFTY THOUSAND AND NO /100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25°.•'0) or decreased
by more than twenty -five percent (25 %) without the consent of the firm to such decrease.
Section 3: This resolution shall take effect immediately from and after its passage by the Board of
Directors of the Baytown Area Water Authority.
INTRODUCED, READ and PASSED, by the affirmative vote of the Board of Directors of the Baytown
